(a) establish the State ApprenƟceship Council in UƩar Pradesh, to be known as the "UƩar Pradesh State ApprenƟceship Council", for a period of three years from the date of publicaƟon of this noƟficaƟon in the Official GazeƩe;

(c) to determine the term of office of, the procedure to be followed in the discharge of their funcƟons by, and the manner of filling vacancies among, the members of the UƩar Pradesh State ApprenƟceship Council (hereinaŌer referred to as the "Council") as follows:-
(1) Term of Office-
(i) The Council shall be consƟtuted for a period of three years and thereaŌer it shall be reconsƟtuted at the end of every three years. All the members appointed to it shall accordingly hold office for a period of three years:
Provided that a member of the Council shall, notwithstanding the expiry of the aforesaid period of three years, conƟnue to hold office unƟl his successor is appointed;
(ii) Where a person is chosen as a member of the Council by virtue of the office or appointment he holds, he shall cease to be a member if he ceases to hold that office or appointment
(2) CessaƟon of membership-
(i) A member of the Council shall cease to be a member if he dies, resigns, becomes of unsound mind, is declared insolvent or is convicted of a criminal offence involving moral turpitude;
(ii) The office of a member of the Council shall fall vacant from the date on which resignaƟon is accepted or on the expiry of thirty days from the date receipt of leƩer of resignaƟon, whichever is earlier.
(3) Filling of vacancies-
(i) Any vacancy in the membership of the Council caused by reasons menƟoned in item (a) of subclause (2) above, shall be filled by the State Government.
(ii) A member appointed to fill a casual vacancy shall hold office for so long as the member whose place he fills would have been enƟtled to hold office if the vacancy had not occurred.
(4) Time and place of meeƟng- The Council shall meet as oŌen as may be necessary and at least once a year on such date, Ɵme and place as may be determined by the Chairman.
(5) NoƟce for meeƟng- The Secretary shall give a noƟce of not less than fiŌeen days for meeƟng of the Council to each member but a shorter noƟce may be given for holding an emergent meeƟng.
(6) Quorum for the Council- One-third of the number of members of the Council shall consƟtute the quorum for any meeƟng of the Council.
(7) Decision by majority-
(i) All quesƟons to be decided by the Council shall be in accordance with the opinion of the majority of the members present and voƟng;
(ii) Each member shall have one vote. If there is equality of votes, the Chairman shall have and exercise the casƟng vote.
(8) Decision by circulaƟon- The Chairman may, in special circumstances, instead of convening a meeƟng of the Council, obtain the opinion of the members on any item of business individually by circulaƟon of papers and such item shall be decided in accordance with the opinion of the majority.
(9) Proceeding of the Council-
(i) Copies of all proceedings of the Council shall be furnished to the Secretary of the State Council for VocaƟonal Training. Any views expressed or suggesƟons made thereon by the said State Council shall be duly considered by the Council ;
(ii) In all other maƩers, the Council shall follow such procedure as it may determine.
(10) Power to co-opt members- The Council may, at any Ɵme invite, any person to aƩend its meeƟngs to give advice or assist in any maƩer. The person so invited shall, however, not be enƟtled to vote on any quesƟon coming before the Council.
(11) CommiƩees of Council-
(i) The Council shall have the power to appoint such Standing or Special CommiƩees for assisƟng it in the discharge of its funcƟons as may be considered expedient by it;
(ii) The funcƟon of the Standing or Special CommiƩees shall be determined by the State Government, and
(iii) The composiƟon of the Standing or Special CommiƩees shall be determined by the State Government.
(12) Fees and allowances to members- The Chairman and the representaƟves of the State Government will draw travelling and daily allowances for aƩending the meeƟng of the Council or of its CommiƩees from the State Government in accordance with the rules of the Government. All other members of the Council will be paid travelling and daily allowances by the State Government for aƩending the meeƟngs of the Council or of its CommiƩees at the rates admissible to a Government Officer of Group 'A' in accordance with the relevant rules.
(13) AuthenƟcaƟon of acts and proceedings-
(i) All acts and proceedings of the Council shall be authenƟcated by the Chairman, or with the approval of the Chairman, by the Principal Secretary/Secretary, VocaƟonal EducaƟon and Skill Development and Entrepreneurship Department, UƩar Pradesh.
(ii) The Principal Secretary/Secretary, VocaƟonal EducaƟon and Skill Development and Entrepreneurship Department, UƩar Pradesh shall carry out the decisions of the Council. By order, (DR. HARI OM) Pramukh Sachiv.
