WHEREAS the draft of amendments of the West BengalGround Water Resources (Management, Control and Regulation) Rules, 2006 (hereinafter referred to as the said rules) control and Regulation) Act, 2005 (West Ben. Act XVIII of 2005) vide this Department Notification No. 1749/WI/O/Law-20/2014, dated the 8% December, 2021 in the Kolkata Gazette, Extraordinary, Part I, dated 15% December, 2021,for inviting objection or suggestion in writing from all the persons likely to be affected thereby, withion a period offifteen days from the date of its publication; AND WHEREAS no objection or suggestion has been received by the State Government within the said period:NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), and sub-section (2), of Section 20of the West Bengal Ground Water Resources (Management, Control and Regulation) Act, 2005 (West Ben. Act XVIII of2005), the Governor is pleased hereby to make, with immediate effect, the following amendments in the said rules-— Amendments In the said rules, —

(1) For rule 8, substitute the following rulé:— “8. Procedure for filing application for obtaining permit for sinking of well. — (1) Any user desiring tosink a well for domestic, agriculture or industrial purpose or for any other purpose, excepting tube well fittedwith hand-pump or a well fror. which extraction or use made without the help of any mechanical-or electricaldevice, shall make an application referred to in sub-section (2) of Section 7, to the Niember-Secretary of theconcerned District Level Authority, or as the case may be, the Corporation Level Authority in Form 1 forirrigation, domestic and ¢:s-stic water supply purpose, in Form 1A for industrial -~ structural and commercialpurpose and in Form 1E *r: ay other,purpose, in such manner as determined | 4: 2 State Government, forobtaining a permit as iio os och section (i) of Section 7 : , a sel Ein See een si BP ras THE KOLKATA GAZETTE, EXTRAORDINARY, OCTOBER 14, 2022Se “i eames ee

Provided further that a user desiring: to sink more than one well, shall be required to submit Separate application form for each well. :

(3) Improper filling up of, and failure to annex all necessary documents specified in, Form lor Form 1A or Form

(2) Inrule 9,

(a) for clause (b) of sub-rule (1), substitute the following clause:— “(b) The Corporation Level Authority considers that the application is issuance of a permit under clause

(b) of sub-section (4) of Section 7, it shall, after being satisfied in its Meeting, approve the case and give intimation in Form 2 to the user to deposit such non-refundable fee payable after acceptance of the application as decided by the State Government.”: . (b) for sub-rule (2), substitute the following sub-rule:— ce as the case may be, the Corporation Level Authority.”:

Provided further that the user may receive the copy of the intimation by hand from the Office of theMember Secretary of the concerned District Level Authority or as the case may be from the CorporationLevel Authotity.” af ‘In rule 10, —

(a) for sub-rule (3), substitute the following sub-rule:— “3) On receipt of the approval of the case, the District Level Authority or the Corporation Level Authority,as the case may be, shall give intimation in Form 2 to the user to deposit such non-refundable feepayable after acceptance of the application, as decided by the State Government.”;

(b) ‘for sub-rule (4), substitute the following sub-rule:— “(4) The user shall, on receipt of the intimation in Form 2, deposit the non-refundable fee payable after acceptance of the application, in such manner and under such head of account as decided by the State Government from time to time and after such deposit, the user shall give an intimation in Form 3 alongwith the original receipt, showing such payment to the concerned District Level Authority or as the case may be, Corporation Level Authority.”

(c) for sub-rule (5), substitute the following sub-rule:— “(5) The concerned District Level Authority, or the Corporation Level Authority shall, on receipt of intimation in Form 3, issue permit in Form 4 for irrigation, domestic and domestic water supply purpose,"in Form 4A for industrial, infrastructural and commercial purpose and in Form 4B for any other purpose.

Provided that in case of application submitted in Form IC, the Corporation Level Authority shall, onreceipt of intimation in Form 3, issue permit in Form 4C to the uscr.”

(d) for sub-rule (7), substitute the following sub-rule:— ses Any decision taken by the State Level Authority regarding grant or refusal of permit shall be intimated to the user by the concerned District Level Authority or the Corporation Level Authority, as the case may be, by speed post/registered post with acknowledgement due or by uploading the decision on its official website, from where the user shall be able to download it, within a period of four months fromthe date of receipt of such application by such District Level Authority or Corporation Level Authority, "as the case may be, anda copy of the intimation shall also be affixed to the Notice Board of the Office of the Member Secretary of the concerned District Level Authority or the Corporation Level Authority :

Provided that any decision taken by the State Level Authority regarding grant er refusal of permit in caseof an application relating to extraction or use of ground water for industrial purpose shall be intimated to the user by the concerned District Level Authority or the Corporation Level Authority, as the case may be, byspeed post/ registered post with acknowledgement due or by uploading the decision on its official website,from where the user shall be able to download it, within-a period of fifty one days from the date of receipt ofsuch application by such District Level Authority or the Corporation Level Author'ty, as the case may be, anda copy of the intimation shai] also be affixed to the Notice Board of the office of the Member Secretary of the concerned District Level Authority or the Corporation Level Authority :

(4) after the rule 10, insert the following rule :— “10A. Disposal of application of permit by High Level Authority. — Any decision taken by the High Level 4 Authority regarding grant or refusal of permit in case of an application relating to extraction or use of ground water for industrial purpose shall be intimated to the user by the conceited District Level Authority or the “ Corporation Level Authority, as the case may be, by speed post/registered post with acknowledgement due or by uploading the decision on its official website/web portal, from where the user shall be able to download it, within a period of sixty six days, from the date of receipt of such application by such District Level Authority or Corporation Leve! Authority, as the case may be, and a copy of the intimation ‘Shall also be affixed to the Notice Board of the office of the Member Secretary of the concerned District Level Authority or the Corporation Level Authority :

Provided that the user may receive the copy of the intimation by hand from the office of the Member Secretary of tne concerned District Level Authority, as the case may be, the Corporation Level Authority.”;

(5) for rule 15, substitute the following tule :— “15. Application Fee. « (1) A user shall deposit such amount of non-refundable fee fixed by the State Government under sub-rule (2) —

(a) for filing application for obtaining permit for sinking a new well as stated in sub-rule (1) of rule 8 ; and

(b) after acceptance of application as stated in sub-rule (1) of rule 9.

(2) The State Government shall fix the amount of fee referred to in sub-rule (1), for extraction of ground water taking into consideration the purpose and discharge of the well.

(3) The fee referred to in sub-rule (1) shall be paid in such manner and under such Head of Account as specified by the State Government.”

(6) for sub-rule (2) of rule 18, substitute the following sub-rule:— “(2) The fee referred to in sub-rule (1) shall be paid in the same manner and in the same Head of Account, as specified by the State Government under sub-rule (4) of rule 15.”

(viii) Provisional Registration Certificate from DIC (District Industry Centre) / MSME Udyog Aaadhar / UdyamRegistration if already exist. ,

(ix) Mutation of land (Porcha) and or Certificate of Conversion of Classification of Land in Land records as peruses of Land and or Lease Deed. , :

(x) Proposal of Rain Water Harvesting (RWH) plan/ reuses plan within the premises as per prevailing ModelBuilding By Laws of Central or State in practice.

(xi) Report of the Ground Water Quality of that location from SWID/ any Govt. Laboratory /NABL accreditedlaboratories for basic parameters (cations and anions), heavy metals, pesticides/ organic compounds for allprojects.

The water from STP shall be utilized for toilet flushing, carwashing, gardening etc. Industries which are likely to cause ground water pollution e.g., Tannery, Slaughter Houses, Dye, Chemical, Coalwashery, other hazardous units, etc (as per CPCB list) need to take necessary well head protection measures toensure prevention of any kind of contamination of ground water. The issue of this permit does not imply that other statutory/ administrative clearances shall be granted to the projectby the concerned authority. Such authorities would consider the project on merits and take decisions independentlyof the permit. In case of permission within KMC area boring permit will only be valid after generating KMC Licence Fee demandu/s 248 of KMC Acct. 11. 12, 13, [A.] General Conditions : In case of any change of ownership of the proposed well, fresh permit has to be obtained. No change of location, design, rate of withdrawal and pumping device in respect of the proposed well as indicatedat SI (1) and (2) of this certificate shall be made without prior permission of the Competent Authority. Anydeviation in this regard shall lead to cancellation of this permit. In case, any of the particulars / information furnished by the applicant in his/her application for issuance of thispermit is found to ‘be-incorrect during verification at any subsequent stage, this permit is liable for cancellation. Any other condition imposed by the concerned Authority. Mandatory Conditions: The sinking of Tube-Well should be done within one year from the date of issuance of the permit. If not, then the _ user must be informed to the permit issuing authority with a satisfactorily explanation. Installation of Separate Energy/ Electric Meter is mandatory for each tube well.& confirmation of the same shall beintimated to the permit issuing authority within 45 days from the date of installation of the tube well. It shall be mandatory for all the mining industries to ensure that water available from de-watering operations isproperly treated and should be gainfully utilized for supply for irrigation, dust suppression, mining process, rechargein downstream. Provision/ Arrangement of "Rooftop Rainwater Harvesting" is mandatory in the premises‘ as per the prevailingModel Building By Laws, for all applicant. The stored water shall be utilised for beneficial uses (other than drinking purpose) by the applicant. In case of mining project the applicant shall submit groundwater quality report of mine discharge/seepage from Govt. approved/ NABL accredited lab to permit issuing authority, in yearly basis. In case of coal and other base metal mining projects, the project proponent shall use the advance dewateringtechnology to avoid contamination of surface water. The “Safe Distance Criteria” (as per the instruction of DLA/SLA/HLA) for more than one tube wells should be adopted. Installation of tamper proof digital Flow Meter with Telemetry Sensor System is mandatory for Medium to Large scale units immediately after installation of the tube well and intimation regarding the installation shall be communicated to the concerned DLA within 30 days from the date of installation of the Flow Meter. The monthly water meterreading should be recorded and submitted to the concerned authority on annual basis. The server will be maintainedby the supplier of the instrument and access will be provided to SWID. For small scale units an ISI marked tamper proof Digital Flow Meter is mandatory. The daily water meter reading with time (starting & ending time of pump)should be recorded and submitted to the permit issuing authority on annual basis. Construction of purpose-build Observation Well/Piezometers for groundwater monitoring shall be mandatory for mining, in the core and buffer zones, as suggested by the authority. Environmental Clearance Consent to Establish (CTE)/Consent to Operate (CTO) for Medium to Large Scale Unitfrom SPCB/ SEAC/SEIAA, whichever is a applicable. Unexpected variation in inflow of groundwater into mine pit, if any shall be reported to the concerned DistrictGeologist of SWID. Treated water/ wastewater shall not be used for recharge to groundwater, since it may contain heavy metals &other toxic elements. The treated water shall be fully used by the proponent or any other agency, who can utilizeit without contaminating the underlying aquifer or water bodies. The issue of this permit “ee not imply that other statutory/ administrative clearisic=s shall be granted to the projectos by the concerned authority.
