On receipt of the list prepared by the Commission, under rule 18, the Government shall subject to the provisions of rules 8, 11 and 21 have the names of the candidates entered in a waiting list in the same order in which they have been recommended by the Commission appointment.
PART VI-Procedure for Promotion
21. Promotions.
[[1] (1) Recruitment to the various categories of the promotional posts in the Centralised Services shall be made from the following sources, by preparing an eligibility list of the officers in the manner laid down in sub-rule (2)
(a) Assistant Engineer (Jal)-By Promotion through the Selection Committee from amongst substantively appointed Junior Engineers, on the basis of seniority subject to the rejection of the unfit.
(b) Executive Engineer (Jal)- By Promotion through the Selection Committee from amongst substantively appointed Assistant Engineers, on the basis of seniority subject to the rejection of the unfit.
(c) General Manager or Nagar Abhiyanta (Jal)-By promotion through the Selection Committee from amongst, substantively appointed, Executive Engineers, on the basis of Merit.]
(2) Preparation of eligibility list Except otherwise provided in sub-rule (6) the Government shall prepare a list to be called the eligibility list of senior most eligible candidate containing names, so far as may be in the following proportion:
for 1 to 5 vacancies twice the number of vacancies subject to a minimum of 5- for over 5 vacancies 1 1/2 (one and half times) the number of vacancies subject to a minimum of 10:
Provided that if recruitment is to be made for vacancies occurring during more than one year, separate eligibility list will be prepared in respect of each year. In such a case while preparing eligibility list for the second and subsequent years, the number of candidates to be included in the eligibility list shall be:
(a) for the second year the said proportion plus the number of vacancies in the first and second years;
(b) for the third year the number according to the said proportion plus the number of vacancies for the first and second years.
Provided further that candidates who are not considered suitable prima facie for promotion shall not be taken into account in calculating the said proportion and a note to the effect that they are not so considered shall be added against the names.
Explanation-In the rule "the number of vacancies" means the total number of substantive or temporary vacancies occurring during a year.
(3) The Selection Committee referred to in sub-rule (1) shall:
(a) In the case of promotions to class I and class II posts, be constituted as under—
(i) the Secretary to the State Government in the Urban Development Department...
Chairman.
(ii)the Secretary to the State Government in the Personnel Department or his nominee not below the rank of a Joint secretary……Member
(iii) the Director, Local Bodies, Uttar Pradesh... Member ________________________________ [1] ins by The Uttar Pradesh Palika And Jal Sansthans Water Works Engineering (Centralised) Services (Second Amendment) Rules, 2012.
(iv) if the officers referred to in sub-clauses (i) to (iii) do not belong to the Scheduled Castes or other Backward Classes one officer each belonging to the said castes or classes, as are not representing, shall be nominated by the Secretary to the State Government in the Urban Development Department from amongst the officers who are at least one scale higher to the post for which Selection Committee is to be constituted… Member
(b) In the case of promotions to the posts other than those referred to in clause (a), be Constituted as under-
(i) the Secretary to the State Government in the Urban Development Department or his nominee not below the rank of a Special Secretary. Chairman
(ii) an officer nominated by the Secretary to the State Government in the personnel Department not below the rank of a Joint Secretary… Member
(iii) the Director, Local Bodies, Uttar Pradesh…. Member
(iv) if the officers referred to in sub-clause (i) to (iii) do not belong to the Scheduled Castes or classes, one officer each belonging to the said castes or classes, as are not representing shall be nominated by the Secretary to the State Government in the Urban Development Department from amongst the officers who are atleast one scale higher to the post for which Selection Committee is to be constituted……Members.
(b) in the case of promotion to the posts other than those referred to in clause (a) be constituted as under :
(i) The Secretary to the State Government in the Urban Development Department Chairman or his nominee not below the rank of a special Secretary,
(i) An officer nominated by the Secretary to the State Government in the personnel Department not below the rank of a Joint Secretary…. Member
(iii) The Director, Local Bodies, Uttar Pradesh…. Member
(iv) If the officers referred to in sub-section (i) to (iii) do not belong to the Scheduled, Castes or other backward classes, one officer each belonging to the said Castes or classes as are not representing shall be nominated by the Secretary to the State Government in the Urban Development Department from amongst the officers who are at least one scale higher to the post for which Selection Committee is to be constituted…. Member
(4) (i) The Government shell fix a date or dates for the meeting of the Selection Committee.
(ii) Where the Selection Committee considers it necessary that candidates on the eligibility list be interviewed by it may also interview the candidates.
(iii) The Selection Committee shall in each case consider the character rolls of the candidate and may consider any other factor found relevant in its opinion.
(5) The Selection Committee shall prepare two list in order of Seniority, namely:
List A-containing name of candidates recommended for permanent appointment against substantive vacancies;
List B-containing name of candidates recommended for temporary or officiating appointment:
Provided that if recruitment is to be made for vacancies occurred in more than one year, the selection in respect of each such year shall be made for the eligibility list prepared for that year.
(6)(a) (i) Candidates included in List A shall be appointed under sub-rule (1) of rule 22 against substantive vacancies in the order in which their names appear in the list.
(ii) Candidates included in List (A) for whom substantive vacancies are not immediately available, shall be appointed in the said order, against temporary or officiating vacancies in preference to those included in List B.
(iii) The names of the candidates included in List A for whom substantive vacancies cannot be found during the year for which their selection was made shall at the end of the year; be carried over for appointment against the substantive post falling vacant in the subsequent year or shall be transferred to the top of list A, if any prepared and appreved to the subsequent year.
(b) Appointment from List B-Subject to the provisions of clause (ii) of sub-rule
(6) candidates included in List B shall be appointed in the order in which their names appear in the List B against temporary vacancies after List A is exhausted.
They may be appointed even against substantive vacancies but on a temporary basis. If at any time it appears to the appointing authority that an officer appointed from List B has not made sufficient use of his opportunities or has otherwise failed to give satisfaction such officer may be reverted to the post for which he was promoted, without assigning any reason.
