West Ben. Act LIV of 1976. GOVERNMENT OF WEST BENGAL LEGISLATIVE DEPARTMENT West Bengal Act LXXIII of 1978 THE CALCUTTA TRAMWAYS COMPANY (ACQUISITION OF UNDERTAKING) (AMENDMENT) ACT, 1978. [Passed by the West Bengal Legislature.] [Assent of the President was first published in the Calcutta Gazette, Extraordinary , of the 29th March, 1979.] [29th March, 1979.] An Act to amend the Calcutta Tramways Company (Acquisition of Undertaking) Act, 1976. WHEREAS it is expedient to amend the Calcutta Tramways Company (Acquisition of Undertaking) Act, 1976, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Twenty-ninth Year of the Republic of India, by the Legislature of West Bengal, as follows:-

1. This Act may be called the Calcutta Tramways Company (Acquisition of Undertaking) (Amendment) Act, 1978.

2. In section 2 of the Calcutta Tramways Company (Acquisition of Undertaking) Act, 1976 (hereinafter referred to as the said Act), after clause (b), the following clauses shall be inserted:— `(bb) "new company" means the Government company, formed and registered under the Companies Act, 1956, in pursuance of the provisions of section 5A; (bbb) "notification" means a notification published in the Official Gazette;'.

3. Section 3 of the said Act shall be renumbered as sub-section

(1) of that section, and after sub-section (1) as so renumbered, the following sub-section shall be added:— "(2) Upon the vesting of the undertaking of the Company under sub-section (1), the State Government may, for the efficient management and administration of the undertaking of the Company, provide by notification, for the transfer of such 307 Short title. Act Amendment of section 4. Amendment of section 5. Insertion of section 5A. Amendment of section 6. (Sections 4-7.) undertaking to, and vesting thereof in, the new company with effect from such date as may be specified in the notification.".

4. In section 4 of the said Act,—

(a) in sub-section (2), for the words and figure "under section 3", the words, figures and brackets "under subsection (1) of section 3" shall be substituted, and

(b) in sub-section (6), for the words and figure "under section 3.", the words, figures and brackets "under subsection (1) of section 3." shall be substituted.

5. In section 5 of the said Act, for the words and figure "under section 3,", the words, figures and brackets "under sub-section (1) of section 3," shall be substituted.

6. After section 5 of the said Act, the following section shall be inserted:— `Formation and 5A. Before the publication of the registration of a notification under sub-section (2) of section new company. 3, there shall be formed and registered a Government company, with the name "The Calcutta Tramways Company (1978) Limited", in accordance with the provisions of the Comapnies Act, 1956.'.

7. In section 6 of the said Act,—

(a) in sub-section (1), for the words and figure "under section 3", the words, figures and brackets "under subsection (1) of section 3" shall be substituted;

(b) in sub-section (2),—

(i) for the words and figure "under section 3,", the words, figures and brackets "under sub-section (1) of section 3," shall be substituted, and

(ii) for the words, figure and brackets "in sub-section

(1).", the words, figure and brackets "in sub-section

(1) of this section." shall be substituted; and

(c) in sub-section (3),- 1 of 1956. 308 The Calcutta Tramways Company (Acquisition of Undertaking ) (Amendment) Act, 1978. LXXII of 1978.] (Sections 8-11.)

(i) for the words and figure "under section 3,", the words, figures and brackets "under sub-section (1) of section 3," shall be substituted, and

(ii) for the words, figure, and brackets "in sub-section

(1)", the words, figure and brackets "in sub-section

(1) of this section" shall be substituted.

8. In sub-section (1) of section 7 of the said Act,— Amendment of section 7.

(a) in clause (a), after the words "the State Government", the words "or the new company" shall be inserted,

(b) in clause (b), for the words and figure "under section 3,", the words, figures and brackets "under sub-section (1) of section 3," shall be substituted, and

(c) in clause (c), after the words "the State Government", the words "or the new company" shall be inserted.

9. In section 9 of the said Act, after the words "the State Amendment of Government", the words "or the new company" shall be inserted. section 9.

10. In sub-section (1) of section 10 of the said Act, after the Amendment of words "the State Government", the words "or the new company" section 10. shall be inserted.

11. In section 13 of the said Act, the words "published in the Amendment of Official Gazette" shall be omitted. section 13. 309 Page 1 Page 2 Page 3
