"(4) Every application for the renewal of a licence shall be made so as to reach the licensing authority or the authority empowered to renew the licence on or before the date on which the licence expires:

Provided that if the renewal application together with complete documents is received by the licensing authority after the date of expiry of the licence but not later than six months from the date of its expiry; and if the licensing authority is satisfied that the reason for the delay was beyond the control of the licence holder, the licence may, without prejudice to any other action that may be taken in this behalf, be renewed on payment of the late fee equivalent to one year's licence fee.";

(B) in sub-rule (5), the words, " and if no application is received till the date of validity of the licence, the licence shall stand expired" shall be omitted;

(C) after sub-rule (8), the following sub-rules shall be inserted, namely:- "(9) No licence shall be renewed if the application for renewal is received by the licensing or renewing authority after six months of the date of its expiry.

(10) An application for renewal received after six months of the expiry of the licence shall be considered as an application for a new licence and in such case, all the documents required for grant of new licence 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] including No Objection Certificate issued by District Authority shall be submitted to the licensing authority for grant of new licence.".

25. In the principal rules, in rule 51, in sub-rule (3), for the words “this rule”, the words, figure and brackets “sub-rule (2)” shall be substituted.

26. In the principal rules, in rule 52, the words “where the loss exceeds the permitted limit of loss that typically occurs during routine production, storage, transportation, or use of Ammonium Nitrate” shall be omitted.

27. In the principal rules, in SCHEDULE I, in the table, against serial no 3, in column 2,- (A) in item (a), the word "or use" shall be omitted;

(B) for item (b), the following item shall be substituted, namely:- "(b) Licence to possess for sale of Ammonium Nitrate from a store house exceeding 30 MT or Ammonium Nitrate melt in tank; or”;

(C) for item (c), the following item shall be substituted, namely:- "(c) Licence to possess for use of Ammonium Nitrate from a store house or Ammonium Nitrate melt in tank attached to explosives manufacturing or Nitrous Oxide manufacturing unit or industrial applications; or".

(D) in item (d), after the word "storehouse", the words and figure "not exceeding 3 MT." shall be inserted.

28. In the principal rules, in SCHEDULE II, (A) in PART-1, in the table, against Form No A-3, in column 2,-

(a) in item (a), the words "or use" shall be omitted;

(b) for item (b), following item shall be substituted, namely:- "(b) Licence to possess for sale of Ammonium Nitrate from a store house exceeding 30 MT or Ammonium Nitrate melt in tank; or”;

(c) for item (c), the following item shall be substituted, namely:- "(c) Licence to possess for use of Ammonium Nitrate from a store house or Ammonium Nitrate melt in tank attached to explosives manufacturing or Nitrous Oxide manufacturing unit or industrial applications; or"

(d) in item (d), after the word "storehouse", the words and figure "not exceeding 3 MT." shall be inserted;

(B) in PART-2, in the table, against Form No P-3, in column 2,-

(a) in item (a), the words "or use", shall be omitted;

(II) after serial number 1, the following serial number shall be inserted;

"1(a) Name of the Occupier ---------------";

(III) in serial number 3, in item (a), in the table,-

(i) column (2) shall be omitted;

(ii) in the last column, for the existing entries, the following entries shall be substituted, namely:- “Particulars of stevedore licence issued under Ammonium Nitrate Rules, 2012”;

(IV) in condition (12), for the word and figures “rule 49”, the word and figures “rule 50”, shall be substituted;

(V) after condition (12), the following condition shall be inserted, namely:- "(13) Licence holder for export of Ammonium Nitrate shall submit declaration in Form R-12 soon after the consignment of ammonium Nitrate is dispatched from Indian sea port.";

(g) in FORM R-1, in the Notes, for serial number (1), the following shall be substituted, namely:- "(1) The renewal application should reach to the renewal authority before the date of expiry of the licence to avoid payment of late fee.";

(h) in FORM R-10,- (I) below the heading "FORM R-10", for the figures, brackets and letter “26(2)(a)", the figures, brackets and letter “27(2)(a) ” shall be substituted;

(II) in the end, after the words “ Signature of the Licence holder”, the words “or authorised person” shall be inserted;

(i) for FORM R-11(a), the following Form shall be substituted, namely:- "FORM R-11(a) (See rule 20(3) of Ammonium Nitrate Rules, 2012) Form of intimation to be given by the consignor or stevedore to the District Superintendent of Police before dispatch of consignment of Ammonium Nitrate
