IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 1546/ XXX11-2-2023, dated June 30,2023 :
No. 1546/ XXXI111-2-2023 Dated Lucknow, June 30, 2023 IN exercise of the powers under section 237 read with section 44 of the Uttar Pradesh Kshettra Panchayats and Zila Panchayats Adhiniyam, 1961 (U.P. Act no. 33 of 1961), the Governor is pleased to make the following rules to regulate the recruitment and conditions of service of persons appointed to the post of Executive Engineer in Zila-Panchayats of Uttar Pradesh.
UTTAR PRADESH (ZILA PANCHAYAT) [EXECUTIVE ENGINEER (CIVIL) CENTRAL (TRANSFERABLE) CADRE] SERVICE RULES, 2023
PART-] ) GENERAL . '
1. (1) These rules shall be called the Uttar Pradesh (Zila Panchayat) Shertitleand [Executive Engineer (Civil) Central (Transferable) Cadre] Service Rules, 2023. Yo
(2) They shall come into force at once.
2. In these rules, unless there is anything repugnant in the subject or context—
(a) "appointing authority" means the Govemor;
(b) "cadre" means the Central Transferable Cadre of Executive Engineer (Civil) created under rule 3;

(d) “Governor” means the Governor of Uttar Pradesh;
(€) “member of the service” means a member of the service substantively appointed under these rules or the rules or orders in force before the commencement of these rules, to a post in the cadre of the higher service;
) nservice® means the Uttar Pradesh (Zila Panchayat) [Executive Engineer (Civil) Central (Transferable) Cadre] Service;
(g) "selection committee” means the selection commitice constituted under rule 8; ;
. (h)."State" means the State of Uttar Pradesh; _ . (i) "substantive appointment" means appointment to the post of Executive @mgineer (Civil) in the cadre of service, not being an ad hoc appointment or on deputation, made after selection in accordance with these rules and, if there were no rules, in accordance with the procedure prescribed for selection for the time being by way of exccutive orders issued by the Government;

. PART-1I CADRE AND NUMBER OF MEMBERS . 3. A central transferable cadre for the post of Executive Engineer (Civil) in Zila Panchayats shall be created.
4. (1) The strength of cadre of members created under rule 3 shall be such as - may be determined by the Government from time to time.

5. Recruitment to the posts of Executive Engineer (Civil) in the cadre shall be made from the following sources:
Executive Engineer (Civil)-By promotion from amongst the substantively appointed Engineers who have completed seven years of service on the first day of the year of recruitment. ;
LI s - . 6. Reservation for candidates belonging to Scheduled Castes, Scheduled Tribes and other categorics shall be in accordance with the Government orders in force at the time of recruitment.

PART-1V PROCEDURE OF RECRUITMENT
7. The Appointing Authority shall determine the number of vacancies (as per reservation under rule 6) to be filled during the course of the year of recruitment, and shall inform about the same to the Selection Committee.
8, (1) Recruitment to the post of Executive Engineer (Civil) in Zila Panchayats shall be made, after rejecting unfit candidates, on the basis of seniority by way promotion, through a Selection Committee constituted as follows:- i. | Additional Chief Secretary/Principal Secretary/ Chairman Secretary, Panchayati Raj Department, Government of Uttar Pradesh ii. | Secretary, Personnel Department, Government of Member Uttar Pradesh or a person nominated by him who shall not be below the rank of Joint Secretary iii. | Secretary, Social Welfare Department, Government of | -Member Uttar Pradesh or a person nominated by him who shall not be below the rank of Joint Secretary -~ iv. { Director, Panchayati Raj Department, Government of Member Uttar Pradesh or a person nominated by him who shall not be below the rank of Joint Secretary v. | A person nominated by the Principal Secretary, Member Panchayati Raj Department, Government of Uttar Pradesh who shall not be below the rank of Joint Secretary '
(2) The appointing authority shall prepare an eligibility list of engineers working in the Zila Panchayats, from the seniority list, in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the purview of the Public Service Commission) Eligibility List Rules, 1986, as amended from time to time, and shall place it before the Selection Committee alongwith their character rolls, pertaining to them, as it may deem fit. '
(3) The Selection Committee shall consider the cases of the candidates on the basis of the records referred to in sub-rule (2) and shall prepare a list of the selected candidates in the order of their seniority as it stands in the cadre from which he is to be promoted. The Selection Committee shall forward such list to the appointing authority.
PART-V APPOINTMENT, PROBATION, CONFIRMATION, SENIORITY AND TRANSFER
9. (1) The appointing authority shall make appointments of the candidates in the order in which their names appears in the list prepared under rule 8.
(2) If more than one candidate is appointed simultaneously then in the order the seniority number of the candidates shall be same as in the list issued by the Selection Committee.
10, All appointments done under these rules shall be notificd in the Gazette.
. 11.(1) A person on substantive appointment to a post in the cadre shall be placed on probation for a period of two years. _
(2) The appointing authority may, for reasons to be recorded, extend the period of probation in individual cases specifying the date upto which the extension is granted:

(3) If it appears to the appointing authority, at any time during or at the end of the period of probation or extended period of probation, that a probationer has not made sufficient use of his opportunities or has otherwise failed to give satisfaction, he may be reverted to his substantive post, if any, and if he does not hold a lien on any o post, his seryices may be dispensed with. :
(4) A probationer who is reverted or whose services arc dtspensed with under sub-rule (3) shall not be entitled to any compensation.
Confirmation 12. A probationer shall be confirmed in his appointment at the end of the period of probation or the extended period of probation if,
(a) his work and i:bndum is reported to be satisfactory, and his integrity is cemfied and
(b) the appointing authonty is satisfied that he is otherwise fit for confirmation.
Seniority 13. The seniority of the persons substantively appointed to:the post of Executive Engineer (Civil) in the cadre shall be, determined from the date of the order of the substantive appointment and if two or more persons arc appointed together, in the order in which their names were placed in the order of appointment. A Posting and 14. The Government can post Executive Engineers in any of the Zila teangfer Panchayats of Prayagraj, Jaunpur, Azamgarh, Sitapur and Hardoi and can transfer them .
to any of the above five Zila Panchayats.
PART-VI ' SCALE OF PAY Scale of pay 15. (1) The scales of pay admissible to persons appointed to the cadre shall be such as may be determined by the Government from time to time.
(2) The scales of pay of Executive Engineer (Civil) according to these rules shall be as follows:

A person on probation shall be"allowed his first increment in the pay-scale when he has completed one year of satisfactory service, has undergone training, where i prescribed, and second increment after two years service when he has completed the probationary period and is also confirmed:
Provided that, if the period of probation is extended on account of failure to give satisfaction, such extension shall not count for increment.-unless the appointing authority directs otherwise.
* ~ PART-VII OTHER PROVISIONS Canvassing. ' 17. No recommendation, cither written or oral, other than that required under these rules shall be taken into consideration. Any attempt on the part of a candidate to enlist support directly or indirectly for his candidature will disqualify him for appointment.
Regulation of other 18. In regard to the matters not specifically covered by these rules or specm! | Tt orders, persons appointed to the cadre shall be governed by the rules, regulations and orders applicable generally to Government servants serving in connection with the affairs of the State.

19. Where the State Government is satisfied that the operation of any rule Relaxation of regulating the conditions of service of persons appointed to the cadre causes undue ™ hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with_ the case in a just and equitable manner.
20. Nothing in these rules affect reservations and other concessions required to Savings be provided for the candidates belonging to the Scheduled Castes, Scheduled Tribes and other special categories of persons in accordance with the orders of the Government issued from time to time in this regard.

(5) Superintending Engineer (Civil) - By promotion through the Selection Committee from amongst substantively appointed Executive Engineers of Zila Panchayat Monitoring Cell Gazetted Officer Cader, who have completed Total fifteen years substantive scrvice on the first day of the year of recruitment including minimum six years service as Executive Engineer.
(6) Chief Engineer(Civil) level-2 - By promotion through Selection Committee from amongst the substantively appointed Superintending Engineers on the first day of selection year, who have completed a total of 25 years of substantive service in the Zila Panchayat Monitoring Cell Gazetted Officer Cader.
Amendment 4. In the said Rules, for existing Rule 17 as sct out in Column-1 below, the rule as of set out in Column-2 shall be substituted, namely:- Rule-17 ’ .

NOTE- Nomination of officers for giving representation to Scheduled Castes, Scheduled Tribes and Other Backward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under section-7 of the Act as amended from time to time.

(1)-Pracedure for recruitment of Deputy Director/ Executive Engineer/Superintending Engineer / Chief Engineer by promotion- recruitment by promotion of Deputy Director/ Executive Engineer/ Superintending Engineer/ Chief Engineer shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994 as amended from time to time through the Selection Committee constituted in accordance with the pravisions of the Uttar Pradesh Constitution of Departmental Promotion Committee for posts outside the purview of the Service Commission, Rules, 1992 as amended from time to time.
