Uttarakhand Anti Littering and Anti Spitting ActState Act of Uttarakhand · Act 23 of 2016

(1) No court other than the Court of a Judicial Magistrate First Class Shall take Cognizance of, and try an offense under this Act.

(2) No court shall take cognizance of any offense except on a complaint in writing of an Authorized Officer.

Offenses under the Act to be non cognizable and bailable

13. Notwithstanding anything contained in the code of Criminal Procedure 1973, offenses under section 3 of this Act shall be non-cognizable and bailable.

Summary trial of offenses

14. All offenses under this act shall be tried summarily in the manner provided for summary trial under the code of criminal Procedure 1973.

Power of State government to make rules & regulations

15. The State Government shall make rules and regulations, for the purposes of carrying out into effect the provisions of this Act.
