Section 139: Application for fixation of rent

139. (1) Where any person is in occupation of any land as an asami without the rent being agreed upon, the asami or his landholder may apply to the Tahsildar for fixation of rent.

(2) On receipt of an application under sub-section (1), the Tahsildar shall make an inquiry in such manner as may be prescribed, and shall fix the rent in accordance with the rules made under this Code.

(3) The rent fixed under sub-section (2) shall be payable by the asami with effect from the date when he occupied the land as such asami.

(4) Any person aggrieved by an order of the Tehsildar under sub-section (2) may file an appeal to the Sub-Divisional Officer, and notwithstanding anything contained in other provisions of this Code, the order of the Sub-Divisional Officer shall be final.
