GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative NOTIFICATION No. 1434-L.-13th August. 2014.—The following Act of the West Bengal Legislature, having been assented to by the Governor, is hereby published for general information:— West Bengal Act X of 2014 THE WEST BENGAL BOARD OF MADRASAH EDUCATION (AMENDMENT) ACT, 2014.

An Act to amend the West Bengal Board of Madrasah Education Act, 1994.

WHEREAS it is expedient to amend the West Bengal Board of Madrasah Education Act, 1994, for the purposes and in the manner hereinafter appearing;

It is hereby enacted in the Sixty-fifth Year of the Republic of India. by the Legislature of West Bengal. as follows:— Short title and 1. (1) This Act may be called the West Bengal Board of Madrasah Education commencement. (Amendment) Act, 2014.

(2) It shall come into force on such date as the State Government may. by notification in the Official Gazette, appoint.

2. In section 2 of the West Bengal Board of Madrasah Education Act, 1994 (hereinafter referred to as the principal Act),—

(1) clause "(a)" shall be renumbered as clause "(aa)" and before the clause so renumbered, the following clause shall be inserted:

"(a) 'Alirrt Madrasah' means a Madrasah where the Senior Madrasah Education system is followed upto tenth class;";

(2) after clause (aa), the following clauses shall be inserted:— "(aaa) 'elementary education' means the general education or Madrasah education from first class to eighth class;

(aaaa) 'Fazil Madrasah' means a Madrasah where the Senior Madrasah Education system is followed upto twelfth class;";

(3) in para (i) of clause (g), for the words "above primary education stage", the words "including primary education", shall be substituted;

(4) after clause (1), the following clause shall be inserted:— "(I1) 'Primary Madrasah' means an institution where High Madrasah Education System or Senior Madrasah Education system is followed from first class to fourth or fifth class, as the case may be;-;

(5) after clause (o). the following clause shall be inserted:

"(oo) 'secondary education' means the general education or Madrasah education upto tenth class;".

3. In section 4 of the principal Act,—

(1) for clause (e), the following clause shall be substituted:— "(e) the Director of Madrasah Education, West Bengal, ex officio;";

(2) for clause (g), the following clause shall be substituted:— "(g) the representative of Vice-Chancellor, Aliah University, ex officio;";

(3) in clause (k),—

(i) for the word 'ten', the word 'eleven' shall be substituted;

(ii) after the words 'two from Junior High Madrasahs', the words 'and one from Primary Madrasah' shall be inserted.

4. In section 9 of the principal Act,—

(1) to sub-section (2), the following provisos shall be added:— "Provided that no person who has attained the age of sixty-two years shall be eligible to hold office as President:

Provided further that the State Government may, if it considers necessary so to do in the interest of public service and the reasons to be recorded in writing, by order raise the said upper age limit of sixty-two years, in a particular case, by a period not exceeding one year.".

5. In section 20 of the principal Act,—

(1) in sub-section (2),—

(a) in clause (e), after the words 'from time to time', the words "list of holidays for recognised Madrasahs,- shall be inserted;

(b) after clause (e), the following clause shall be inserted:— "(ee) to maintain, print and issue from time to time, the Registration Certificate, Admit Card, Marksheet, Migration Certificate, Certificates and such other papers as it may thinks fit;";

(c) for clause (g), the following clause shall be substituted:— "(g) to set down the conditions to be fulfilled by the candidates presenting themselves for examinations instituted by the Board;";

(2) to sub-section (3), the following proviso shall be added:— "Provided that any decision or action taken or any order made by the Board in the discharge of its functions under this Act shall not be invalid merely on the ground that no regulation has been made under this sub-section.".
