1956. Legislative Department West Bengal Act XXIII of 1956 THE CALCUTTA UNIVERSITY (AMENDMENT) ACT, 1956 [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 6th August, 1956.] [6th August, 1956.] An Act to'antend the Calcutta University Act, 19.51. WHEREAS it is expedient to amend the Calcutta University Act, 1951, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Seventh Year of the Republic of India, by the Legislature of West Bengal, as follows :-

1. (1) This Act may be called the Calcutta University Short title (Amendment) Act, 1956. and commence. (2) It shall come into force immediately on the Calcutta ment. University (Amendment) Ordinance, 1956, ceasing to operate.

2. (1), the term of office of the members other than e,p,onicio• memters of the Senate, the Syndicate or the Academic Council as provided in this Act shall be held to include any period which may elapse between'the expiry of the said term and the adte of elections to the Senate, the Syndicate or the Academic Council, as the case may be, to fill vacancies arising by efflux of time. Ea planation.—When elections to .the Senate, the Syndicate or the Academic Council are held on more than one date, then the last of such dates shall be taken to be the date of elections for purposes of, this sub-section. (3) Any member of the Senate, the Syndicate or the Academic Council elected or nominated to fill a vacancy other than a vacancy arising by efflux of time shall hold office for the unexpired portion of the term of office of the member whose seat became vacant.". Amend- 3. After sub-section (4) of section 52 of the said Act, the merit of following sub-section shall be inserted and shall be deemed section 52. always to have been inserted, namely :— "(4a) Notwithstanding anything elsewhere contained in this Act, but subject to the provisions of subsection (2) of section 41, the elected members and the nominated members, other than life members, of the Senate, the Syndicate and the Academic Council constituted under sub-section (3) of this section shall hold office for a period of three years from the appointed date.". Continuance.

4. Any action taken or anything whatsoever done under the said Act as amended by the Calcutta University (Amendment) Ordinance, 1956, shall, upon the said Ordinance ceasing to operate, be deemed to have been taken or done under the said Act as amended by this Act as if this Act had commenced on the 29th day of June, 1956.
