YT MR RN ST, (3 wad), 2011 7 IN pursuance af the provisions of clause (3) of Articie 348 of the Constilution, the Governor is pleased to order the publicsiion of following English translation of notification no LX/Nine-9-2011- 65J/09, dated 13 January, 2011 NOTIFICATION No. LX /Nine-5-2011-65J/09 Lucknow : Dated: 13 January, 2011 WHEREAS the Utter Pradesh Municipalities (Public Disclosure of Information) Rules, 2010, wac published in Government notification no. 768/MNine-8-2610-653/09, dated May 13, 2010 for inviting, objections and suggestions as required under sub section (2) of section 540 of the Uttar Pradesh Municipal Corporation Act, 1959 (U.P. Act no. 2 of 1959) and sub section (1) of section 300 of the Uttar Pradesh Municipalitics Act, 1916 (U.P. Act no. 2 of 1916); AND whereas no objcstions or suggestions have been received in this regard within the stipulated time; Now, therefore. in exercise of the powers under sections 114, 540 and 573-B of the Utiar Pradesh Municipal Corporation Act, 1959 (U.P. Act no. 2 of 1959) and sections 7, 296 and 332-A of the Utiar Pradesh Municipalities Act, 1916 (U.P. Act no. 20f 1916), the Governor is pleased to make the following rules vith @ view (o regulaiing the disclosurc of information pertaining to various facts of municipal governance by a municipality:- THE UTTAR PRADESH MUNICIPALITIES (PUBLIC DISCLOSURE OF INFORMATION) RULES, 2010
1.(1) These rules may be called the Uttar Pradesh Municipalities (Public ~ Shortiile. Disclosure of Information) Rules. 2010. Amliameid commenceient
(2) They shall be applicable to all Municipal Corporatiors, Municipal Cauneils and Nagar Pancliayats in Uiler Pradesh
(3) They shall come into force with effect from the date of their publication in the Gazette. 2,(1) In these rules vnless there is anything repugnant in tic subject or Defitons context,- {2)'Act’ means the Uttar Pradesh Menicipal Corporation Act, 1959 in case of the Municipal Corporations and the Uttar Pradesh Municipalities Act, 1916 in case of a Municipal Council or a Nagar Fanchayat; (6 'Public disclosue’ means disclosure of information by a municiplity pertaining to various facts of municipal govemance, namely personnel, particulars of administrative structure, finances and operations as mentiened in rule-3.
(c) 'Schedule’ means the Schedule appended to these rules.
(2) Waords and expressions used in these rules bui not defined, shall have the meznings respectively assigned to them in the Actor the Constitution of India.
3. Every Municipal Corporation or Municipal Council or Nagar Panchayat Obligaion of 2 shall maintain its records with respect to the activities mentioned in sub-section (1) of ~Muncipality section 573-B of the Uttar Pradesh Municipal Corporation Act, 1959 or in sub-section
(1) of section 332:A of the Utiar Pradesh Municipelities Act. 1916 as the case may be., in the Forms given in the Schedule and publish them in the manner povided in the respective section of the said scetions, to disclose the required informatiss at'quarterly intervals.
