Section 16: Limitation of Prosecution

UP Electricity Duty Rules 1952State Rules of Uttar Pradesh · 1952

(1) No court shall take 5 ] ‘cognizance of any offence punishable under this Act unless complaint thereof is made within three months of the date on which the alleged commission of the offence came to the knowledge of an Inspecting Officer :

Provided that no cognizance shall be taken of an offence committed unless it is brought to the notice of the Inspecting Officer within 24 months of the date on which the same was committed :

Provided further that where the offence consists of disobeying a written order made by an Inspecting Officer, complaint thereof any be made within six months of the date on which the offence is alleged to have been committed.

(2) No Court shall take cognizance of an offence under thé Act and these rules except on a complaint made by the Electrical Inspector or the Deputy Electrical Inspector.
