Short title and commencement.
Amendment of section 3 of West Ben. Act IV of
1997.
Validation.
An Act to amend the West Bengal School Service Commission Act, 1997.
WHEREAS it is expedient to amend the West Bengal School Service Commission Act, 1997, for the purpose and in the manner hereinafter appearing;
It is hereby enacted in the Fifty-sixth Year of the Republic of India, by the Legislature of West Bengal, as follows:-
1. (1) This Act may be called the West Bengal School Service Commission (Amendment) Act, 2005.
(2) It shall come into force at once.
2. In sub-section (1) of section 3 of the West Bengal School Service Commission Act, 1997 (hereinafter referred to as the principal Act), for the words "The State Government shall, with effect from such date as it may, by notification, appoint, constitute—", the words " There shall be —" shall be substituted.
3. The amendment made in the principal Act by section 2 shall be deemed to have been made with effect from the 1st day of November, 1997 and accordingly anything done or any action taken by the West Bengal Central School Service Commission or the West Bengal Regional School Service Commission, referred to in clause (a) and clause (b), respectively, of sub-section (1) of section 3 of the principal Act, on and 27 West Ben. Act IV of 1997.

after the said date and before the commencement of this Act in exercise or purported exercise of its jurisdiction, powers and authority conferred by or under the principal Act shall be deemed to have been validly done or taken as if the provision of the principal Act, as amended by this Act, had been in force at all material times and, accordingly, anything done or any action taken by the said Commissions shall not be called in question merely on the ground that —
(a) the said Commissions had not been properly constituted, or
(b) the said Commissions had no jurisdiction, powers and authority conferred by or under the provisions of the principal Act.
Repeal and 4. (1) The West Bengal School Service Commission (Amendment) Ordinance, West Ben. Ord. V saving. 2005, is hereby repealed. of 2005.
(2) Notwithstanding such repeal, anything done or any action taken under the principal Act as amended by the said Ordinance shall be deemed to have been validly done or taken under the principal Act as amended by this Act.
