Section 41: Disabilities of members removed under section 40

[41. (1) A member removed under clause (a) of sub-section (1) of the preceding section shall, if otherwise qualified, be eligible for further election [ ] or nomination.

(2) A member removed under clause (b) of sub-section (1) of the preceding section [* * * *] shall not be so eligible [unless his qualification no longer exists] [* * * *]

(3) A member removed under sub-section (3) of the preceding section shall not be so eligible for a period of [five] years from the date of his removal :

[Provided that the [State Government may for sufficient reason exempt any person from this disability ] ;

(4) A member removed under any other provision of the preceding section shall not be so eligible until he is declared [for reasons to be specified] to be no longer ineligible, and he may be so declared by an order of the [State Government].
