GOVERNMENT OF WEST BENGAL LAW DEPARTMENT Legislative West Bengal Act XVI of 1997 THE VIDYASAGAR UNIVERSITY (AMENDMENT) ACT, 1997. [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 4th August, 1997.] [4th August 1997.] An Act to amend the Vidyasagar University Act, 1981. West Ben. Act XVIII of
1981. WHEREAS it is expedient to amend the Vidyasagar University Act, 1981, for the purposes and in the manner hereinafter appearing; It is hereby enacted in the Forty-eighth Year of the Republic of India, by the Legislature of West Bengal, as follows:-
1. (1) This Act may be called the Vidyasagar University (Amendment) Act, 1997.
(2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. In sub-section (1) of section 17 of the Vidyasagar University Act, 1981 (hereinafter referred to as the principal Act),— under the heading "(b) elected members",—
(a) in clause (xiii),—
(i) for the word "six", the word "seven" shall be substituted, and
(ii) after the words "one shall be a woman", the words "and one shall be from an engineering college in which instruction is provided for courses of study in engineering and technological subject," shall be inserted;
(b) in clause (xiv),—
(i) for the word "three", the word "four" shall be substituted, and
(ii) after the words "other than constituent colleges" the words ", of whom one shall be from an engineering or technological college," shall be inserted. Short title and commencement. Amendment of section 17 of West Ben. Act XVIII of

3. In sub-section (1) of section 18 of the principal Act,—
(1) for clause (i), the following clause shall be substituted:— "(i) to initiate proposals for the establishment of Faculty Councils for post-graduate studies and Councils for undergraduate studies and to establish University Departments, institutions, centres, libraries, laboratories, workshops and museums for study and research;";
(2) in clause (ii), after the word "laboratories", the word ", workshops" shall be inserted. Amendment 4. In sub-section (1) of section 20 of the principal Act,— of section
20. (1) under the heading "(a) ex officio members", after clause (vi), the following clause shall be inserted:— "(via) the Principal, Haldia Institute of Technology;";
(2) under the heading "(b) elected members", for clause (xvii), the following clause shall be substituted:— "(xvii) seven Teachers of affiliated colleges, of whom one shall be from an engineering or technological college, elected jointly by the Teacher-members of the Councils for undergraduate studies from amongst themselves;". 21. In section 21 of the principal Act,—
(1) in clause (ii),—
(a) for the words "to recommend to the Court,", the words "to recommend to the Court the initiation of action for the establishment of Faculty Councils for post-graduate studies and Councils for undergraduate studies and," shall be substituted, and
(b) after the word "laboratories", the word ", workshops" shall be inserted;
(2) in clause (iii), after the words "University Laboratories", the words ", University Workshops" shall be inserted;
(3) in clause (v), after the words "University Laboratories,", the words "University Workshops," shall be inserted;
(4) in clause (vii), after the word "laboratories", the word, ", workshops" shall be inserted. 166 The Vidyasagar University (Amendment) Act, 1997. XVI of 1997.] (Sections 6, 7.)
6. In section 22 of the principal Act,— Amendment
(1) in sub-section (1), after clause (b), the following clause shall of section
22. be inserted:— "(c) the- Faculty Council for Post-Graduate Studies in Engineering and Technology.";
(2) in sub-section (2), after the words "Each Faculty Council for post-graduate studies", the words ", other than the Faculty Council for Post-Graduate Studies in Engineering and Technology," shall be inserted;
(3) after sub-section (2), the following sub-section shall be inserted:— "(2A) The Faculty Council for Post-Graduate Studies in Engineering and Technology shall consist of the following members:—
(i) the Vice-Chancellor—Chairman;
(ii) the Principal, Haldia Institute of Technology;
(iii) the Head or Heads of the Department or Departments of the constituent colleges of engineering and technology;
(iv) the Professor or Professors of the Department or Departments of the constituent colleges of engineering and technology;
(v) two Teachers, other than Professors, participating in post-graduate teaching in the subject concerned, from the constituent colleges of engineering, elected jointly by the Teachers of such colleges;
(vi) one person having special knowledge in the subject concerned, nominated by the Vice-Chancellor;
(vii) three Teachers participating in undergraduate teaching in the subject concerned, elected by the Teachermembers of the Council for Undergraduate Studies in Engineering and Technology.".
7. In section 23 of the principal Act,—
(1) in clause (i), after the word "laboratories", the word ", workshops" shall be inserted;
(2) in clause (v), after the word "laboratories,", the word "workshops," shall be inserted;
(3) in clause (vii), for the words "and University Laboratories", the words ", University Laboratories and University Workshops" shall be substituted. Amendment of section

8. In section 24 of the principal Act,—
(1) in sub-section (1), after clause (ii), the following clause shall be inserted:— "(iii) the Council for Undergraduate Studies in Engineering and Technology.";
(2) after sub-section (3), the following sub-section shall be inserted:— "(3A) The Council for Undergraduate Studies in Engineering and Technology shall consist of the following members:—
(i) the Vice-Chancellor—Chairman;
(ii) the Dean of the Faculty Council for Post-Graduate Studies in Engineering and Technology;
(iii) the Principal, Haldia Institute of Technology;
(iv) the Heads of the Departments of teaching, Haldia Institute of Technology;
(v) three Teachers, not belonging to the same Department, elected jointly by the Teachers of affiliated colleges providing instruction for courses of study in engineering and technology;
(vi) one person nominated by the Director of Technical Education, West Bengal;
(vii) two persons having knowledge in the subject concerned, nominated by the Vice-Chancellor.". 168 Page 1 Page 2 Page 3 Page 4
