(1) Any person, who wilfully obstructs an Inspector in the exercise of his powers or discharge of his duties under this Act, or intentionally omits to produce or deliver up, for inspection on demand by an Inspector appointed under this Act, any register, records or other documents, or intentionally omits to furnish any information required under this Act shall, on conviction be punished

(a) for the first offence, with imprisonment for a term which may extend to three months or with a fine which may extend to one thousand rupees or with both; and 16] THE KOLKATA GAZETTE, EXTRAORDINARY, FEBRUARY 18, 2008 [PART III Previous sanction of the State Government necessary.

(b) for second and subsequent offence, with imprisonment for a term which may extend to six months or with fine which may extend to five thousand rupees, or with both.

(2) If an employer ofthe Unorganised Sector fails to get his establishment registered under this Act or fails to pay and contribution which under this Act he is liable to pay shall, on conviction, be punished with imprisonment for a term which may extend to one year or with a fine which may extend to five thousand rupees, or with both.

21. No prosecution shall be instituted against any person in respect of any. ffence under this Act without the previous sanction of the State Government.
