Section 8: Removal of the Chairperson or a Member

(1) Subject to the provisions of sub-section (2), the Chairperson or any Member shall only be removed from his office by the State Government on the ground proved misbehavior after the panel of three enquiry officers appointed from the officers equivalent to Secretary to the Government for this purpose on reference being made to them by the State Government, has, on enquiry, held by the panel and in consultation with the leader or opposition reported that the Chairperson or the Member ought on any such ground to be removed:

Provided that such Chairperson or any Member may be removed from his office on the basis of such enquiry report only on the recommendation of thepanel headed by the Chief Minister, the Minister of Irrigation and the leader of opposition as members thereof.

(2) Notwithstanding anything contained in sub-section (1), the State Government may, by order, remove the Chairperson or a Member from his office if he has incurred any of the disqualifications mentioned in section 5.

(3) Notwithstanding anything contained in sub-section (2), the Chairperson or a member shall be removed from his office on the ground specified inclause (b), clause (d) or clause (o) of section 5 as per the process given in sub-section (1).

(4) The State Government shall pass suitable order in accordance with the report referred to in sub-section (1) or sub-section (3), as the case may be, and the final decision of the State Government shall be communicated to the Chairperson or other Member concerned within a period of 30 days of receipt of such report.
