THE WEST BENGAL MOLASSES CONTROL (RE-ENACTING) ACT, 1971 No. 25 OF 1971 Enacted by the President in the Twenty-second Year of the Republic of India.

An Act to re-enact the West Bengal Molasses Control Act, /949.

in exercise of the powers conferred by section 3 of the of 1'971. West Bengal State Legislature (Delegation of Powers) Act, 31 1971, the President is pleased to enact as follows:-

1. (1) This Act may be ealied the West Bengal Molasses Control (Re-enacting) Act, 1971.

(2) It shall be deemed to have come into force on the 1st day of April, 1971.

2. The West Bengal Molasses Control Act, 1949, as in force on the 31st day of March, 1971, is hereby re-enacted subject to the modification that for sub-section (4) of section I. the following sub-section shall be, and shall be deemed.

3. Notwithstanding anything contained in the West Bengal Molasses Control Act, 1949, or in any other law for the time being in force, no licence, permit, order, direction,, notification, price, proceeding, liability or penalty, punishment, thing or action which is purported to have been granted, made, issued, fixed, commenced, incurred, awarded, done or taken, as the case may be, on or after the 1st day of April, 1971,, and before the date of publication of this Act in the Official Gazette, shall be deemed to be invalid or ever to have become invalid merely on the ground that the said Act had expired, and every such licence, permit, order, direction, notification, price, proceeding, liability or penalty, punishment, thing or action shall be deemed to have been granted, made.

PART V] THE CALCUTTA GAZETTE, EXTRAORDINARY, DECEMBER 30, 1971. 2590 Sp Reasons for the enactment The West Bengal Molasses Control Act, 1949, which was passed by the State Legislature in 1949, and had received the assent of the President, enabled the State Government to.

control production, supply, distribution and trade in molasses in the State of West Bengal. The Act, as initially enacted, was to remain in force for a period of three years. The period of operation of the Act was, however, extended from time to time by legislation and the period of operation of the Act was last extended up to the 31st March, 1971. Due to elections and other pre-occupations, further extension of the period of operation of the Act after the 31st March, 1971, could not be made by the Government of West Bengal. That. Government has represented to the Central Government that the situation created by the expiry of the period of operation of the said Act is required to be urgently remedied by the re-enactment of that Act.

2. While a proposal to promulgate an Ordinance further to extend the period of operation of the Act was being processed, President's rule was imposed in the State of. West Bengal and the proposed Ordinance could not be promulgated. Since a very short time was left between this develop-, ment and the end of the last session of the Lok Sabha, it was thought best to re-enact the West Bengal Molasses Control Act through a President's Act under the powers delegated to him by the West Bengal State Legislature (Delegation of Powers) Act, 1971 (31 of 1971).

3. The Committee constituted under the proviso to subsection (2) of section 3 of the West Bengal State Legislature.

(Delegation of Powers) Act, 1971 (31 of 1971), has been consulted before the enactment of this measure as a President's Act.
