(1) Whoever intentionally insults or causes any interruption to the Lokayukta or Upa-Lokayukta while the Lokayukta or Upa-Lokayukta is making any investigation under• this Act, shall, on conviction, be punished with simple imprisonment for a term which may extend to six months, or with fine, or with both.
(2) Whoever, by words spoken or intended to be read, makes or publishes any statement, or does any other act, which is calculated to bring the Lokayukta or Upa- Lokayukta into disrepute, shall, on conviction, be punished with simple imprisonment for a term which may extend to six months, or with fine, or with both.
(3) The provisions of section 199 of, t4e Code of Criminal Procedure, 1973 2 of 1974.
(hereinafter referred to in this sub-section as the said Code), shall apply in relation to an offence under sub-section (1) or• sub-section (2) of this section as they apply in relation to an office referred to in sub-seetikrii(4) of section 199 of the said Code, subject to the modification that no complirnt in respect of such offence shall be made by the Public Prosecutor except with, the previous sanction,—
(a) in the case of an offence against Upa-Lokayukta,. of the Lokayukta;
(b) in the case of an offence against Lokayukta, of the Upa-Lokaynkta concerned.
(4) The Lokayukta and Upa-Lokayukta shall have and may exercise the same jurisdiction, powers and authority, in accordance with the same procedure and practice, in respect of contempt of any of them as a High Court has and may exercise, and, for this purpose, the provisions of the Contempt of Courts Act, 1971, shall have effect, 70 of 1971.
subject to the modification that any reference therein to the High Court shall be construed to be a reference to the Lokayukta or Upa-Lokayukta, as the case may be.
