GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative West Bengal Act XIII of 2001' THE WEST BENGAL CO-OPERATIVE SOCIETIES (VALIDATION OF THINGS DONE AND ACTIONS TAKEN) ACT, 2001. 1995. West Ben. Act XXVII of 1997. An Act to validate things done, and action taken, under the West Bengal Co-operative Societies Act, 1983. WHEREAS it is expedient to validate things done, and action taken, under the West Bengal Co-operative Societies Act, 1983; It is hereby enacted in the Fifty-second Year of the Republic of India, by the Legislature of West Bengal, as follows:-

1. (1) This Act may be called the West Bengal Co-operative Societies Short title (Validation of Things Done and Actions Taken) Act, 2001. and commence-

(2) It shall come into force at once. ment.

2. Notwithstanding anything to the contrary contained in the West Validation Bengal Co-operative Societies Act, 1983, as amended by— doe nor things tions (a) the West Bengal Co-operative Societies (Amendment) Act, taken, under 1989, West Ben. Act XLV of

(b) the West Bengal Co-operative Societies (Amendment) Act, 1983. 1990,

(c) the West Bengal Co-operative Societies (Amendment) Act, 1992,

(d) the West Bengal Co-operative Societies (Amendment) Act, 1995, and

(e) the West Bengal Co-operative Societies (Amendment) Act, 1997 (hereinafter referred to as the principal Act), or the rules made thereunder, as subsequently amended (hereinafter referred to as the said rules), anything done, or any action taken, under any provision of the principal Act or the said rules before the coming into force of the said provision shall 'For proceedings of the West Bengal Legislative Assembly, see the proceedings of the meeting of that Assembly held on the 14th February, 2001. 117 The West Bengal Co-operative Societies (Validation of Things Done and Actions Taken) Act, 2001. Act to have overriding effect. be valid and shall be deemed always to be valid as if the said provision were in force when such thing was done or such action was taken, and the said provision shall be deemed always to be in force for the purposes of anything to be done, or any action to be taken, thereunder.

3. The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or in any judgement, decree or order of any court, tribunal or other authority or in any instrument having effect by virtue of any law other than this Act. Some actions have been taken in accordance with some of the provisions of the West Bengal Co-operative Societies Act, 1983 as amended from time to time, and the West Bengal Co-operative Societies Rules, 1987. These provisions were not, however, brought into force by any formal Notification as required under the law. Hence such actions were not valid in the eye of law.

2. In order to validate such actions, it is necessary to enact a law with the approval of the Legislature.

3. The Bill has been framed with the above object in view.
