Section 222: Refund of stamp duty and penalty

Refund under Section 45 of the Stamp Act should be by application in writing to the Collector who should forward it to the Chief Controlling Revenue Authority. Such application should bear court-fee as an application to a Collector. While forwarding the application for the orders of the Chief Controlling Revenue Authority, the Collector should submit the file of the case containing the original document bearing the endorsement of the payment of duty and penalty and an English translation of the same. The Collector should also express his own opinion on the merits of the application.
