PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 2265] ubZ fnYyh] 'kqØokj] flrEcj 16] 2016@Hkkæ 25] 1938 No. 2265] NEW DELHI, FRIDAY, SEPTEMBER 16, 2016/BHADRA 25, 1938 जल ससंाधन, नदी िवकास और गगंा सरंᭃण मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 16 िसतंबर, 2016 का.आ. 2971(अ).—अंतराᭅि᭔यक नदी जल िववाद अिधिनयम, 1956 (1956 का 33) (िजसे इसमᱶ इसके प᳟ात् उᲦ अिधिनयम कहा गया ह)ै कᳱ धारा 4 के अधीन अिधसूचना सं.का.आ. 465 (अ.), तारीख 24 फरवरी, 2010 ᳇ारा वंसधारा जल िववाद अिधकरण (िजसे इसमᱶ इसके प᳟ात् उᲦ अिधकरण कहा गया ह)ै का गठन अंतराᭅि᭔यक वंसधारा नदी और उसकᳱ नदी घाटी से संबंिधत जल िववादᲂ के ᭠यायिनणᭅयन के िलए ᳰकया गया था;
और, उᲦ अिधिनयम कᳱ धारा 5 कᳱ उपधारा (2) के अधीन उᲦ अिधकरण को तीन वषᭅ कᳱ अविध के भीतर, अपनी ᳯरपोटᭅ और यथा अपेिᭃत िनणᭅय को तारीख 23 फरवरी, 2013 को या उससे पूवᭅ दनेा अपेिᭃत था;
और, उᲦ अिधकरण ने के᭠ᮤीय सरकार से ᳯरपोटᭅ और िनणᭅय ᮧ᭭तुत करने कᳱ अविध 23 फरवरी, 2013 स े एक वषᭅ के िलए और बढ़ाने का अनुरोध ᳰकया था;
और, के᭠ᮤीय सरकार ने अिधसूचना सं.का.आ. 436 (अ.) तारीख 22 फरवरी, 2013 ᳇ारा ᳯरपोटᭅ और िनणᭅय कᳱ ᮧ᭭तुित कᳱ अविध को 23 फरवरी, 2014 तक एक वषᭅ कᳱ और अविध के िलए िव᭭ताᳯरत कर ᳰदया था;
और, ओिडशा कᳱ सरकार िसिवल ᳯरट यािचका स. 2006 का 443 मᱶ अ᭠तᭅवतᱮ आवेदन स. 2013 का 8 ᳇ारा माननीय उᲬतम ᭠यायालय मᱶ के᭠ᮤीय सरकार को अिधकरण के गठन कᳱ तारीख 17 िसत᭥बर, 2012 से संगणना का िनदᱷश दनेे के िलए कᳱ गयी थी;
और, माननीय उᲬतम ᭠यायलय ने तारीख 13 ᳰदसंबर, 2013 को मामले को सुनकर यह आदशे पाᳯरत ᳰकया ᳰक उᲦ अिधिनयम कᳱ धारा 5 कᳱ उपधारा (2) के अधीन यथा उपबंिधत तीन वषᭅ कᳱ अविध कᳱ संगणना के ᮧयोजन के िलए वंसधारा जल िववाद अिधकरण के गठन कᳱ ᮧभावी तारीख के ᱨप मᱶ 17 िसतंबर, 2012 कᳱ तारीख स ेअिधकरण को कृ᭜य करन ेके ᱨप मᱶ िवचार ᳰकया जाएगा;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, के᭠ᮤीय सरकार ने अिधसूचना स.ंका.आ. 778 (अ.) तारीख 14 माचᭅ, 2014 ᳇ारा िनणᭅय ᳰकया ᳰक उᲦ अिधकरण के गठन कᳱ ᮧभावी तारीख 17 िसतंबर, 2012 होगी और तदनुसार उᲦ अिधिनयम कᳱ धारा 5 कᳱ उपधारा (2) के उपबंधᲂ के अधीन वंसधारा जल िववाद अिधकरण ᳇ारा ᳯरपोटᭅ और िनणᭅय के ᮧ᭭तुत करने के िलए तीन वषᭅ कᳱ अविध 17 िसतबंर, 2012 से ᮧारंभ होगी;
और, उᲦ अिधकरण ने के᭠ᮤीय सरकार से ᳯरपोटᭅ और िनणᭅय ᮧ᭭तुत करने कᳱ अविध 17 िसतंबर, 2015 स े एक वषᭅ के िलए और बढ़ाने का अनुरोध ᳰकया था;
और, के᭠ᮤीय सरकार ने अिधसूचना स.ंका.आ. 2581 (अ.) तारीख 18 िसतंबर, 2015 ᳇ारा ᳯरपोटᭅ और िनणᭅय कᳱ ᮧ᭭तुित कᳱ अविध को 17 िसतंबर, 2015 स ेएक वषᭅ कᳱ और अविध के िलए िव᭭ताᳯरत कर ᳰदया था;
और, उᲦ अिधकरण ने ᳯरपोटᭅ और िनणᭅय ᮧ᭭तुत करन ेकᳱ अविध 17 िसतंबर, 2016 से एक वषᭅ के िलए और बढ़ाने का अनुरोध ᳰकया था;
अतः अब, के᭠ᮤीय सरकार, अंतराᭅि᭔यक नदी जल िववाद अिधिनयम, 1956 कᳱ धारा 5 कᳱ उपधारा (2) के पर᭠तुक ᳇ारा ᮧद᭜ᱫ शिᲦ᭜यᲂ का ᮧयोग करते ᱟए, वंसधारा जल िववाद अिधकरण ᳇ारा ᳯरपोटᭅ और िनणᭅय कᳱ ᮧ᭭तुत करने कᳱ अविध को तारीख 17 िसतंबर, 2016 से एक वषᭅ कᳱ और अविध के िलए िव᭭ताᳯरत करती ह|ै [ फा. स. 18/3/2013-बी.एम.]
संजय कंुडू, संयुᲦ सिचव (पीपी) MINISTRY OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION NOTIFICATION New Delhi, the 16th September, 2016 S.O. 2971(E).—WHEREAS, the Vansadhara Water Disputes Tribunal (hereinafter called the said Tribunal) was constituted on the 24th February, 2010 vide notification number S.O.465 (E), dated the 24th February, 2010 under section 4 of the Inter-State River Water Disputes, Act, 1956 (33 of 1956) (hereinafter called the said Act) for the adjudication of the water disputes regarding Inter-State river Vansadhara, and river valley thereof;
AND WHEREAS, the said Tribunal was required to submit its report and decision under sub-section (2) of section 5 of the said Act within a period of three years, on or before the 23rd February, 2013 ;
AND WHEREAS, the said Tribunal had requested to extend the period of submission of report and decision for a further period of one year with effect from 23rd February, 2013 ;
AND WHEREAS, the Central Government vide notification number S.O.436 (E), dated the 22nd February, 2013, had extended the period of submission of report and decision for a further period of one year upto 23rd February, 2014 ;
AND WHEREAS, the Government of Odisha approached the Hon’ble Supreme Court vide Interlocutory Application No. 8 of 2013 in Writ Petition (C) No. 443 of 2006 to direct the Central Government to reckon the date of constitution of the Tribunal as 17th September, 2012 ;
AND WHEREAS, the Hon’ble Supreme Court heard the matter and passed the order on 13th December, 2013 that as the Tribunal started functioning with effect from 17th September, 2012, that date be considered as the effective date of the constitution of the Vansadhara Water Disputes Tribunal for the purpose of calculating the period of three years as provided under sub-section (2) of section 5 of the said Act;
AND WHEREAS, the Central Government vide notification number S.O.778 (E), dated the 14th March, 2014, had decided that the effective date of constitution of said Tribunal shall be 17th September, 2012, and accordingly, under the provisions of sub-section (2) of section 5 of the said act, the period of three years for submission of report and decision by the Vansadhara Water Disputes Tribunal shall commence from the 17th September, 2012;
AND WHEREAS, the said Tribunal had requested to extend the period of submission of report and decision for a period of one year with effect from 17th September, 2015;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 AND WHEREAS, the Central Government vide notification number S.O. 2581 (E), dated the 18th September, 2015, had extended the period of submission of report and decision for a further period of one year with effect from the 17th September, 2015 ;
AND WHEREAS, the said Tribunal had requested to extend the period of submission of report and decision for a period of one year with effect from 17th September, 2016;
NOW, THEREFORE, in exercise of the powers conferred by the proviso to sub-section (2) of section 5 of the Inter-State River Water Disputes Act, 1956, the Central Government hereby extends the period of submission of report and decision by the Vansadhara Water Disputes Tribunal for a period of one year with effect from the 17th day of September, 2016.
