No. 7432/XX1X~—Food-4 Derted Lucknow, October 1, 1985 'WHEREAS, the State Government is of opinion that it is necessary and expedient so to do for maintaining the supplies of rice and for securing its equitable distribution and availability at fair prices; NOW, THEREFORE, in exercise of the powers under section 3 of the Essential Commodities Act, 1955 (Act no. X of }955) read with the Government of India, Ministry of Agriculture (Department of Food) Order no. GSR-800, dated June 9, 1978 and with the prior concurrence of the Ceniral Government, the Governor is pleased to make the following Order, namely i— THE UTTAR PRADESH RICE AND PADDY (LEVY AND REGU- LATION OF TRADE) ORDER, 1985 Short title, ex- 1. (1) This order may be called the Uttar Pradesh Rice and Paddy 'efllwf:_:gnm"‘- (Levy and Regulation of Trade) Order, 1985. men 2
(2) It extends to the whole of Uttar Pradesh.
(3) It shall come into force at once. Definitions. 2. In this order unless the context otherwise requires—
(a) ‘Border area’ means—
(i) the area of sixteen kilometres all along the border of the State adjoining the territory of China;
(ii) the area of fifteen kilometres all along the border of the State adjoining the territory of Nepal. {b) ‘Controller’ means the Regional Food Controller and includes Deputy Regional Food Controller, Regional Marketing Officer, Deputy Regional Marketing Officer or Assistant Regional Food Controller; (¢) ‘Custom Milling’ means milling of Paddy, not belonging to the miller, into rice in his rice mill cn payment of milling charges in cash or in kind.
(d) ‘Enforcement Officer’ means the Commissioner, Food and Civil Supplies, Uttar Pradesh, Additional Commissioner, Food and Civil Supplies, Uttar Pradesh, Deputy Commissioner, Food and Civil Supplics, Uttar Pradesh, Assistant Commissioner, Food and Civil Supplies, Uttar Pradesh, the Chief Marketing Officer, Food and Civil Supplies, Uttar Pradesh, the District Magistrate, Executive Magistrate Tahsildar, Naib-Tahsildar, the Regional Food Controller, Deputy Regional Food Controller, Regional Marketing Officer, Deputy Regional Marketing Officer, Assistant Regional Food Controller, Senior Marketing Inspector, Marketing Inspector, Assistant Inspector, District Supply Officer, Town Rationing Officer, Deputy Town Rationing Officer, Area Rationing Officer, Senior Supply Inspector, Supply Inspector, a Police Officer not below the rank of sub-Tnspector within the limits of their respective jurisdiction and a Police Officer not below the rank of Sub-Inspector attached to the Commissioner, Food and Civil Supplies;
(e) ‘Land less agricultural labourer’ means a person whose main source of livelihood is agricultural labour or cultivation and who, immediately before the commencement of this Order, neither holds no land or holds land not exceeding 0.40 468564 hectare (one acre) in Uttar Pradesh as a bhumidar, sirdar, asami or Government lesssee;
(f) ‘Licensed dealer’ means a person holding licence in Form ‘B’, ‘D’ or ‘E’ under the Uttar Pradesh Foodgrains (Dealers’ Licensing and Restriction on Hoarding) Order, 1976. ST TR JAETTN AHZ, 1 FF]A7, 1985 15
(g) ‘Licensed miller’ means the owner or other person incharge _f a rice mill, holding a valid licence under the Rice Milling Industry (Regulation) Act, 1958 (Act no. 21 of 1958) and includes a person or authority which has the ultimate control over the afl'qu'S of such mill and when the said affairs are entrusted to a Managing Director or Managing Agent, such Manager, Managing Director or Managing Agent.
(i) ‘Notified Price’ in relation to any variety of paddy or rice means price as notified by the State Government from time to time with the prior concurrence of the Central Government:
(i) ‘Paddy’ mecans rice in husk;
(j) ‘Permit’ means a permit issued by the Controler or an Officer authorised by him to a licensed miller to undertake custom milling:
(k) ‘Release Certificate’ means a certificate granted in the form given in Schedule I by a Marketing Inspector to a licensed dealer or licensed miller in token of his having sold the required quantities of rice/paddy to the State Government:
(1) ‘Rice’ means raw or parboiled rice;
(m) ‘Rice Mill’ means the plant and machinery with which and the premises, including the precincts thereof, in which or in any part of which rice milling operation is carried on and includes a rice huller attached to or maintained with any flour, oil, dal or other mill or pumping set;
(n) ‘Schedule’ means a schedule to this Order;
(0) ‘Spccifications’ means the specifications prescribed for paddy and rice and notified by the State Government from time to time;
(p) ‘Urban area’ means area included in any Town Area, Notified Arca, Cantonment Board, Municipal Board or a Nagar Mahapalika.
3. (1) Every licensed miller shall sell and deliver to the State Government at notified price sixly per cent of each variety of rice conforming to specificalions— " E
(a) held in stock and owned by him on the date of comniencement of this Order;
(b) milled by him every day out of stocks of paddy owned by him; and (¢) purchased by him or coming into his custody or possession for sale or disposal through him on Commission basis or in any other manner every day beginning with the date of commencement of this Order and until such time as the directs
Provided that in case of rice mills_of huller type with not more than one huller, the Controller may agree t& accept a hxed quantity. of rice of such variety or varieties as may be specified in lieu of the quantity due by way of levy as aforesaid for such period as may be agreed upon., The agreement shall be in the form set out in Schedule I :
Provided further that nothing contained in this sub-clause shall apply 1o a licensed miller having rice mill of huller type with not more than one huller operating in any area other than uiban area. ,
(2) Every licensed dealer shall sell and deliver to the State Government d_wucr cent of each variety of rice conforming to specifi-
(a) held in stock and owned by him on the date of commencement of this Order;
(b) milled by him every day out of his stocks of paddy; and (¢) purchased by him or coming into his custody or possession for sale or qi§posal through him on commission basis or in any other mannér every day beginning with the date of commencement of this Order and unfil such time as the State Government otherwise directs:
Provided that no levy shall be imposed under this sub-clause on the Food Corporation of India. 4. The rice required to be sold to the State Government under clause 3 shall conform to the specifications of rice of fair average quality notified by the State Government for that respective variety of rice and shall not contain re(ractions beyond rejection limit shown in the Government notification and in case any stock of rice offered for sale does not conform to such specifications, it shall be reconditioned or rectified or otherwise brought in conformity with specifications by the licensed miller or the dealer as the case may be before being so offered.
5. (1) No licensed miller or licensed dealer shall sell or otherwise dispose of or remove to any place other than his usual place of business or storage in a particular locality his stocks of rice* or paddy except in accordance with a release certificate issued by -the Centre incharge/Senior Marketing Inspector/Marketing Inspector as a token of having sold the prescribed percentage of paddy/rice in levy under clause 3 to the State Government.
(2) Save as otherwise provided in sub-clause (1) no licensed miller or licensed dealer shall transport rice for sale from the premises of the rice mill or the godown declared in the licence except in accordance with the release certificate referred to in sub-clause (1) :
Provided that if part of any lot of rice in respect of which release cerlificate as aforesaid has been obtained is moved by road, the driver or person incharge of the vehicle carrying such rice shall carry a certificate from the Senior Marketing Inspector/Marketing Inspector having jurisdiction at the place of despatch indicating that rice moved is a part of released stock. This certificate shall also indicate the name, the license number and address of the dealer/miller in whose favour the particular lot of rice was released and also the date and number of release certificate as well as grades and total quantity of rice released under that release certificate.
Explanation—No licensed miller who is exempt from levy under second proviso to clause 3(1)(c) shall transport from his premises of the rice mill or the godown declared in the licence rice/paddy for sale except in accordance with a transport certificate issued by the Controller or his nominee in the form set out in Schedule 1I1.
6. The Controller or his nominee—
(a) shall purchase rice from any person including a licensed miller having a rice mill of huller type with not more than one huller operating in area other than urban area also at the notified price, if 1t conforms to the specifications notified.
(b) may in accordance with the directions of the State Government accept for rice due to be sold to the State Government under clause 3.
(i) parboiled rice of same variety in lieu of rawrice ot vice versa ;
(ii) rice even in excess of levy due if voluntarily offered, (¢) The Controller or his nominee shall, subject to such general or special instructions as may be issued from time to time by the State Government for taking delivery of the quantity of rice sold under clauses 3 on behalf of the licensed miller or the lincensed dealer shall sive a receipt to him specifying the quantity and variety of rice delivered by him and the date of taking delivery thereof.
7. Any person on whose behalf the licensed dealer holds any stock of rice/ paddy the whole or part of which such dealer is required to sell to the State Government shall, notwith standing any contract or instrument ot the contrary, not be entitled to recover from the dealer on account of the value of the stock as sold, anything more than the price received by the licensed dealer under the said sub-clause. s order shall deliver to erson from whom levy is due under thi t LR 4 e sold in the Controller or his nominee the stocks of rice-paddy required to b such lots and in such manner, at such place and at such times as the Controller or his nominee may direct. : FET AR AT T97E, 1 AT, 1985 lia REEEE e et . 9. The percentage of rice recovered from corrasponding variety of 3 shall be deemed to be as follows, unless proved to the contiary and the levy due un. clause 3 shall be calculated accordingly : Common variety i 34 o2 68 Fine and super fine variety 5 I 66.5 Scented variety = e ) 66 _ Provided that the State Government may, in public interest, reduce the perzentage of recovery in respect of any area or in relation to any varisty ot grade of paddy :
Provided further that if the actnal recovery in a mill is higher than the deemed reccvery percentage levy shall be taken only on the basis of dzemedrecovery percentage and not on the actual recovery:
Provided also that the Controller on being satisfied that the percentage of recovery in any case is fess than that specified in this clause may accept such reduced percentage of levy as he, for reasons to be recorded in writing, thinks fit.
10. Notwithstanding anything contained in clause 3 10 levy skall be charged in respect of rice obtained by hulling of paddy at a rice mill of huller typ> hav ng not more tkan one huller in quantity up to fifty kilograms at a time subject to a maximum of two quaintals jn onc calender month by—
(a) an agriculturist of paddy produced by him ; cr
(b) a landless agricultural labourer.
11. No licensed rice miller shall undertake custom milling of »addy exc:pt under and in accordance with a permit in the form set out ‘n Schedule 1V :ssuec by the Contolier or an officer authorised by him in this behalf.
12. (1) Every licensed miller or licensed dealer shall sell to the State Governmrent at the notided price sixty per cant of any paddy in stock on the commencement of this order or received-by him thareafter and reraaining unconverted into rice, khell, laiya or choora within three months or sach extended time as the Controller may, in special circumstances allow: .
Provided that in case time is extended buyond three months, the Controller shall make a report of the order exiending time to the State Government, who may vary, amend ot rescind such order:
Provided further thatno levy shall be imposed on any stocik of paddy, pur-hased or otherwise acquired in respect of whicih levy in aceordanc: with this sub-clause has been imposed and paddy dclivered to the State Government:
Provided further that no paddy shall reraain vnmilied with the miliers at the end cf the marketing season in which the paddy has been purchased.
(2) The licznsed miller or licensed dealer who has delivered levy paddy uad:c sub-clause (i) shall obtain a relense certificate and tae provisicns of clauss 5 shall matatis matandis apply to movement of such paddy. . (3) The conditions prescribed in regard to specifications, payment of notified price and delivery of levy rice shall mutatis mutandis apply to the delivery of paddy under sub-clause (2).
13. (1) No person shall export out of Uttar Pradesh paddy without perrassion in writing of the Regional Food Coatroller, Deputy Regional Food Controller or Regional Marketing Officer.
(2) Nothing contained sab-clause (1) shall apply to the export of paddy: _ (i) on Government account or by or in behalf of the Feod Corpora-~ tion of India ; or
(i) under and in aczordance with Military Credit Note; or
(iii) from one part of Nepal to another through the interlying territory of Uttar Pradesh. 17 Recovery of rice from paddy. Exemption from levy. Permit for custom milling. Levy on Paddy. (b) from any place in the border area to any other place in that area; except under and in accordance with a permit issued in this behalf by the State Government or the Regional Food Controller ot the District Magistrate of the border area concerned :
Provided that nothing contained herein shall apply to such movemeni :
(i) on Government account or by or on behalf of the Food Corporation of India, or ;
(i) under and in accordance with the Military Credit Notes: or
(iii) within the same town or village in the border area. . 15. The driver or incharge of a vehicle carrying paddy or rice through an interlying territory of Uttar Pradesh shall produce his documents before the Marketing Inspector/Senior Marketing Inspector of the nearest checkpost of Uttar Pradesh who shall, after necessary verification his satisfaction, make an endorsement to the following effect which shall entitle the vehicle to cross the exit barrier of the State. 16. For the paddy or rice delivered as levy, payment shall be made at the notified price in accordance with the specifications to be notified by the State Government from time to time.
17. (1) The nctificd price referred to is for the fair average quality of rice or paddy of that vatiety conforming to the specifications notified under clause 16 and shall be subject, in relation to rice or paddy below that quality, to deductions specified in the specifications
(2) 1f rice or paddy offered for sale con exceeding rejection limit mentioned in the specifications for that particular variey of rice or paddy, the Controller or his nominee may direct the concerned licensed dealer/miller to bring such rice or paddy in conformity with the specifications by removing such admixtures : tains admixture of lower varieties
Provided that if rice or paddy offered for sale contains admixture of any variety of rice or paddy specified in Schedule V beyond rejection limit mentioned in the specifications for that particular variety of rice or paddy, the Controller or his nominee may for the purpose of this Order treat such rice/ paddy belonpiac t- that lower variety the admixture of which is highest and price for that lower varicty shall be payable for such sice/paddy.
(3) (i) Four samples of rice or paddy delivered in levy shall be drawn, sealed and signed Dy the ficensed dealer/miller or his representative and the Controller or his representative. One sampe shall be handed over to the licensed dealer/miller or his representative and 1wo samples shall be fo_rwarded to the Regional Check Laboratory. ‘The Controller or his representative s!mll make analysis of the remaining sample in presence of the licensed dealer/miller or his represeniative and make payment at the notified price accordingly :
(i) If the licensed dealer/miller is not satisfied with the results of analysis done he shall within three days file an objection in writing to the person who made the analysis for its re-analysis :

(iv) If the licensed dealer/miller is not satisfed with the result of analysis done at the Regional Check Laboratory, he may within three days of such analysis, represent to the Regional Food Countroller for analysis at the Cen- tral Check Laboratory. The Regional Food Controifer shail forward such representation to the Chief Marketing Officer. The Chief Marketing Officer shall fix a date for analysis of tie sample not later than fifteen days of receipt of representation from the Regional Food Controller and direct concerned licensed dealer/miller to be present at the time of analysis along with the sealed sample given to him. On the fixed date analysis of such sample in possession of licensed dealer/miller shall be done at the Central Check Laboratory by the Chief Marketing Officer whose findings shall be final.
(v) Necessary adjustment in price shall be made according to the results of final analysis af the Regional/C: entral Check Laboratory as the case may be
8. The State Government may direct any licensed rice any stocks of paddy into rice held by the State Gov on such terms and conditions as may be notified from time to-time ; mill to convert erament or its agencies by the State Government
Provided that the quantity of Paddy to be State Government or its agencies during one kh: ning from Ist October shall not e; capacity to be caleulated on an a given to & rice mill by the arif marketing season beginxceed forty per cent the annual licensed verage of 300 working days.
Explanation.—For the purpose of this clause the Jicensed milling capacity of any licensed rice mill shall be ihe same as mentioned in the licence issued under the Rice Milling Industry (Regulation) Act, 1958 and the rules made thereunder,
19. Notwithstanding anything contained in the Utiar P, : radesh Foodgrains (Dealer’s Licensing and Restricti. on on Hoarding) Order, 1976 :
(a) (i) Licensed miller having sheller or sheller-cuz-huller or battery of hullers type rice mill ; or
(ii) Licensed dealer holding licence under Forin B’ and ‘E’. may store paddy in any quantity ;
(b) Licensed dealer under Form ‘B’ and ‘E’ may store rice in quantity ot exceeding five hundred quintals excluding levy share against each licence separately; and
(c) licensed miller having sheller or sheller- hullers type rice mill and holding a licence under Form ‘B’ of “the Uttar Pradesh Foodgrains (Dealer’s Licensing and Resiriction on Hoarding) Order, 1976 may store rice in quantities not exceeding :—
(i) one thousand quintals excluding fev milling capacity is up to one tonne per hour ; cum-hulier or battery of share in case the
(if) two thousand quintals excluding levy share in case milling capacity exceeds and tonne but does ot exceed fwo tonnes per hours

(d) enter and search, with such aid or dssistance as may be neccssary :— such mill or other promises;
(e) seize and remiove with such aid or assistance as may be Dnecessary i—
(i) any stock of rice or paddy in respect of which or part of which he has reason to believe the contravention of any of the provisions of this order has been or is being or is about to be committed :
(ii) any package, covering or receptacle in which such stock of rice or paddy is found; and (iiiiy any animal, vehicle, vessel or other conveyance used in carrying such stock of rice or paddy if he has reason to believe that such animal, vehicle, vessel or other conveyance is liable to be forfeited under the proyisions of the Essential Comumnodities Act, 1955 and thereafter, without unreasonable delay, make a report to the Controller under the provisions of section 6-A of the said Act. Seize and remove any bocks of accounts or documents which in his opinion, shall te useful foz, or relevant to any proceeding in respect of any contravention of this order and allow the person from whose custody such books of accounts or documents are sezed to make copies thereof to take extracts therefrom in his presence.
(2) The provisions of section 100 of the Code of Criminal Procedure, 1973 (Act no. 2 of 1974), relating to search and seizure shall, so far as may be, apply to search and seizure under this clause.
21. Every licensed dealer and licensed miller shall maintain such records and submit such periodical return as the controller or his nominee may direct from tirae to time.
22. Any miller or dealar or other person aggrieved by the order of the Controller or his nomince fixing the quantity of levy, may within seven days from thz date of service of such order, appeal to the Divisional Commissioner exercising jurisdiction in the area in which the mills of the miller, or the busi~ ness premises of the dealer in situate.
(2) The Divisional Commissioner shall fix the date, time and plece for hearing the anpeal thus preferred to him and may from time to time zdjouwrn the hearing.
(3) The Divisional Commissioner may iv appeal _confirm or set aside tke order appealed against or rednee or enhance the quantity of rice to te sold under the said crder.
(4) The Divisional Commissioner shall communicate in writing the order passed in appeal to the appelent and ajso the purchases officer concerned.
