Whcreas it is expedient to provide for the establishment of a Council giving it Powers for the social, economic, cduqtlonnl and cullural advancement and development of thc people rcsjding in certain districts of the Western parts of Orissa. , - 1 , . . .

, , . . . . . I aobpitfon~. 2. In this Act, unless thc context' otherwise requires- '

(a) "Chief Exccutivc Officer'' means the Chief Executive Officer of the Council ;

(b) "Counci~" mmns the Western Orissa Development Council established under this Act. , . , , , , , .:'

(c) "Co~ncil area" means the arca of the Council as mentioned in ,,' sub-section (1) of section 3 ;

(6) ~'GavernmentbJ means the State Govcrnmcnt of Odssa ; . .

(e) "Preaaibedm means prescribed by mles ;

(f) "Council F d P means the Council Fund established undcr section 15 ;

(g) "Rdes" means rules made under tbis Act.

Etsablirh- 3. (I) There shalI be established and constituted by the Oovernment, a m t ~ t and Council to be known as the Wetern Orissa Development Council for thc h w r p ~ t a - accelerated devdopment and advancement of the area OF tho Council which shall comprlsc the districts of Baragarb, Bolangir, Boudb, Deognrh, Jbarsuguda, C o ~ l . Kalahandl, Nuapada, Sambalpur, Sonepur and Sundargarh and may include auch other area as may be prescribed.

(2) The Council shall be a body corporate with the name aforesaid havlng perpetual succession and a common seal with power, subject to the provisions of this Act, to acquire, hold and dispose property, both movablc and immovable, and to contract with approval of the Government, and shall, by the said name, sue and be sued.

(3) The Council shall be decmed to havc been incorporated for the purposes, among others, of preparing plans and programmes for the allround development in the Council area promoting original rcsearch of advancement of education, of educational and financial condition of the ~ o p l e , of inspecting the different institutions, organisations, local authorities and supervising a11 mattm relating:

to the general standard of the people of the area and of promoting their physical, mental and moral welfare.

(4) The headquarters of tho Council shall bc at such a place within the Council arcaas may bs notified in tho Gazettc by the Gwernment in cons~ltatioa with Cguncil which shall meet for the purpose at such place as the Goveramont may ftx. .. .

ComporItfon 4. ( 1 ) The council shall consist of the foUowing members, namcly :- or cdprtci~

(a) two members of the Lok Sabha, representing anyconstitueacy, either wholly or in part, within the Council area, to be nominated by Government on rotational bads ;

(b) eleven members of the Orissa Legislative Assembly elected from any constituency, either who1ly or partIy within the Council area, to be nominated by Government on rotational basis ;

(c) ten m s t o be nominated by Government from amongst persons who have-

(i) ~peciat knowledge of planning, jinaacc and a&unts of Government, or , . , .

(ti) wide experience in public administration or social s e r y i ~ , or ( [ I t ) expertise or special knowledge in different fields like Education including law, technical education and vocat jonal training, Agticul ture, kdwtrles, Irrigation, Public Health, Forestry, Mining, Public Works, EmplopWt or rnanagementIof people's problems ;

. , (dl Rovcnuc Divisional Commissioner of the Division under shich the maximum portion of Council area is situated ; and {e) Chief Executive Ofier, who shall be the- ember-secretary of the Council.

12) One of the memkers of thc Council referred to in sub-section ( I ) , as mag be nominated by the Government, shall be the Chairman of ib Council.

(2) A mmber, other than the Revcnuc Divjsionel Commissioner and the Chlef Eaecutive Officer, may, by writing under his hand, addressed to Government resip from the ofice of the Chairman if he is the Chairman or, as the case may be, from $8 o5ee as member, and tho member so resigning shalI be deemed to have vacated his . .

Provided that no person shall b removed under this sub-section untiI that person has beea given an opportunity of being beard in the matter.

(4) When the office of a member including the Chairman becomcs vacant by big resignation, removal, death or otherwise. the vacancy shall be med up in the ~ame manner in which he was taken.

(g The Chairman of the Council shaII enjoy the status of a Minister of the State ofOrissa and shall be entitled to such remmeralion add allonances' as may bs, prescribed.

(6) The other, members of tho Council excluding ,lhe Revenue ~ ivh iona l Cornmissioner and' the Chief Executiye 05cer. shalI be paid such fees and allowances for attending the meetings of the Council and performing the functions thereof entrustedto them, as the Council may, from time t o time h. . , .

. (3) The Chief Executive Officer shall be under the adminislrat ive control of the Council.

7. (1) The Council shall determine, with approval of the G o v m e n t , the number of Class I and Class I1 Officers that are required for the cflective performance of its functious underthis Act and request the Government to place the Services of those officers under the Council, whereupon the Government sshd, in consuItation with the Chairman of the Council, dcpute such officers l o funelion under the Co~ncjl.

(2) The Council, with prior approvaI or lhe Government, shall create Class liII and Class IV posts and fill up the said posts in-the manner prescribed.

(3) The appointment of officers and other employees, their terms and conditions of service shdl be such as may be prescribed.

(4) The Council shaII be the disciplinary authority in respecr of Class UI and Class TV emyloyees of the Council and shall exercise the powers of disciplinary authority in the manner prescribed.

Admini- 8. The administrative expenses of the Council, including 1 he salaries, auowances arrstivn ,and pensions payable to the Chief Executive Oficer and other o5cers and employees a P m s a ~f the Council, including those deputed by Government, shall be defrayed out ofthe Counci'' grant-in-aid fund granted 'by the Governmcnt.

Duties and 9. (1) The Chief Executive OEcer shall be responsible for the maintenan= of the Powers of records of the Council and shall exercise administrative supervision and controI overall Chic r oficers and employee's of the Council including those whose services may bc placed at ~ ~ ~ V d the msposal of the Council by the Gawmment.

(2) Subjeit t o the rules, the Chief Executim Officer shall exercise such., other powers, perform such other functions and discharge such other dutles as the council may, by general or special resolution, decide from limeto time.

including the annual grant-in-aid by the Government which' shall not be ' 16ss than'rupees thirty cmres, and disbursement for the followiag financial year and submit thc same to the Government three months beforethe presentation ofthe State Budget ; and

(0) prepare in each financial ycar a supplementary Budget providing grant-in- ' aid t o bamade by the Government to the Council in the second phase, which .shall not be lcss than rup-es twenty crores, and ,make any modification of its Budget for that particuIar year an! ,may sub@ those , .

(e) he shall have power to take iamediaie action in emergency.situations, which the Council is competent to do, and every such action shall have to be ratified by thc Council in its next meeting ';

(3) The Member-Secretary, of the C~unc;ll shall, in consultation and with the approval ofthe Chairman, convene themeetings of the CoanciI at a place and time fixed by the Chairman.

C.6) The quorum necessary for thc transaction of business 'of a meeting of the Csuncil shall be ten members excluding tho Chicf Executive Officer, and , the matters mquired to be decided by the ' Council shaU be decided by the 'majority of votes of the members phsent and voting.

(6) Save as aforesaid, the business of the Council shall be transacied in such mannor and in acsordan~ with such piomdure as the Council may, by regulation, determine.

(1) There shall be established by the Council a Fund to be called the Council Fuod. Fund to which shall be credited- ,(a) all slims of money paid to it or any grants made by the Governmmt for the purposes of this Act ;

(6) -any grNUs that may be made by the G ovemmtnt of India or by any person or authority for the purpose of this Act; and

(c) any other amount received by the Council from any other source.

(2) The Council Fund shall be applied for payment of all sums, charges and costs necessary for carrying into effect the purpose of this Act.

(2) Thc Council shall maintain its proper accounts and other relevant rccords in such form and in such manner as may be prescribed.

( I ) If, in the opinion of the Government, the CounclI- ruriPn of Coumli. {a) is not competent to perform, or persistently makes default in the performance, of the duties imposed on i t by or undcr tbis Act or exceeds or abuses its power, or { b ) fails to perform its functions efficiently, the Government may, by an order notified in the Gazelle, supersede the Council:

Provided that the Council shaI1 be given reasonable oppottnniry of being ,head before its supersession.

(2) The notified order shall remain infcrce icr s ~ c h yericd, c ~ t cxcceding dx months, as the Government may specify therein and Ihe Ccuncil shall be rccon~tituted in themanner provided in s~c t ion4 kefore Ihe expiraiicn r f Ihc ~ e r i c d so s$~ci$ed.

(3) When the Council is suptr~ei.ed by an order unlcr sub-seetion (2)-

(a) all nominated members including the Cliairm~n of ~ h c Ccbncil &all vacate their respective cffices with cffrct frcm Ihe dale of publicationof the order;

(b) during* the period of supersession, all the POWCIS and functions of the Counc11 shall be exercised and perfoimed by stcb Ferscn or authority ae the Government may appoint in Ihat bchalf; and

19. Every member including fhe Chairman and every o5cer end employcc of the Council shall be deemed to be public scrvanls within Ihc meaning of seaion 21 of 45 of 1960.

20. No suit shall be instituted against the Council or any Committee or Chairman or any 'member, officer or employee thereof, or any person acting under direction of the Councilor Chairman for anything done or ~ ~ ~ ~ o r t i n g t o bc done in good faith under this Act, or the rules or regulations made thereunder, until expiry of two months notice in writing delivered or left at the Council's office, stating the cause of action, the name and place of abode of the intending plsintifr or petitioner and the, relief which he dains.

23. ( I ) If any difficulty arises in given effect to the provisions of this Act. tha Government may, by order, not inconsistent with the ~r~v i s i ons of this, !Act; ' remove tho difficulty:

(2) On such repeal- 199%.

(a) all praperlies, funds and dua which were vested in, and realisable by the Western Orissa Development. Council constituted under the Aa so repealed, shall vest in and be redlsablo by, the Government; and

(b) all liabilities enlbrceable against the said Council shall bo enfomablc against the Government to the extent of properties, funds and dues vested in, and realised by the Government.
