On the failure of the passenger to produce the ticket or receipt under Rule 23, the Magistrate or the authorised employee, as the case may be unless satisfied that such passenger has not intentionally travelled without a ticket or carried goods without a receipt may without prejudice to any action that may be taken against such passenger under any law for the time being in force, take action for his prosecution under Section 46 of the Act.
