Environment & Forest dt. 19th July 1991 SRO .A. 169/91- In exercise of the power conferred by the Sub section (2) of section 40, sub-section (3) of section 43 and subsection (2) of section 64 of the Wildlife (Protection) Act, 1972 (Central Act 53 of 1972) the Governor of Tamil Nadu hereby makes the following rules:-……………………………………….
(1) These rules may be called the Wildlife (Transit) (Tamil Nadu) Rules, 1901.
(2) They extend to the whole of the State of Tamil Nadu. (3) They shall come into force on such date as the Government may by notification appoint. Short title, extent and commencement
(1) In these rules unless the context otherwise requires:-
(a) "Act" means the Wildlife (Protection) Act, 1972 (Central Act of 1972).
(b) "Authorised Officer" means an officer authorised by the State Government under sub-section (3) of section 9 of the Act.
(c) Having the jurisdiction as specified in the Annexure to these rules.
(d) "Form" means a form appended to these rules.
(e) "Schedule" means Schedule to the Act.
(f) "Wildlife or Wildlife Product" includes all wild animals Definition specified in schedule I and Part II of Schedule Il of the Act or article, trophy, uncured trophy or meat derived from such animal.
(2) The words and expressions occurring in these rules shall have the same meaning as defined in section 2 of the Act.
(1) No person shall transport from one place to another within the State or outside the State, any wildlife or wildlife product except with the previous permission in writing given by the Chief Wildlife Warden or the authorised officer.
(2) Every application for such permission shall be made in From "A" affixing the Court-fee label for Rs.2 (rupees two only)
(3) On receipt of an application made under sub-rule (2), the Chief wildlife Warden or the authorised officer may, after making such enquiry as he may think fit and within period of fifteen days from the date of receipt of the application either grant or refuse to grant the permission.
Provided that no such permission shall be granted unless the Chief Wildlife warden or the authorised officer is satisfied that the Wildlife of Wildlife product referred in sub-rule (1) has been lawfully acquired.
(4) When the Chief Wildlife Warden or the authorised officer refuses to grant the permission he shall record the reasons for such refusal and a copy of the reasons so recorded shall be communicated to the person applying for the permission. Transit of Wildlife products
(1) In the case of Wildlife or Wildlife products transferred from other States in to Tamil Nadu, the person shall hold the previous permission in writing by the Government of that State or any authority competent to issue such permission in that state.
(2) In the case of transit of Wildlife or Wildlife Products other than that referred to in sub-rule (1), the permit shall be in Form B. This permit will be issued on payment of fee Rs.50 (Rupees fifty only) by a demand draft in favour of the authorised officer. In no case, the payment shall be made in cash. Permit
(5) The permit in Form B shall be in triplicate and shall have Procedure to all parts filled up by the Chief Wildlife Warden or the authorised officer or a subordinate officer duly authorised by him. The Chief Wildlife Warden or the authorised officer shall hand over the original to the applicant and retain the triplicate as counter foil for record in his office. The duplicate shall be sent to the Chief Wildlife Warden in case it is issued by the authorised officer. issue of permits
(6) (1) An appeal from against an order refusing to grant a permit under sub-rule (3) of rule 3 shall lie. Appeal
(a) If such order is made by the authorised officer, to the Chief Wildlife Warden; or
(b) If such order is made by the Chief Wildlife Warden, to the State Government.
(2) In the case of an order passed in appeal by the Chief Wildlife Warden under sub-rule (1) a second appeal shall lie to the State Government against such order.
(3) No appeal under this rule shall be entertained unless it is preferred within fifteen days from the date of the receipt of the order appealed against. Provided that the appellate authority may admit any appeal after the expiry of such period, if it is satisfied that the appellant had sufficient cause for nor preferring the appeal in time.
