& Strength - ‘

(1) The strength of cach of the Certralised Services created under rule 3 shall be such as the Government may from time to time fix.

(2) Al the existing posts under the Palikas covered by the Centrafised Services shall form the present strength of these Services, (%) The Palika shall have no authority to abofish any of the existing posts under the Centralised Services or any such post which may be created in futurs,

(iii) the posts mentioned in Schedule-I1T shall be filled in equally from two sourc.es and in the manner mentioned above s0, however, that the odd post, if any, shall be filled in by promotion:

Provided that if suitable candidates are not available in the number required under this sub-rule for recruitment by promotion or by direct recruitment, as the case may be, the deficiency may be made good from either of the two sources ora temporary appointment may be made by deputation from amongst the officers serving under Government. ] ?2) The absorption or determination of services of officers and servants of the Palika, holding or performing the duties and functions of the posts referred to in rule3 immediately before the commencement of these rules, shall be governed by the following provisions:- () Permanent officers and servants of the Palikas as well as officers and servants referred to in clause (e) of Section 577 of the Uttar Pradesh Nagar Nigam Adhiniyam, 1959, shall unless they opt otherwise, stand absorbed provisionally subject to such orders as Government may in each case pass;

(i) Other temporary officers and servants shall, unless they opt otherwise, stand absorbed provisionally subject to such orders as Government may in each case pass; 2 I'shall be filled in by promotion in the

(iii) Such officers and servants as are provisionally absorbed under clauses

(i) and (ii), may, by subsequent orders of Government to be passed before the 31st day of August, 1967, be finally absorbed, if found suitable;

(iv) If in any case no orders to the contrary are passed by Government before the date mentioned in clause (i), the officers or servants shall be deemed to be finally absorbed;

Palika Centralised Services Rules, 1966 The services of officers and serva who opt against absorption as unsuitable for absorption, shall s prejudice to their claim toanyle as they would be entitled to termination of service, as the made, be paid the following ¢ ) nts referred to in the preceding clauses, well as of those who are found to be tand determined, and they shall, without ave, pension, provident fund or gratuity take or receive on their retirement or case may be, if these rules had not been ompensation — (@) officers and servants referred to in clause (i) - (A) thepayforthe remaining period of their service, or (B) six months pay in the case of officers and servants whose total continuous service im mediately before the commencement of these rules exceeded ten years, and three months’ pay in the case of officers and servants whose total continuous service as aforesaid did not exceed ten years;

() officers and servants referred to in clause (i) — one month’s pay.

Explanation - (I)- For the purposes of calculating pension or gratuity, if any, admissible to the officers and servants referred toin clause ( 1), whose services stand determined under this clause, the length of service qualifying for pension or gratuity shall be deemed to be added as follows:- ’ Length of service qualifying for pension or gratuity Addition to be made

(i) uptofiveyears one year

(if) over five years and up to 10 years two years

(i) over 10 years and up to 15 years three years

(iv) over 15 years four years . Explanation - (I)- For the purposes of this clause, “pay” includes any deamness allowance or other ad hoc addition by way of interim relief that may be admissible.

- (vi) The compensation mentioned in clause (v) shall be paid by the Palika - ‘ under whom the officer or servant was employed immediately before the commencement of these rules;

(vi) The option mentioned in clauses (i) and (if) may be exercised at any time before the 15th day of November, 1966 and intimation of exercise thereaf shall be sent to Government. Until option to the contrary is exercised the officer or servant shall, subject to the provisions of the foregoing clauses, stand absorbed provisionally.

(d) an Overseer or Junior Engineer shall, unless he opts against appointment, i found suitable by Government, be appointed as Junior Engineer in the Palika (Centralised) Services;

(e) theservices of Secretary, BBakshi or Superintendent, Overseer or Junior Engineer, who opts against appointment, or who is found unsuitable by Giovernment, shall stand determined.

(i) The provigions of clauses (v) and (vi) of sub-rule (2) shall mutatis mutandis apply to an employee whose services are determined under sub-rule (3) orsub-rule (4);

(i) The option mentioned in sub-rules (3) and (4) may be exercised within one month of the date of up-gradation of Municipality or conversion of the Town Area Committee or Notified Area Committee into a Municipality « and the option so exercised shall be sent to Government by the District Magistrate along with the service books, and the character roll and other personal files relating to each individual as also attested copies of the certificates of his educational qualifications. The District Magistrate of the district in which the local body is situate shall send his recommendation to the State Government through Director of Local Bodies, whether or not the employee’s work, conducet, qualification and general reputation regarding his integrity justifies his appointment on any post in the U.P.

Palika (Centralised) Scrvices.

The employees of local bodies which were upgraded or converted on or after July 9, 1966 shall also be entitled to exercise their option at any time before 15" day of December, 1979 and the intimation thereof shall be sent to Government.

Their cases of absorption/appointment in the Palika (Centralised) Services or otherwise shall be dealt with in accordance with sub-rules (3), (4) and (5).

Consequent upon inclusion of new posts in the Centralised Services under rule 3, or conversion of a Notified Area Committee or Town Area Committee into any class of a Municipality, the absorption/appointment or determination of services of officers and servants of the Palikas/Notified Area/Town Area Committee holding or performing the duties and functions of the posts immediately before the said inclusion/conversion shall be governed by the provisions in clauses (i) to (w’) given below :-

(i) officers and servants of the Palika shall, unless they opt otherwise, stand absorbed/appointed provisionally subject to such orders as may be made by Government in cach case;

(i) suchofficers and servants as are provisionally absorbed under clause (i) may, by subsequent orders of Government to be passed within 180 days of the inclusion of their posts in the Centralised Services, if found suitable, be finally absorbed,;

(i) if in any case no orders 10 the contrary are passed by Goy, before the expiry of the aforesaid period of 189 days, the officer, o servants shall be deemed to bc‘ finally W, '

(iv) the option for absorption/appointment mentioned in clause (i) may be exercised atany time before expiry of 60'da)s fiomdzed@cofm'c@m of the new post in the Centralised Services or conversion of Notified Area/Town Area Committee into any class of a Municipality and intimation thereof shall be sent to the Director of Local Bodies and the Government;

(¥) the option exercised under the foregoing clauses shall be sent to Government through the Director of Local Bodies by the District Magistrate in the case of Mupicipal Boards and by the Administrator or the Mukhya Nagar Adhikari in the case of Nagar Mahapalika (Nigam) along with the service book, character roll and personal file relating to each individual as also attested copies of the certificates of his educational qualifications and while doing so, the aforesaid authority shall also send his recommendation whether or not the employee’s work, conduct, qualification and general reputation regarding integrity justify his absorption/appointment in the Centralised Services;

(vi) theservices of officers and servants referred to in the preceding clauses who opt against absorption/appointment as well as of those who are .

found to be unsuitable for absorption/appointment shall stand determined and they shall without prejudice to their claim to any leave, pension, - provident fund, or gratuity as they would be entitled to take or receive on their retirement or termination of service, as the case may be, if these rules had not been made, be paid compensation according to the formula givenin clause (v) of sub-rule (2);

(vii) the compensation mentioned in clause (vi) shall be paid by the Palika/ Notified Area/Town Area Committee under whom the officer or servant was employed immediately before the inclusion of his post in the ~ Centralised Services:

Provided that this sub-rule shall not apply to the officers and servants who have already been ‘absorbed or who have been appointed on permanent or temporary basis on any centralized post.

Comments : Firstamendment to this rule was made on October 10, 1966 and Schedules I, II and IIl were added.

On October 5, 1979 sub-rules (3), (4). (5) and (6) were inserted. 16. Applications — The applications for recruitment to the Centralised Services shall be invited by (a) gle. Commission and shall be made on the prescribed form which may be obtained om the Secretary to the Commission on payment and shall be submitted within such t.ime as may be specified.

18. Fees —

(1) Candidates for direct recruitment shall pay to the Commission and to Medical Board such fees as may from time to time be prescribed by the Government.

No claim for the refund of fees shall be entertained.

(2) The syllabus and the rules relating to the competitive examination will be prescribed from time to time by the Commission with the approval of Government.

19. Approved List — On receipt of the list prepared by the Commission under rule 17, the Government shall, subject to the provisions of rules 7, 10 and 20, have the names of the candidates entered in a waiting list in the same order in which they have been recommended by the Commission for appointment.

(b) Subject to the provisions of sub-clause (ii) of clause (a), candidates included in List ‘B’ shall be appointed in the order in which their names appear in the list against temporary vacancies after List ‘A’ is exhausted.

They may be appointed even against substantive vacancies but on temporary basis. Ifatany time it appears to the appointing authority that an officer appointed from List ‘B’ has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, such officer may be reverted to the post from which he was promoted without assigning any reason.

Ifin any case the number of vacancies to be filled by promotion is small and the appointing authority considers the senior most eligible candidate or candidates clearly fit for promotion and also where no supersession is involved, he may approve the proposal straightaway. In that case no Selection Committee need be constituted and the candidates so approved shall be deemed to have been duly selected for promotion.] , Comments : A proposal for amending this rule was first made on April 25, 1974, it was modified on February 22, 1980 and notified on September 15,1990. Subsequent proposal was made on September 19, 1995 and was finalized on October 26, 1995 (19th Amendment). The original title Vacancies to be, filled by promotion was also modified.

Part-VII y Appointment, Probation and Confirmation

21. Appointment— O] On the occurrence of substantive vacancies, the Government shall make appointments to the Centralised Services from the list prepared under rule 19, and by promotion in accordance with the provisions of rule 20:

Provided that in case where appointment is made both by promotion and direct recruitment, the Government shall make appointment in such vacancies by taking candidates alternately so far as this may be possible from the two lists of promoted and directly recruited candidates. Candidates shall be taken in the order in which they stand in the list and the first candidate taken shall be from the list of promoted candidates.

53 U.P. Palika Centralised Services Rules, 1966 @ The Government may also make appointment in temporary vacancies for a period exceeding six weeks from among the persons selected for promotion under rule 20:

Provided that ifno approved candidate is available for such appointment, the Government may appoint a candidate who is eligible under the rules for Permanent recruitment to the Centralised Services. The appointments under this proviso shall be subject to the provisions contained in the U.P. Public Service Commission (Limitation of Functions) Regulations, 1954. Comments : An amendment 1o this was first proposed on January 9, 1973 but was not finalized.

21-A. Regularisation of Ad-hoc appointments- '[(1) Any person, who- @ (©) @ 5 ® @ was directly appointed on ad hoc basis before June 30, 1998 and is ' continuing in service, as sych on date of commencement of these rules,

(i) possessed requisite qualifications prescribed under rule 12 for regular appointment at the time of such ad hoc appointment, and

(iii) has completed or as the case ‘may be, after he has completed three years -of continuous service, shall be considered for appointment in permanent or temporary vacancy as may be available on the basis of his service record and suitability before any regular appointment is made in such vacancy in accordance with the provisions contained in these rules.

In making regular appointment under these rules, reservation for the candidates belonging to the Scheduled Castes, Scheduled Tribes, Backward Classes and other categories shall be made in accordance with the orders of the Government in force at the time of recruitment.

For the purpose of sub-rule (1), Government shall constitute a Selection Committee, and consultation with the Commission shall not be necessary.

The Director of Local Bodies shall prepare an eligibility list of the candidates, arranged in order of seniority as determined from the date of order of their ad hoc appointment and if two or more persons are appointed together, from the order in which their names are arranged in the said appointment order. The list shall be placed before the Selection Committee along with their character rolls and such other service records, pertaining to them, as may be considered necessary to judge their suitability.

The Selection Committee shall consider the case of the candidates on the basis of their records referred to in sub-rule (4).

The Selection Committee shall prepare a list of selected candidates, the names in the list being arranged in order of seniority, and forward it to the Government and the Director of Local Bodies,

The services of a person, appointed on ad hoc basis who is not found suitable or whose case is not covered by sub-rule (1) of this rule, shall be terminated forthwith and, on such termination, he shall be entitled to receive one month’s pay.]

Comments : There was no such provision in original Rulen. In pursuance of its decision to regularize the services in 1977, 1983 and 1986 the Regularivation of Government Emplayees Rules, 1978 were applied.

Subsequently, UP Nagar Nigam Adhiniyam, 1939 (section!12-4) and UP Munlcipalitles Act, 1916 (section 69- B) were amended to facilitate the regularization. The 121h Amendment (1984) Inserted this new rule. It was again modified by 16th Amendment (1986) and substituted on April 10, 2003(2151 Amendment),

22. Probation- Q) @ A person on direct appointment to the Centralised Services in or against a substantive vacancy shall be placed on probation for a period of two years:

Provided that continuous service rendered in an officiating and temporary capacity in a post included in the cadre of the Centralised Services may be allowed, in whole or in part, to be counted by the Government towards the period of probation:

Provided further that the Government may, for sufficient reasons to be recorded in writing, extend the period of probation in individual cases, fora further period not exceeding two years. Argy sgch order of extension shall specify the exact period for which the extension is granted. .

23. Confirmation — A probationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation, if his work and conduct are satisfactory and his integrity is certified.

‘[y./ Seniority — Seniority of persons substantively appointed in any category of posts in “ the Centralised Services shall be determined in accordance with the Uttar Pradesh Government Servants Seniority Rules, 1991 as amended from time to time.]

Comments : This rule was first amended by 27th Amendment (2016).

'[25. Transfer— (I) The State Government may transfer any officer of the Centralised Services from one Palika to the other.

(2) APalika may seek transfer of any officer of the Centralised Services by passing a special resolution to that effect by a majority of 2/3rd members constituting the Palika.]

Comments : This rule was first amended by 27th Amendment (2016) and sub-rule (2) was deleted.

Part-VIII Other provisions

26. Paying Authority — The pay and allowances of the officers of the Centralised Services, as fixed by the State Government, shall be paid by the Palika to the officers direct.

27. Pay during Probation—

(1) A personon probation, ifhe is not already in the permanent service of a Palika, shall draw, during the period of probation, the minimum pay of the post for the first year and increments as they accrue, provided that, if the period of probation is extended on account of failure to give satisfaction, the extended period shall not count for increment unless the competent authority so directs, but on confirmation, he shall be allowed pay as would be admissible to him according to his length of service.

(2) The pay during the period of probation of a person, who is already holding a substantive post in the service of a Palika before recruitment to the Centralised Services, shall be fixed in accordance with the relevant rules relating to the fixation of pay of the employees of the Palikas.

28. Criteria for crossing efficiency bars —

(1) No member of the Centralised Services shall be allowed to cross the first efficiency bar unless he is found to have worked satisfactorily and to the best of his ability and his integrity is certified to be above suspicion.

(1) Exceptas otherwise provided in these rules, all matters relating to leave and leave salary shall be regulated in the manner laid down in the leave rules applicable to the government servants of like status and all amendments thereto together with all explanations and clarifications issued from time to time shall mutatis mutandis, apply:

Fundamental and Subsidiary Rules contained in the Financial Hand-Book, Volume II, Parts Il to IV and travelling allowance rules contained in Financial Hand Book, Volume [Tl shall, mutatis mutandis, apply.

37 Adhikari or the President, as the case may be, of the Palika from where he has been transfgrred shall, within thirty days from the date of such transfer, forward to the Palika towhich he has been transferred. a full and complete account of the officer’s Provident Fund and cause to be transferred to his new account, the amount standing to his credit in the old account along with interest calculated up to the month in which the account is so transferred. All further interest onsuchamount as from the next succeeding month, shall be Rayable by the Palika where the new account has been opened. In circumstances other than those mentioned in rule 34, the officer shall continue to subscribe to his existing Provident Fund and tender such further amounts as may be requ'ired of him in connection therewith and the Palika administering the Fund shall continue to credit its own contribution thereto, and it shall be incumbent on the Palika, to which the officer has been transferred, to inform with all reasonable dispatch the Palika from where the officer has been transferred, the exact amount of his emoluments. Intimation about every change therein shall similarly be sent promptly.

The responsibility for payment upon an amount becoming due shall devolve on the Palika which is responsible for maintaining the Provident Fund for the time being.

Disciplinary Proceedings —

(1) Subject to such modifications as the Government may make from time to time, the rules regarding disciplinary proceedings, appeals and representations against punishments, as are applicable to the Government Servants shall apply to the officers and other employees of the Service.

(2) The authority competent to impose any punishment, major or minor, on the officers of the Centralised Services shall be the State Government:

Provided that the power to inflict any minor punishment shall also vest in the President of the Municipal Board or the MukhyaNagar Adhikari of the NagarNigam:

Provided further that the power to inflict major or minor punishment on the officers of Centralised Services in respect of whom power of appointment has been delegated to him by State Government, shall also vest in the Director of Local bodies:

Provided also that it shall be necessary to consult the Commission before passing an order for the dismissal or removal from service or reduction in rank in respect of any such officer.

(3) '[The power tosuspend an officer of the Centralised Services shall be exercised by the appointing authority only.]

(@) Incase where the disciplinary proceedings against an officer have been started by the President or Mukhya Nagar Adhikari in accordance with the provisions of sub-rule (2) above; and after the completion of enquiry he comes to a provisional conclusion that a penalty of dismissal or removal from service or reduction in rank is required, he shall refer the case along with his findings and recommendations to the Government for final orders.

Provided that —

(a) any such Centralised Services officer may, by order of Government without such notice or by a shorter notice, be retired forthwith atany time after attaining the age of fifty years, and on such retirement the CemralisedSeni:soficerslnnbemfidednchinasumequi\m © the amount of his pay plus allowances, if any, for the period of the notice or, as the case may be, for the period by which such notice falls short of three months, at the same rates at which he was drawing immediately before his retirement;

(b) itshall be opento Government to allow a Centralised Services officer to retire without any notice or by a shorter notice without requiring the Centralised Services officer to pay any penalty in licu of notice:

Provided further that such notice given by the Centralisad Services omagakstwhomadbci)finyplweedi:g‘spflfihgwcmhwd shall be effective only if it is accepted by Government provided that in officer shall be informed before the expiry of his notice that it has not been accepted:

Provided also that the notice once given by a Centralised Services officer under sub-rule (2) seeking voluntary retirement shall not be withdrawn by him except with the permission of Government.

(4) Aretiring pension and/or other retirement benefits, if: any, shall be available in accordance with and subject to the provisions of the relevant rules applicable to every Centralised Services officer who retires or is required or allowed to retire under this rule.

Explanation — (1) The decision uf Government under sub-rule (2) to require the Centralised Ser_vnces qfficer to retire as specified therein shall be taken if it appears to Government to !)e in public interest but nothing herein contained shall be construed to require any recital, in the order, of such decision having been taken in the public interest.

(2) Every such decision shall unless the contrary is proved, be presumed to have been taken in the public interest.

(3) Every order of the Government requiring a Centralised Services officer to retire forthwith under the pr_oviso (a) to sub-rule (3) of this rule shall have effect from the afternoon of the date of its issue, provided that if after the date of its issue, the Centralised Services officer concerned bona fide and in ignorance of that order performs the duties of his office, his acts shall be deemed to be valid notwithstanding the fact of his having earlier retired.]

Comments : First amendment to this rule was proposed on January 20, 1973 but not finalized. Subsequent proposal to amend was made on May 4, 1976. By inserting provision for compulsory retirement the 7th Amendment (1976) was made effective from 13th August, 1976.

39. Extension in Service — Extension in service may be allowed to the officers of the Centralised Services up to the age of 62 years for special reasons to be recorded by the Government: .

Provided that no extension of service shall be granted —

(i) forany period exceeding one year at a time; and

(i) unless the officer concerned is physically fitand efficient.

Comments : An amendment to this rule was proposed on November 20, 1973 bu{ not finalized.

40. (1) IfanydisputeordiffictflWarisamgmdmgmwrpretafionofanyofflrpmvisiom of these rules, the same shall be referred to the Government whose decision thereon shall be final and conclusive.

(2) Matters not covered by these rules shall be governed by such orders as the State Government may deem proper to issue.

41. Notwithstanding anything contained in these rules, where the Government is satisfied that the operation of any of the provisions of these rules causes undue hardship in any particular case, it may, by order, dispense with or relax the requirements of that provision to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner. .

42. Delegation of powers and functions - The Government may delegate its powers and functions under these rules to the Director of Urban Local Bodies or any other authority, as it deems fit.

Comments : The 20th Amendment (1996) inserted rules 43,44,45,46,47, and 48. Rule 43 provided Constitution of Palika Hill Sub-cadre; rule 44 was reluted to Allocation of members of Service to Palika Hill Sub-cadre; rule 45 made provision for Recruitment to Palika Iill Sub-cadre and rule 46 provided Seniority of the persons of Palika Hill Sub-cadre, Rule 47 was related 1o Regulation of other matters and rule 48 provided Savings. In addition, Schedule IV congisting of services Jalling under Palika Hill Sub-cadre was added. Subsequently, by 23rd Amendment (2006) rules 43, 44, 45 and 46 were substituted and a new cadre was formed. Divisional Sub- cadre substituted the Hill Sub-cadre. Rule 43 provided the Constitution of Palika Divisional Sub-cadre; rule 44 wan related to Allocation of members of Service to Palika Divisional Sub-cadre; rule 45 provided Recruitment to Palika Divisional Sub-cadre; and rule 46 was regarding scrmining Seniority under new cadre. The Schedule 1V was also amended. It consisted of the Educationul Qualifications and Mode of Entry related 1o Divisional Sub-cadre, Later on 23rd Amendment was annulled in 2008, I Inserted by 20th Amendment, Notification No. 1096/9-4-96, dated |5t May,1996, published on 28th June,1996;

subsequently substituted by 23rd Amendment (2006), which was annulled by Notification No. 1433/9-6-2008- Misc05, dated 15th May,2008, . %
