9. [If any member of the Council, whether elected or nominated, under sub-section (1) of section 4 dies or resigns his membership or ceases to be a member under the provisions of sub-section (1) of section 8, the vacancy shall be filled within three months by a fresh election or nomination, as the case may be, in accordance with the provisions of sub-section (1) of section 4 and in default of election, by nomination in accordance with the provisions of section 5.]
