266. Whoever, without the written permission of the Municipality, digs up or removes earth, sand or other material from any open space, whether vested in the Municipality or not which is not private property, shall be liable upon conviction to a fine not exceeding [five hundred] rupees, and if the offence is a continuing offence, to a further fine not exceeding ten rupees for every day during which the offence continues after the date of the conviction for such offence.
