Act no. 23 of 1980), and all other powers enabling in this behalf, the Governor is pleased to make the following rules:- THE UTTAR PRADESH STATE LEGISLATURE (FACILITIES TO LEADER OF OPPOSITION) RULES, 1981
CHAPTER 1 Preliminary Short title and commencement
1. (1) These rules may be called the Uttar Pradesh State Legislature (Facilities to Leader of Opposition) Rules,
1981.
(2) They shall come into force at once. Definitions 2. In these Rules-
(a) Act means the Uttar Pradesh State Legislature (Member's Emoluments and Pension) Act, 1980;
(b) "Members Emoluments Rules" means the Uttar Pradesh State Legislature (Member's Emoluments and Pension) Rules, 1981 ;
(c) all other words and expressions used and defined in the Act but not defined in these Rules shall have the meanings assigned to them in the Act. CHAPTR II Salary and Constituency Allowance Salary when to become due
3. (1) Subject to the provisions of these rules, the salary of the Leader of Opposition shall become due on the first day of succeeding month, and may be drawn on that very day or any day subsequent thereto.

(2) In case the recognition of the Leader of Opposition is withdrawn by the Speaker or the Chairman, as the case may be, or the office of the Leader of Opposition otherwise becomes vacant, his salary shall become due on the day following the date of such withdrawal or vacancy, and it may be drawn on that very day or any day subsequent thereto. Drawing officer 4. (1) The Leader of Opposition shall be the drawing officer of his salary bill, and the Secretary shall be the controlling officer in respect of such bill.
(2) The Leader of Opposition shall forward to the Treasury officer of the district where the payment of the salary bill is required to be made, a specimen of his signature for the purpose of verification before payment of such bill. Information to Accountant General
5. When a person ceased to be the Leader of Opposition either by resignation, death or otherwise, the Secretary shall immediately inform the Accountant General, the date of which such person ceased to be the Lender of Opposition. Constituency allowance
6. The provisions of this Chapter shall mutatis mutandis apply to the claim in respect of the constituency allowance as they apply to the claim in respect of the salary.

CHAPTER V Telephone Telephone Facilities 12. (1) The Leader of Opposition shall be entitled to one internal and one external telephone installed in his office room in the Secretariat at the expense of the State Government in addition to the telephones to which he is entitled as member under rule 37 or rule 38 of the Members’ Emoluments Rules.
(2) The Leader of Opposition shall be entitled at the expense of the State Government to free local calls and in addition to such Trunk calls as are made in public interest from all the telephones referred to in sub-rule (1).
CHAPTER VI Staff Staff to the Leader of of Opposition [13. Secretary shall provide the following staff to the Leader of Opposition namely-
(a) one Private Secretary (Grade-II):
(b) one Public Relation Officer:
(c) one Personal Assistant:
(d) one Jamadar;

CHAPTER VII Miscellaneous Miscellaneous provisions
15. The Leader of Opposition shall continue to enjoy such other facilities to which he is entitled as a member under the Members’ Emoluments Rules and for which no express provision has been made under these rules. Applicability of rules 48 and 49 of Members’ Emoluments Rules The provisions of rules 48 and 49 of the Members’ Emoluments Rules and the form prescribed under the said Rules shall mutatis mutandis apply in respect of the provisions of these rules. Interpretations of Rules If there is any doubt or dispute about the interpretations of any provisions of these rules, the matter shall be referred to the State Government, and the decision of the Government there on shall be final.
