Section 22: Appointment

(1) On the occurrence of substantive vacancies, the Government shall make appointments to the Centralised Services for the list prepared under rule 20 and by promotion in accordance with the provisions of rule 21 :

Provided that in case where a appointment made both by promotion and direct recruitment, the Government shall make appointment in such vacancies by taking candidates alternately so far as this may be possible from the two lists of promoted and directly recruited candidates. Candidates shall be taken in the order in which they stand in the list and the first candidates taken shall be from the list of promoted candidates.

(2) The Government may also make appointment in temporary vacancies for a period exceeding six weeks from among the persons selected for promotion under rule 21:

Provided that if no approved candidate is available for such appointment, the Government may appoint a candidate who is eligible under the rules for permanent recruitment to the Centralised Services. The appointments under this provision shall be subject to the provisions contained in the U. P. Public Service Commission (Limitation of Functions) Regulations, 1954.

23. Regularisation of ad hoc appointment-Any person who:

(i) was directly appointed on ad hoc basis before October 1, 1986 and is continuing in service, as such on the date of commencement of these Rules:

(ii) possessed requisite qualification prescribed under rule 13 for regular appointment at the time of such ad hoc appointment; and

(iii) has completed cr, as the case may be, after he has completed three years continuous service, shall to considered for appointment in permanent or temporary vacancy as may be available on the basis of his service record and suitability before any regular appointment is made in such vacancy in accordance with the provisions contained in these rules.

(2) In making regular appointment under these rules, reservations for the candidate belonging to the Scheduled Castes, Scheduled Tribes, Backward Classes and other categories, shall be made in accordance with the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and other Backward Classes) Act, 1994 and orders of the Government in force at the time of recruitment.

(3) For the purpose of sub-rule (1) Government shall constitute a Selection Committee and consultation with the Commission shall not be necessary.

(4) The Director of Local Bodies shall prepare an eligibility list of the candidates, arranged in order of seniority as determined from the date of order of their ad hoc appointment and if two or more persons are appointed together, from the order in which their names are arranged in the said appointments order. The list shall be placed before the Selection Committee along with their character rolls and such other service records, pertaining to them, as may be considered necessary to judge their suitability.

(5) The Selection Committee shall consider the case of the candidates on the basis of their records referred to in sub-rule (4).

(6) The Selection Committee shall prepare a list of selected candidates, the names in the list being arranged in order of seniority, and forward it to the Government and the Director of Local Bodies.

(7) The Government or the Director of Local Bodies shall, subject to the provisions of sub- rule (2) of this rule and sub-rule (1) of rule 6 make appointments from the list prepared under sub- rule (6) of these rules in the order in which their names stand in the list.

(8) Appointment made under sub-rule (7) shall be deemed to be made under relevant provision contained in rule 22.

(9) A person appointed under this rule shall be entitled to seniority only from the date of order of appointment after selection in accordance with this rule and shall in all cases, be placed below the persons appointed in accordance with the procedure for direct recruitment contained in Part V of these rules prior to the appointment of such person under this rule.

(10) If two or more persons are appointed together under this rule, their seniority inter se shall to determined in the order mentioned in the order of appointment.

(11) The services of a person, appointed on ad hoc basis who is not found suitable or whose case is not covered by sub-rule (1) of this rule, shall to terminated forthwith and, on such termination, he shall be entitled to receive one month's pay.

24. Probation (1) A person on direct appointment to the Centralised Services in or against a substantive vacancy shall be placed on probation for a period of two years.

Provided that continuous service rendered in an officiating and temporary capacity in a post included in the cadre of the Centralised Services may be allowed, in whole or in part, to be counted by the government towards the period of probation;

Provided further that the Government may, for sufficient reasons to be recorded in writing, extend the period of probation in individual cases, for a further period not exceeding two years any such order of extension shall specify the exact period for which the extension is granted.

(2) If during or at the end of the period of probation or extended period of probation, it is found that a person has not made sufficient use of his opportunities or has otherwise failed to give satisfaction as to the standard expected of him, his service may, if directly recruited be dispensed with without entitling him to any notice or compensation; or if appointed by promotion, reverted to the post from which he was promoted.
