Section 112: In section 505, after sub-section (2). the iollowing sub-seclion shall be added, namely

117. In section 518,-

(1) in sub-section ( I ) , for the words "Sub-divisjonnl Magismate 01' of a Magismre of -the first class", the words "Sub-divisional Judicial or Executive Magisirale or of a Judicial or Executive Magistale of h e first class" shall be substituted;

(2) for sub-seclion (2), the following sub-section shall be substituled, namely:- "(2) In the case of an order passed undcr this section by a Magistrate other than a Presidency Magistrate, an appeal shall lie to the Sessions Judge, and in Ihe case of an order passed under this section by a Presidency Magistrate, UI appeal shall lie ro the High Court.".

1 19. In section 528,- ( I ) in sub-section (2), for the words "or Sub-divisional Magisrratk'?; the words"Sub-divisional Execu tiveMagistrate or Sub-divisional Judicial Magisrate" shall be substituted;

(2) in sub-seclion (4), after Ihe word, figure and brackets "subsection (2)", the words, figure and brackers "or subsection (3)" shall be inserted.

120. In swtion 552, for the words "or Disuict Magiskale", the words ", Disu-ict Magistrate or Sub-divisional Judicial Magistrate" shalt be subs~rured.

121. In sub-section (2) of section 554,-

(1) the words, brackets and Ligure "not being a High Courl to which sub-section (1) applies" shall be ornilred;

(2) after clause (d), the following clause shall be insened, namely:- "(e) make rules regulating the conuol and supervision of different classes of Magistrales and the control, supervision and inspection of different classes of Courls:".

122. In sub-section (2) of section 559, for the words "the District Magistrate outside such lowns", the words "elsewhere, [he District Magistrate in the case of Executive Magistmtes and [he Sessions Judge in the case of Judicial Magistrates" shall be substi~uted.

123. In section 561, for [he words "Dislricr Magistrate", in h e two places where they occur, the words "Sub-divisional Judicial Magistrale" shall be subsliluted.

124. In the proviso to sub-section (1) of section 562,-

(1) for the words "aMagislraten, whereverthey occur, the words "a JudiciaI Magismre" shall be subslitured;

(2) after Ihe words "by rhe Statc Govemmenl", the words ", in consullalion with the High Coun," shall be insened; and

(3) for the words "Sub-divisional Magislrale", [he words "Subdivisional Judicial Magistnte" shall be substituled.

125. In seclion 565,-

(1) in sub-section (I), for the words "District Magistrate, Subdivisional Magistrale or Magisrnte of the first class", h e words "Sub-divisional Judicial Magisrrale or Judicial Magistrate of the firs1 class" shall be substitured; and

(2) in sub-section (3), after the words "he State Government may". the words ", in consulm~ion with the High Court," shall be jnseficd.

126. In Schedule 11, in column 8,-

(1) for the word "Magisrate", wherever it occurs except in the expression "Presidency Magistrate", the words "Judicial Magistr~te", and for the words "Any Magistrate", wherever they occur, the words "Any Judicial Magistra~e" shall be substimled: - rile Wesr Betigal Sepamtiotr of Jrrdicial and ELrecutive F~ulcrions Act. 1970.
