"(3) Where hec commission is received by the Sub-divisional Judicial Magistrate, Lhe Sub-divisional Judicial Magismre or such other Judicial Magistnte subordinate to him as he may appoinl in !his behalf, may compel he attendance of, andexamine, Ihe witness as if he were a wilness in a case pending before himself.".
