GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative NOTIFICATION No. 1462-L.-19th August 2014.—The following Act of the West Bengal Legislature, having been assented to by the Governor, is hereby published for general information:— West Bengal Act XI of 2014 THE WEST BENGAL STATE HOMOEOPATHIC HEALTH SERVICE (AMENDMENT) ACT, 2014.

An Act to amend the West Bengal State Homoeopathic Health Service Act, 2002.
WHEREAS it is expedient to amend the West Bengal State Homoeopathic Health west Ben. Act X Service Act, 2002, for the purposes and in the manner hereinafter appearing; of 2002.
It is hereby enacted in the Sixty-fifth Year of the Republic of India, by the Legislature of West Bengal, as follows:- Short title and commencement.
1. (1) This Act may be called the West Bengal State Homoeopathic Health Service (Amendment) Act, 2014.
(2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

Amendment of Section 7 of West Ben. Act X of 2002.
Substitution of new section for section 14.
Amendment of section 21.
2. In section 7 of the West Bengal State Homoeopathic Health Service Act, 2002 (hereinafter referred to as the principal Act), for the words 'the Homoeopathy (Minimum Standards of Education) Regulations, 1983,', the words 'the Homoeopathy Central Council (Minimum Standards Requirement of Homoeopathic Colleges and Attached Hospitals) Regulations, 2013,' shall be substituted.
3. For section 14 of the principal Act, the following section shall be substituted:— "Recruitment to 14. (1) Recruitment to the post of Lecturer in the West State Homoeopathic Health Service. Bengal Homoeopathic Education Service shall be made through the West Bengal Health Recruitment Board, in such manner as may be prescribed by the Homoeopathy Central Council (Minimum Standards Requirement of Homoeopathic Colleges and Attached Hospitals) Regulations, 2013:
Provided that the recruitment to the post of Lecturer in the West Bengal Homoeopathic Education Service shall be made giving preference to the persons who have rendered at least two years service in the rural areas:
Provided further that the recruitment to the post of Principal in the West Bengal Homoeopathic Education Service shall be made on promotion from the members of the West Bengal Homoeopathic Education Service in such manner as may be prescribed:
Provided also that any person appointed to the West Bengal Homoeopathic Health Service shall, subject to such terms and conditions as may be prescribed, be eligible to apply for the post of Lecturer:
Provided also that the recruitment to the posts of Reader and Professor shall be filled up by promotion only from the members of the West Bengal Homoeopathic Education Service in such manner as may be prescribed.
(2) Recruitment to all Basic Grade Posts in the West Bengal Homoeopathic Health Service shall be made through the West Bengal Health Recruitment Board in such manner as may be prescribed.
(3) Recruitment to all administrative posts in the West Bengal Homoeopathic Health Service shall be made through the West Bengal Health Recruitment Board in such manner as may be prescribed."
4. (1) In Section 21 of the principal Act,—
(a) for the words "or may make recruitment to any teaching post in the West Bengal Homoeopathic Education Service in such manner and subject to such terms and conditions as contained in the Homoeopathy (Minimum Standards of Education) Regulations, 1983 of the Central Council of Homoeopathy", the words "or may make recruitment to the post of Lecturer in the West Bengal Homoeopathic Education Service by inviting option by the Department of Health & Family Welfare, Government of West Bengal from the members of West Bengal Homoeopathic Health Service having only medical qualifications as per Homoeopathy Central Council (Minimum

5. Anything done or any action taken under the principal Act as amended by this Act before the publication of this Act in the Official Gazette shall be deemed to have been validly done or taken under the principal Act as amended by this Act.
