An Act to amend the West Bengal Co-operative Societies Act, 1983.
WHEREAS it is expedient to amend the West Bengal Co-operative Societies Act, 1983, for the purposes and in the manner hereinafter appearing:
It is hereby enacted in the Forty-eighth Year of the Republic of India, by the Legislature of West Bengal, as follows:-
1. (1) This Act may be called the West Bengal Co-operative Societies (Amendment) Act, 1997.
(2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. In section 38 of the West Bengal Co-operative Societies Act, 1983 (hereinafter referred to as the principal Act),—
(1) for sub-section (1), the following sub-section shall be substituted:— "(1) The State Government shall constitute a Co-operative Service Commission (hereinafter referred to in this section as the Commission) and shall appoint the following three persons as the members of the Commission:—
(a) one person who is or was a Judge of the High Court at Calcutta or who holds or held a post not below the rank of Secretary to the Government of West Bengal, to be the Chairman of the Commission;
(b) two persons from the apex societies, to be nominated by the State Government.";

(2) for sub-section (1A), the following sub-section shall be substituted:— "(1A) The State Government shall appoint the Additional Registrar of Co-operative Societies to be the Secretary of the Commission.";
(3) for sub-section (2), the following sub-section shall be substituted:— "(2) The Chairman and the other members of the Commission shall hold office for a term of three years:
Provided that no member of the Commission shall be reappointed or renominated as a member of the Commission after the expiry of the term of three years as aforesaid.";
(4) in sub-section (3), for the words "of the Chairman", the words "of the members including the Chairman of the Commission" shall be substituted;
(5) in sub-section (4), for the words "Co-operative Service Commission", the word "Commission" shall be substituted;
(6) in sub-section (5),—
(a) for the words "Co-operative Service Commission", the word "Commission" shall be substituted, and
(b) after the words "such posts", the words ", other than the posts to be filled up by promotion," shall be inserted;
(7) sub-section (6) shall be omitted;
(8) in sub-section (7),—
(a) for the words "The Selection Committee of the Co-opeative Service Commission", the words "There shall be a Selection Committee of the Commission and such Selection Committee" shall be substituted,
(b) for clause (a), the following clause shall be substituted:— "(a) the Chairman and two other members of the Commission,",
(c) in the proviso, for clause (a), the following clause shall be substituted:— "(a) the Chairman and two other members of the Commission,",
(d) after the proviso, the following proviso shall be inserted:— "Provided further that the Chairman and the Secretary of the Commission shall respectively be the Chairman and the Convener of the Selection Committee.".

3. In the Fifth Schedule to the principal Act,—
(1) for serial No. 3 in column 1 and the entry relating thereto in column 2, the following serial No. and entry in column 1 and column 2 respectively shall be substituted:— "3. West Bengal State Co-operative Agriculture and Rural Development Bank Limited.";
(2) for serial No. 5 in column 1 and the entry relating thereto in column 2, the following serial No. and entry in column 1 and column 2 respectively shall be substituted:— "5. Co-operative Agriculture and Rural Development Bank Limited.".
