Section 11: The Kulpati (Vice-Chancellor)

[ (1) The [Kulpati] (Vice-Chancellor) shall be a whole time officer of the University. The first [Kulpati] (Vice-Chancellor), after the commencement of the Uttar Pradesh Krishi Vishwavidyalaya (Sanshodhan) Adhyadesh, 1966, shall be appointed by the [Kuladhipati] (Chancellor) out of a panel of three persons nominated by a search committee consisting of an ex-officio member of the Board i.e. [the secretary/Principal secretary/Addl. Chief Secretary of the Agriculture Education and research department and two other member appointed by the State Government and two other members appointed by the State Government. ]

[ (1-A) Where the Kuladhipati (Chancellor) does not consider any one or more of the persons recommended by the Committee to be suitable for appointment as Kulpati (Vice-Chancellor) or if one or more of the persons recommended is or are not available for appointment and the choice of the [Kuladhipati] (Chancellor) is restricted to less than three persons, he may require the Committee to submit a panel of fresh names in accordance with sub-section (1). ]

[(2) (a) Only such person shall be eligible for the appointment to the office of [Kulpati] (Vice-Chancellor) who has not attained the age of 65 years ;

[(b) The [Kulpati] (Vice-Chancellor) shall hold office for a term of three years from the date he enters upon his office or till he attains the age of sixty-eight years whichever is earlier ;

[(c) The [Kulpati] (Vice-Chancellor), who has not attained the age of 65 years may be appointed as such for second term ;

[Provided that the [Kulpati] (Vice-Chancellor) may in writing under his hand addressed to the[Kuladhipati] (Chancellor) resign his office, and shall cease to hold his office on the acceptance by the Chancellor of such resignation. ]

(3) [* * * *]

(4) The emoluments and other conditions of service of [Kulpati] (Vice-Chancellor) shall be such as may be prescribed and shall not be varied to his disadvantage after his appointment.

(5) The [Kulpati] (Vice-Chancellor) may relinquish office by resignation in writing addressed to the [Kuladhipati] (Chancellor). The resignation shall ordinarily be delivered to the Secretary of the [Kuladhipati (Chancellor)] sixty days prior to the date on which the [Kulpati (Vice-Chancellor)] wishes to be relieved.

[(6) In any of the following circumstances [ of the existence of which the [Kuladhipati] (Chancellor) shall be the sole judge], the [Kuladhipati] (Chancellor) may appoint any suitable person to the Office of [Kulpati] (Vice-Chancellor) for such term not exceeding six months, as he may specify —

(a) where a vacancy in the Office of [Kulpati] (Vice-Chancellor) occurs or is likely to occur, by reason of leave or any cause not being expiry of term ;

(b) where a vacancy in the Office of [Kulpati] (Vice-Chancellor) occurs and it cannot be conveniently and expeditiously filled in accordance with the provisions of sub-section (1) ; and

(c) any other emergency.]

[Provided that the Chancellor [Kuladhipati] may from time to time extend the term of appointment of any person to the office of Vice-Chancellor (Kulpati) under this sub-section so however, that the total term of such appointment (including the term fixed in the original order) does not exceed one year.]

Until the vacancy is filled under sub-section (6) or until such time as the [Kuladhipati[ (Chancellor) appoints a [Kulpati] (Vice-Chancellor)] the [Kul Sachiv] (Registrar) shall carry on the current duties of the office of the [Kulpati] (Vice-Chancellor).
