GOVERNMENT OF WEST BENGAL LEGISLATIVE DEPARTMENT West Bengal Act XLVIII of 1975 THE WEST BENGAL UNIVERSITIES (AMENDMENT) ACT, 1975. [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 1st April, 1977.] [1st April, 1977.] An Act to amend the Jadavpur University Act, 1955, the Burdwan University Act, 1959, the Kalyani University Act, 1960, the North Bengal University Act, 1961, the Rabindra Bharati Act, 1961 and the Calcutta University Act, 1966. West Ben. Act XXXIII of 1955. West Ben. Act XXIX of 1959. West Ben. Act XIII of 1960. West Ben. Act XXVII of 1961. West Ben. Act XXIX of 1961. West Ben. Act II of 1966. WHEREAS it is expedient to amend the Jadavpur University Act, 1955, the Burdwan University Act, 1959, the Kalyani University Act, 1960, the North Bengal University Act, 1961, the Rabindra Bharati Act, 1961 and the Calcutta University Act, 1966, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Twenty-sixth Year of the Republic of India, by the Legislature of West Bengal, as follows:-

1. (1) This Act may be called the West Bengal Universities Short title (Amendment) Act, 1975. and commence-

(2) The provisions of this Act shall come into force on such date as ment. the State Government may, by notification in the Official Gazette, appoint and different dates may be appointed for different provisions of this Act.

2. In the Jadavpur University Act, 1955,—

(a) in section 4,—

(i) in sub-section (4),—

(1) for clauses (d) and (e), the following clauses shall be substituted, namely:— "(d) three Deans of the Faculties, one from each of the Faculties of Arts, Science, and Engineering and Technoligy, ex-officio; Amendment of West Ben. Act XXXIII of 1955. 227 The West Bengal Universities (Amendment) Act, 1975. [West Ben. Act (Section 2.)

(e) two Principals of Institutions established by the University, ex-officio;",

(2) for clause (h), the following clauses shall be substituted, namely:— "(h) the President, West Bengal Council of Higher Secondary Education, ex-officio;

(hh) the Director of Public Instruction, Government of West Bengal, ex-officio; (hhh) the Director of Technical Education, Government of West Bengal, ex-officio;",

(3) for clauses (i) and (j), the following clauses shall be substituted, namely:— "(i) three Professors, one from each of the Faculties of Arts, Science, and Engineering and Technology, elected by the Professors of the respective Faculty in accordance with rules;

(j) nine teachers, not being Professors, three from each of the Faculties of Arts, Science, and Engineering and Technology, elected by the teachers of the respective Faculty in accordance with rules;",

(4) in clause (1), for the word "eight", the word "two" shall be substituted;

(5) after clause (m), the following clauses shall be inserted, namely:— "(ml) three persons of whom—

(i) one shall be elected by the students of the Faculty of Engineering and Technology from amongst themselves,

(ii) one shall be elected by the students of the Faculty of Arts from amongst themselves, and

(iii) one shall be elected by the students of the Faculty of Science from amongst themselves, in accordance with rules; (m2) one post-graduate student nominated by the Vice-Chancellor, on the basis of the results in the preceding degree examinations of the University, from amongst the students of the Faculties of Engineering and Technology, Arts and Science by rotation in the manner provided by rules; 228 The West Bengal Universities (Amendment) Act, 1975. XLVIII of 1975.] (Section 3.) (m3) not more than three persons having special interest in Technologcal education to be nominated by the Chancellor;";

(ii) in sub-section (5),—

(a) 'ter the words, brackets and letters "clauses (i) to (m) . (both inclusive)", the words, brackets and letter "and clause (m3)" shall be inserted,

(b) after the words "a period of four years", the words "and the members referred to in clauses (ml) and (m2) of sub-section (4) shall hold office for a period of one year" shall be inserted; '

(b) in the Schedule,—

(i) in item (iii), after the words "Government of West Bengal", the words ", ex-officio, or his nominee" shall be added;

(ii) in item (iv), after the words "Government of West Bengal", the words ", ex-officio, or his nominee" shall be added.

3. In the Burdwan University Act, 1959,—

(a) in section 8,—

(1) in sub-section 1,—

(i) in clause (iii), after the word "ex-officio", the words ", or his nominee" shall be added,

(ii) in clause (iv), after the word "ex-officio", the words ", or his nominee" shall be added,

(iii) for clauses (v) and (vi), the following clauses shall be substituted, namely:— "(v) the director of Public Instruction, Government of West Bengal, "ex-officio;

(vi) the President, West Bengal Council of Higher Secondary Education, "ex-officio;",

(iv) clauses (vii), (viii), (ix) and (x) shall be omitted,

(v)" for clauses (xi) to (xv), the following clauses shall be substituted, namely:— "(xi) the deans of the Faculties, ex-officio;

(xii) two Professors one each from the Faculties of Arts and Science elected by the Professors of the respective Faculty from amongst themselves, in accordance with the provisions made in this behalf by Statutes; Amendment of West Ben. Act XXIX of 1959. 229 The West Bengal Universities (Amendment) Act, 1975. [West Ben. Act (Section 3.)

(xiii) one teacher, not being a Professor, from each of the Faculties, elected by the teachers of the respective Faculty from amongst themselves, in accordance with the provisions made in this behalf by statutes;

(xiv) the Principal, Durgapur Engineering College or where the Principal is himself a Dean, a Professor of the said college elected by its Professors from amongst themselves, in accordance with the provisions made in this behalf by statutes;

(xv) the Principal, Burdwan Medical College or where the Principal is himself a Dean, a Professor of the said college elected by its Professors from amongst themselves, in accordance with the provisions made in this behalf by Statutes; (xva) ten teachers of affiliated colleges, of whom at least two shall be women and at least one shall be from each of the districts comprising the territorial jurisdiction of the University, elected by the teachers of all such colleges other than the Teachers' Training Colleges and the Engineering and Medical Colleges, from amongst themselves, in accordance with the provisions made in this behalf by Statutes; (xvb) one teacher elected by the teachers of the affiliated Teachers' Training Colleges from amongst themselves, in accordance with the provisions made in this behalf by Statutes;

(xvc) five Principals of affiliated colleges other than the Engineering and Medical Colleges, elected by the Principals of such colleges from amongst themselves, in accordance with the provisions made in this behalf by Statutes; (xvd) two persons to be elected in accordance with the provisions made in this behalf by Statutes by members of Governing Bodies of Colleges, not being Principles or Teachers of Colleges, from amongst themselves; (xve) five members of the West Bengal Legislative Assembly, one from each of the districts 230 The West Bengal Universities (Amendment) Act, 1975. XL VIII of 1975.] (Section 3.) comprising the territorial jurisdiction of the University, elected by the members of the West Bengal Legislative Assembly in accordance with the provisions made in this behalf by Statutes; (xvf) thee persons of whom—

(1) one shall be elected by the post-graduate students of the Faculties of Arts, Science and Commerce, if any, including the affiliated and constituent colleges from amongst themselves,

(2) one shall be elected by rotation from amongst the students pursuing courses of study in

(a) Engineering, (b) Medicine, (c) Teachers' Training and (d) law at the University and in affiliated and constituent colleges, by all the aforesaid students,

(3) one shall be elected by the students of the constituent and affilated colleges of the University excluding post-graduate students in those colleges and students pursuing courses of study in Engineering, Medicine, Teachers' training and Law, from amongst themselves, in accordance with the privisions made in this behalf by Statutes; (xvg) (1) one person appointed by the Vice- Chancellor, by rotaiton from amongst the post-graduate students of the Faculties of Arts, Science and Commerce, if any, including the affiliated and constituent colleges, on the basis of the results of the preceding degree examinations of the University,

(2) one person appointed by the Vice- Chancellor, by rotation from amongst the students pursuing courses of study in (a) Engineering,

(b) Medicine, (c) Teachers' Training and (d) Law at the University and in affiliated and constituent colleges, on the basis of academic distinction in the preceding examinations, in accordance with the provisions made in this behalf by statutes ;"; 231 The West Bengal Universities (Amendment) Act, 1975. [West Ben. Act (Section 3.)

(2) in sub-section (4),—

(i) for the words "other than ex-officio members shall hold office for a term of two years", the following shall be substituted, namely:— ", other than ex-officio members and the members referred to in clauses (xvf) and (xvg) of sub-section (1), shall hold office for a term of two years, and the members referred to in clauses (xvf) and (xvg) of sub-section (1) shall hold office for a term of one year,";

(ii) for the proviso, the following proviso shall be substituted, namely: "Provided that when a person is elected or appointed as a member of the University from any constituency, he shall cease to be a member when he ceases to belong to that constituency.";

(3) sub-section (5) shall be omitted;

(b) section 9 shall be omitted;

(c) in section 12,—

(1) in sub-section (1),—

(i) the words, brackets and figures "clause (vi), clause (xii) or" shall be omitted,

(ii) clause (d) shall be omitted,

(2) for sub-section (3), the following sub-section shall be substituted, namely:— "(3) If a casual vacancy arises in the seat of any member elected under clause (xii), clause (xiii), clause

(xiv), clause (xv), clause (xva), clause (xvb), clause

(xvc), clause (xvd), clause (xve) or clause (xvf), or appointed under clause (xvg), of sub-section (1) of section 8 for any of the reasons referred to in clauses

(a), (b), (c), or (e) of sub-section (1), or in view of the provisions of the proviso to sub-section (4), of section 9, such vacancy shall be filled up by a person having the requisite qualifications to be elected by the body or appointed by the Vice-Chancellor, as the case may be, and in the manner referred to in the said clauses (xii),

(xiii), (xiv), (xv), (xva), (xvb), (xvc), (xvd), (xve), (xvf) or (xvg), as the case may be.", 232 The West Bengal Universities (Amendment) Act, 1975. XLVIII of 1975.] (Section 4.)

(3) in sub-section (4), for the word "elected" in the two places where it occurs, the words "elected or appointed" shall be substitured;

(d) in sub-section (5) of section 21,—

(1) clause (i) shall be omitted,

(2) in clause (j), for the word, brackets and figure "clause

(xiii)", the words, brackets, figures and letters "clauses

(xii), (xiii), (xva), (xvb) and (xvc)" shall be substituted,

(3) to clause (j), the words, brackets and figures "and also for election if necessary, under clauses (xiv) and (xv) of the said sub-section" shall be added,

(4) in clause (k), for the word, brackets and figure "clause

(xiv)", the word, brackets, figure and letter "clause (xvd)" shall be substituted,

(5) after clause (k), the following clause shall be inserted, namely:— "(ka) the procedure to be followed for the election or appointment of the members referred to in clauses (xve) and (xvf) and clause (xvg) of sub-section (1) of section 8.". Amendment of West Ben. Act XIII

(i) in clause (iii), after the word "ex-officio", the words ", of 1960. or his nominee" shall be added;

(ii) in clause (iv), after the word "ex-officio", the words ", or his nominee" shall be added;

(iii) for clause (viii), the following substituted, namely:— "(viii) the Director of Public Instruction, Government of West Bengal, a-officio; (viiia) the President, West Bengal Council Secondary Education, ex-officio; (viiib) four Deans of the Faculties, one from each of the Faculties of Arts, Science, Commerce and Education, ex-officio;

(viiic) three Teachers, being Professors, graduate Departments, one from

4. In the Kalyani University Act, 1960,—

(a) in section 8,—

Faculties of Arts, Science and Commerce, elected by the Professors of the Post-graduate Departments in accordance with the provisions made by Statutes in this behalf";

(iv) clause (ix) shall be omitted;

(v) for clause (x), the following clauses shall be subtituted, namely:— "(x) six Teachers, not being Professors, of the Postgraduate Departments, two from each of the Postgraduate Departments of Arts (including Education), Science and Commerce elected by the teachers of those Departments in accordance with the provisions made by Statutes in this behalf;

(xa) (a) one person to be elected by the Post-graduate students of the Faculty of Arts including Education from amongst themselves,

(b) one person to be elected by the Postgraduate students of the Faculty of Science from amongst themselves,

(c) one person to be elected by the Postgraduate students of the Faculty of Commerce, if any, from amongst themselves, in accordance with the provisions made by Statutes in this behalf;

(xb) one person from amongst the Post-graduate students of the University to be nominated by the Vice-Chancellor, by rotation from amongst such students of the Faculties of Arts, Science and Commerce, if any, on the basis of their results in the preceding degree examinations in accordance with the provisions made by Statutes in this behalf;",

(2) in sub-section (2),—

(i) for the words "shall hold office for a period of two years", the following shall be substituted, namely:— "or a member referred to in clause (xa) or clause (xb) of sub-section (1) shall hold office for a period of two years, and a member referred to in clause (xa) or clause

(xb) of sub-section (1) shall hold office for a period of one year,"; 234 The West Bengal Universities (Amendment) Act, 1975. XLVIII of 1975.] (Section 4.)

(ii) for the priviso, the following proviso shall be subsituted, namely:— "Provided that a member elected or nominated in accordance with the provisions of clause (viiic) or clause (x) or clause (xa) or clause (xb) of sub-section

(1) shall cease to hold office as such as soon as he ceases to hold office as a Teacher of a Post-graduate Department or ceases to be a student, as the case may be.";

(b) section 9 shall be omitted;

(c) in section 11,—

(i) for sub-section (4), the following sub-section shall be substituted, namely:— "(4) If a casual vacancy arises in the seat of any member elected under clause (viiic) or clause (x) or clause (xa), or nominated under clause (xb), of sub-section (I) of section 8 for any of the reasons referred to in sub-section (1) or for the reason that such member has ceased to hold office as a member under the proviso to sub-section (2) of section 8, such vacancy shall be filled by a person having the requisite qualifications to be elected by the body or nominated by the Vice-Chancellor and in the manner referred to in clause (viiic), clause (x) or clause (xa), or clause

(xb), of sub-section (1) of section 8, as the case may be.";

(ii) in sub-section (5), for the word "elected", in the two places where it occurs, the words "elected or nominated" shall be subsitituted;

(d) in sub-section (5) of section 20,—

(i) clause (i) shall be omitted;

(ii) after clause (p), the following clause shall be inserted, namely:— "(pp) the procedure to be followed for the election or nomination of the members referred to in clauses

(viiic), (x) and (xa), and clause (xb), of sub-section (1) of section 8;". 235 The Wes-, Bengal Universities (Amenchncni) Act, 1975. [West Ben. Act (Section 5., Amendment of West Ben. Act XXVII of 1961.

5. In the North Bengal University Act, 1961,—

(a) in section 8,—

(i) in sub-section (1),—

(1) in clause (iii), after the word "ex-officio", the words "or his nominee" shall be added,

(2) in clause (iv), after the word "ex-officio", the words "or his nominee" shall be added,

(3) for clauses (v) and (vi), the following clauses shall be substituted, namely:— "(v) four Deans of Faculties, one from each of the Faculties of Arts, Science, medicine and Pharmacy, and Engineering and Technology, ex-officio;

(vi) two Principals of constituent colleges, not being Deans of Faculties of the University, ex-officio; (via) the director of Public Instruction, Government of West Bengal, ex-officio; (vib) the President, West Bengal Council of Higher Secondary Education, "ex-officio ;",

(4) clause (vii) shall be omitted,

(5) for clauses (viii), (ix) and (x), the following clauses shall be substituted, namely:— "(viii) the Principal, North Bengal University Medical College or where the Principal is himself a Dean, a professor of the college elected by the Professors of that college from amongst themselves in accordance with the provisions made in this behalf by Statutes; (viiia) the Principal, Jalpaiguri Engineering College or where the Principal is himself a Dean, a Professor of the college elected by the Professors of that college from amongst themselves in accordance with the provisions made in this behalf by Statutes; (viiib) three Principals of affiliated colleges elected by the Principals of such colleges from amongst themselves in accordance with the provisions made in this behalf by Statutes;

(ix) two Professors, one from each of the Faculties of • Arts and Science elected by the Professors of the 236 The West Bengal Universities (Amendment) Act, 1975. XLVIII of 1975.] (Section 5.) respective Faculty from amongst themselves in accordance with the provisions made in this behalf by Statutes; (ixa) two teachers, not being Professors, one from each of the Faculties of Arts and Science elected by the teachers of the respective Faculty from amongst themselves in accordance with the provisions made in this behalf by Statutes; (ixb) five teachers of affiliated colleges elected by the teachers of such colleges ' from amongst themselves in accordance with the provisions made in this behalf by Statutes;

(ixc) one teacher of the Teachers' Training Colleges elected by the teachers of such colleges from amongst themselves in accordance with the provisions made in this behalf by Statutes;

(x) two persons to be elected in accordance with the provisions made in this behalf by Statutes by members of Governing Bodies of Colleges, not being Principals or Teachers of Colleges, from amongst themselves;

(xa) five members of the West Bengal Legislative Assembly, one from each of the districts comprising the territorial jurisdiction of the University, elected by the Members of the West Bengal Legislative Assembly in accordance with the provisions made in this behalf by Statutes;

(xb) three persons of whom—

(1) one shall be elected by the post-graduate students of the Faculties of Arts and Science from amongst themselves,

(2) one shall be elected, by rotation from amongst—

(i) the students of the Faculty of Medicine and Pharmacy,

(ii) the students of the Faculty of Engineering and Technology, and

(iii) the students of the Departments of Education and Law, by the students of the aforesaid Faculties and Departments, and 237 The West Bengal Universities (Amendment) Act, 1975. [West Ben. Act (Section 5.)

(3) one shall be elected by the students of the under-graduate colleges affiliated to the University from amongst themselves, in accordance with the provisions made in this behalf by Statutes;

(xc) (1) one person appointed by the Vice-Chancellor, by rotation from amongst the post-graduate students of the Faculties of Arts and Science, on the basis of the results in the preceding degree examinations,

(2) one person appointed by the Vice-Chancellor, by rotation from amongst—

(i) the students of the Faculty of Medicine and Pharmacy,

(ii) the students of the Faculty of Engineering and Technology, and

(iii) the students of the Departments of Education and Law, on the basis of academic distinction, in accordance with the provisions made in this behalf by Statutes;",

(6) clause (xi) shall be omitted,

(7) in clause (xii), for the word "five", the word "three" shall be substituted;

(ii) for sub-section (4), the following sub-section shall be substituted, namely:— "(4) The members of the University other than ex-officio members and the members referred to in clauses (xb) and (xc) of sub-section (1) shall hold office for a term of two years, and the members referred to in clauses

(xb) and (xc) of sub-section (1) shall hold office for a term of one year, from the date on which they were elected or appointed, as the case may be:

Provided that where a person is elected or appointed as a member of the University from any constituency, he shall cease to be a member when he ceases to belong to that constituency.",

(iii) sub-section (5) shall be omitted;

(c) in section 12,--

(a) in sub-section (I),— CO the words, brackets and figures "clause (vi), clause

(viii) or" shall be omitted,

(ii) clause (d) shall be omitted;

(b) for sub-section (3), the following sub-section shall be substituted, namely:— "(3) if a casual vacancy arises in the seat of a member elected under clauses (viii), (viiia), (viiib), (ix), (ixa), (ixb), (ixc), (x), (xa) or (xb), or appointed under clause

(xc), of sub-section (1) of section 8 for any of the reasons referred to in clauses (a), (b), (c) or (e) of sub-section (1), or in view of the provisions of the proviso to sub-section (4) of section 8, such vacancy shall be filled by a person having the requisite qualifications to be elected by the body or appointed by the Vice-Chancellor, as the case may be and in the manner referred to in the said clauses (viii), (viiia), (viiib), (ix), (ixa), (ixc), (x), (xa) or (xb) or clause (xc), as the case may be.";

(c) in sub-section (4), for the word "elected' in the two places where it occurs, the words "elected or appointed" shall be substituted;

(d) in sub-section (5) of section 23,—

(i) clause (j) shall be omitted,

(ii) in clause (k), for the word, brackets and figure "clause

(ix)", the words, brackets, figures and letters "clauses (viiib), (ix), (ixa), (ixb) and (ixc)" shall be substituted,

(iii) to clause (k), the words, brackets and figures "and also for election, if necessary, under clauses (viii) and (viiia) of the said sub-section" shall be added,

(iv) after clause (1), the following clause shall be inserted, namely:— "(II) the procedure to be followed for the election or appointment of the members referred to in clauses (xa) and (xb) and clause (xc) of sub-section (1) of section 8 ;". 239 The West Bengal Universities (Amendment) Act, 1975. 6. In the Rabindra Bharati Act, 1961,—

(a) in section 9,—

(1) in sub-section (1),—

(i) in clause (iii), after the word "ex-officio", the words ", or his nominee" shall be added,

(ii) in clause (iv), after the word "ex-officio", the words ", or his nominee" shall be added,

(iii) clause (v) shall be omitted,

(iv) for clauses (vi) and (vii), the following clauses shall be substituted, namely:— "(vi) the Director of Public Instruction, Government of West Bengal, ex-officio; (via) the President, West Bengal Council of Higher Secondary Education, ex-officio;

(vii) three Deans, one from each of the Faculties of Arts, Fine Arts and Visual Arts, ex-officio;",

(v) clause (ix) shall be omitted,

(vi) clauses (xiv) and (xv) shall be omitted,

(vii) in clause (xvi), for the word "five", the word "three" shall be substitued,

(viii) after clause (xvi), the following clauses shall be inserted, namely:— "(xvii) three Professors, not being Deans, one from each of the Faculties of Arts, Fine Arts and Visual Arts; elected by the Professors of all the Faculties in accordance with the provisions made in this behalf by Statutes; (xv iii) five Teachers, not being Professors, elected by the Teachers excluding Professors of the respective Faculty, of whom two shall be from the Faculty of Arts, two from the Faculty of Fine Arts and one from the Faculty of Visual Arts, in accordance with the provisions made in this behalf by Statutes;

(xix) (a) two students to be elected by the Post-graduate students of the Faculty of Arts from amongst themselves,

(b) one student from amongst the students of the Faculty of Fine Arts and Visual Arts to be elected by the students of the post-graduate and the under-graduate units of the said Faculties, 240 The West Bengal Universities (Amendment) Act, 1975. XLVIII of 1975.] (Section 6) in accordance with the provisions made in this behalf by Statutes;

(xx) one post-graduate student to be appointed by the Vice-Chancellor, by rotation in accordance with the provisions made in this behalf by Statutes from amongst the students of the Faculties of Arts, Fine Arts and Visual Arts, on the basis of the results in the preceding degree examinations.";

(2) for sub-section (4), the following sub-section shall be substituted, namely:— "(4) A member of the University other than an ex-officio member or a member referred to in clauses (xix) and (xx) of sub-section (1) shall hold office for a term of two years from the date on which he is elected or appointed, as the case may be, and a member referred to in clause (xix) or clause (xx) of sub-section (1) shall hold office for a term of one year from the date on which he is elected or appointed, as the case may be:

Provided that—

(a) such term of two years or one year, as the case may be, shall be held to include any period which may elapse between the expiry of the said two years or one year and the date of election or appointment of a new member in place of the member whose term of office expires;

(b) the members referred to in clause (xvii) or clause (xviii) of sub-section (1) shall cease to hold office as such as soon as they cease to hold office as professors or Teachers of the University, as the case may be; and

(c) the members referred to in clauses (xix) and (xx) of sub-section (1) shall cease to hold office as such as soon as they cease to be students of the University.";

(b) section 10 shall be omitted;

(c) in section 12,—

(1) in sub-section (1),—

(i) the words, brackets and figures "clause (vii), clause

(xv) or" shall be omitted,

(2) in sub-section (2),—

(i) the words, brackets and figure "or clause (ix)" shall be omitted,

(ii) the words "or of the President of the Rabindra Bharati Society, as the case may be" shall be omitted,

(3) after sub-section (3), the following sub-section shall be added, namely:— "(4) If a casual vacancy arises in the seat of any member elected under clause (xvii), clause (xviii) or clause (xix) or appointed under clause (xx) of sub-section (1) of section 9 for any of the reasons referred to in clauses (a), (b), (c) or (e) of sub-section (1) or in view of the provisions of clause (b) or clause (c) of the proviso to sub-section (4) of section 9, such vacancy shall be filled up in the manner referred to in the said clause (xvii), clause (xviii), clause (xix) or clause (xx) as the case may be, and the person so elected or appointed shall hold office as a member for the unexpired period of the term of office of the member in whose place he is so elected or appointed.";

(d) in sub-section (5) of section 21,—

(i) clauses (j) and (k) shall be omitted,

(ii) after clause (s), the following clause shall be inserted, namely:— "(ss) the procedure to be followed for the election or appointment of the members referred to in clauses

(xvii), (xviii) and (xix), and clause (xx), of sub-section

(1) of section 9;".

7. In the Calcutta University Act, 1966,—

(a) In sub-section (I) of section 19,—

(1) clause (iii) shall be omitted;

(2) for clause (vii), the following clauses shall be substituted, namely:— "(vii) the Secretary, Department of Finance, Government of West Bengal, or his nominee; (vita) the President, West Bengal Council of Higher Secondary Education; (viib) all Deans of Faculties;";

(3) for clause (viii), the following clause shall be substituted, namely:— "(viii) all University Teachers who are Heads of Departments not being Deans of Faculties;"; 242 The West Bengal Universities (Amendment) Act, 1975. XLVIII of 1975.] (Section 7.)

(4) clauses (ix), (x) and (xx) shall be omitted;

(5) for clause (xxi), the following clause shall be substituted, namely:— "(xxi) fifteen Principals elected by the Principals of Affiliated Colleges including Professional and Constituent Colleges from amongst themselves, of whom—

(a) at least two shall be women,

(b) at least two shall be Principals of Professional Colleges, and

(c) at least two shall be Principals of Constituent Colleges;";

(6) clause (xxii) shall be omitted;

(7) for clauses (xxiii) to (xxvi), the following clauses shall be substituted, namely:— "(xxiii) fourteen teachers of the Post-Graduate Departments of the University elected jointly by the teachers of such Departments from amongst themselves of whom—

(a) two shall be Professors,

(b) four shall be Readers, and

(c) eight shall be Lecturers;

(xxiv) twenty-six teachers of Affiliated Colleges including Constituent and Professional Colleges elected jointly by the teachers of such Colleges from amongst themselves of whom—

(a) two shall be from Professional Colleges (excluding the Bengal Engineering College),

(b) two shall be from the Constituent Colleges,

(c) two shall be from the Bengal Engineering College, and

(d) twenty shall be from Affiliated Colleges including at least two women;";

(8) for clause (xxviii), the following clause shall be substituted, namely:— "(xxviii) eight persons elected by the members of the West Bengal Legislative Assembly from amongst themselves of whom at least one shall be from each of the districts comprising the territorial jurisdiction of the University;";

(9) after clause (xxx), the following clauses shall be inserted, namely:— "(xxxa) nine persons of whom- 243 The West Bengal Universities (Amendment) Act, 1975. [West Ben. Act (Section 7.)

(1) one shall be a post-graduate student of the Faculty of Arts elected by the students of the said Faculty,

(2) one shall be a post-garduate student of the Faculty of either Science or Technology elected by rotation by the post-graduate students of both the Faculties,

(3) one shall be a post-graduate student of the Faculty of Commerce elected by the students of the said Faculty,

(4) one shall be a student of the Faculty of Engineering elected by the students of the said Faculty,

(5) one shall be a student of the Faculty of Medicine elected by the students cf the said Faculty,

(6) one shall be a stude.-I of the Faculty of either Homoeopathy or Ayurved or Dental Science or Veterinary Science, the particular Faculty in any year being determined by rotaton, elected by the students of all the aforesaid Faculties,

(7) one shall be a student of the Faculty of Law elected by the students of the said FacUlty,

(8) one shall be a student of the Faculty of Education elected by the students of the said Faculty, and

(9) one shall be a student of the Faculty of either Fine Arts and Music or Library Science or Social Welfare and Business Management or Journalism or Home Science or Agriculture, the particular Faculty in any year being determined by rotation, elected by the students of all the aforesaid Faculties; (xxxb) five persons elected by the students of the under-graduate colleges of Arts, Science, Commerce and Technology including textile Technology, Leather Technology, Printing Technology and Ceramic Techhology, affiliated to the University from amongst themselves;";

(10) in clause (xxxi),—

(ii) after the word "music", the word, "sports" shall be inserted; (I I) after clause (xxxi), the following clause shall be added, namely:— "(xxxii) three persons, one each from the post-graduate students of the Faculties of Arts, Commerce and Science, nominated by the Vice-Chancellor on the basis of the results in the preceding degree examination of the University.",

(b) in section 37, in sub-section (1), for the words "shall hold office for a period of four years", the following shall be subsitituted, namely:— "except any member referred to in clauses (xxxa), (xxxb) and (xxxii) of sub-section (1) of section 19 shall hold office for a period of four years, and an elected or nominated member referred to in clauses (xxxa), (xxxb) and (xxxii) of sub-section
