R “Atiicle; 348 of the Corsircr or i N |N. pursuance of the provisions of clause (B) of Article 348 of the Constitution of India, the Govemor is pleased (o order the publication of the following English translation of notification no. 1172/XXXVI-2 2022-105-2009, dated June 15,2022 No. 1172/ XXX VI-2-2022-105-2009 Dated Lucknow, June 15,2022 WIEREAS the rates of wages of Workmen employed in distillcry and Breweries Industry of the State were last revised vide notification no. 28/2016/814/36-2-2016-105/2009 dated 19-07-2016, under sccu.on 3(b) of the Uttar Pradesh Industrial Disputes Act, 1947 (U.P. Act no. 28 of 1947), which were made applicable from date 01-09-2010 10 31-08-2016 . It was provided in said notification that a committee for wage revision from 01-09-2016 shall be constituted which will be competent to recommend in relation to new wages and deame; lowances; Hiny ) AND, WHEREAS, a tripartitc committee under chairmanship of Labour Commissioner has been constituted by U.P. Government vide notification no. 1470/36-2-18-105/2009, dated 31-10-2018 which has been modified by office memorandim 0. l20‘9(2)/36-2-2021-]05!2009‘ dated 12-07-2021; . AND, WHEREAS, Various meetings of the committee wete convened under the chairmanship of the Labour Commissioner, in which after due deliberation, various points of wage revision were decided on 18-12-2021. Based on the decision taken by the Committee; the recommendations were made available to the State Government by the Labor Commissioner, Uttar Pradesh by letter number-2073-75/Chini veg board-21, dated 18-12-2021 , which ?ré accepted by it after due consideration;
AND, WHEREAS, in the opinion of State Government it is necessary to implement the recommendations of the committce regarding fevision of wages and variable dearness allowance for the maintenance of public order and also for maintaining employment;
Now, THEREFO_RE.V in exercj»sc,qf powers under\ clausg: (b) of section-3 of Uttar Pradesh Industrial Disputes Act, 1947 (UP. Act no. 28 of 47), the Govemor is pleased to make the following order and to direct with reference to Sec of id Act that the fiotice of this order shall be given by publication in the Gazette.
ORDER On the basis of decision taken by the tripartite committee under chairmanship of Labour Commissioner, U.P. the wage structure/salary to the workmen employed in distilleries and breweries industry shall be determined from dated 01-09-2016 as follows.
1. Revised wage stricture:-
(a) That the workmen of distilleries and breweries shall be given lump-sum enhancement of Rs. 650/- from dated 01-09-2016. . . n )
(b) The Consumer price index upto August, 2016 (1.¢. 6346 point) shall be merged at the rate 2.10 in the basic wage. ) ) ) A ‘
(c) Annual increment-The workers of the distillery industry will be given an annual increment at the rate of 0.5 (half) percent. ) On the basis of above formula the revised pay scale of the workmen shall be as follows:- S. 2. Due 1o revision as above if the basic wage of workmen falls between two slabs (level), the workmen's pay wapes shall be fixed in higher slab (level)
3. Vanable Deamess Allowance: Variable dearness allowance shall be payable at the rate of Rs. 210/ over and above 6346 points from 01-09-2016 and at the rate of Rs. 2.35/- aver and above 7350 point from 01-00-2019
4. Additional Enhancement: Additional lump-sum enhancement of Rs. 600/- shall be given to workmen from 01-09:2019 and if basic pay scale of any workmen falls in the middle of two slabs, the workers pay wapes shall be fixed in the higher slab.
S, Specinl - Allowanee The apecinl allowance as determined in the notification no. 28/2016/814/36-2-2016-105/209 dated July 19, 2016 shall be payable accordingly.
6. Fitment Formula : The detils of the instance of wages being paid to such workers as on August 31, 2016 in previous seale and in the revised pay scale on 1* Scptember, 2016 is being given as under:-

A-Un-Skilled Workmen Old Pay Scale 6757-35-6932-40-7132 Revised Pay Scale 13374-67-13709-72-14069 Suppose an Unskilled worker is drawing basic pay of Rs. 6862- in old pay scale on 31" August, Then admissible basic pay in revised pay scale on 1* September, 2016 to such worker shall be as follows:
Rs. 6862/- Basic Pay Lump-sum increasc Rs. 650/- Cent-percent neutralization of | Rs. 5967/~ DA up to August, 2016 Total Rs. 13479/- On the basis of above basic pay on 1* September, 2016 shall be Rs. 13479/~ which shall be fixed in the next stage of Rs. 13508/~ in the pay scale and the total wage of such worker on 1 * September, 2016 shall be as follows:
Basic Pay Rs. 13508/~ Fixed Allowance Rs. 785/- Variable l)eun:css Allowance | Rs. 00/- Total Rs. 14293 The workers whose basic wages comes more than the maxi calculation, their pay will be fixed afier adding as extra increment in the maximum of t heir pay scale mum of their pay scales as per abo ve and further increment at the same rate shall be admissible till the notificat ion is operatve.
Those workmen who have reached maximum of their pay scale will continue increment in their pay scale till continuance of notification.
7. Seniority Benefits : Those workmen, who has completed five ye:
has not been given benefit of promotion, shall be given benefit of wage fixation.

8. Payment of Arrears © Arrears of revised pay sh:
cight months from the date of notification all be paid to workmen in two i nstalments within Those workmen who have been retired before issue of notificatio n, shall be paid arrears in one instalment,
9. 1f n workmen is in receipt of nny wage allowance or any additional emoluments or benefits accordingly to any local agreement over and above the benefits provided in this notification, he shall continue to get those additional benefits and shall not be affected by this agreement. There will be no adjustment of amount being received by the employec as per local agreement from the arrears (o be paid as per the notification.
This notification shall remain in force from 01-09-2016 till further orders.
