Without prejudice to the generality of the expression “misconduct”, it includes the following acts of omission and commission which shall be treated as misconduct for the purposes of these regulations, namely:-
(i) theft, fraud or dishonesty in connection with the business or property of the Authority or property of another person within the premises;
(ii) Taking or giving bribes or any illegal gratification or any remuneration to which he is legally not entitled;
(iii) Possession of pecuniary resources or property disproportionate to the known sources of income by the employee or on his behalf by another person, which the employee cannot satisfactorily account for;
(iv) Furnishing false information regarding name, date of birth, age, father’s name, ability, qualification, or any other matter in relation to the employment at the time of appointment or during the course of employment;
(v) Acting in any manner prejudicial to the interests of the Authority;
(vi) Willful insubordination or disobedience of any lawful and reasonable order of his superior;
(vii) Absence without leave or over-staying the sanctioned leave for more than four consecutive days, without sufficient grounds or satisfactory explanation;
(viii) Habitual late coming or irregular attendance;
(ix) Neglect of work or negligence in the performance of duty including malingering or slowing down of work;
(x) Causing damage to any property of the Authority;
(xi) Interference or tampering with any safety device installed in or about the premises of the Authority;
(xii) Drunkenness or riotous or disorderly or indecent behaviour in the premises of the Authority or outside such premises where such behaviour is related to or connected with employment;
(xiii) Gambling within the premises of the Authority;
(xiv) Smoking within the premises of the Authority where it is prohibited;
(xv) Collection, without the permission of the competent authority, of any money, within the premises of the Authority except the sanctioned by any law or rules of the Authority for the time being in force;
(xvi) Sleeping while on duty;
(xvii) Commission of any act which amount to a criminal offence involving moral turpitude;
(xviii) Absence from the employee’s appointed place of work without permission or sufficient cause;
(xix) Purchasing from or selling to, the authority properties, machinery, stores or other articles without express permission in writing from the competent authority;
(xx) Participating in an illegal strike or abetting, inciting, instigating or acting in furtherance thereof;
(xxi) Willful damage to works of the authority in progress;
(xxii) Failure to wear a uniform or badge or both wherever an employee is required to wear a uniform or badge while on duty;
(xxiii) Disclosing to any unauthorised person any information in accordance with the working of process of the authority, which comes into the possession of the employee during the course of his work. Spreading rumours or giving false information which may bring disrepute to the authority or its employees or spreading panic among them;
(xxiv) Levelling malicious or false allegations;
(xxv) Occupying or taking possession in an unauthorised manner or refusal to vacate or deliver possession of Authority’s quarters or any of its premises, owned or hired when required to do so by Authority;
(xxvi) Refusal to accept a charge-sheet or order or any other communication of management;
(xxvii) Misuse of any advance or non-compliance with the provisions of the rules for grant of any advance/settlement of claims etc;
(xxviii) Violation of the provisions of any of the rules or established practices of the Authority;
(xxix) Subletting of residential quarters to others without express permission from the competent Authority;
(xxx) Deliberate attempt to delay in delivery of cargo with ulterior motives;
(xxxi) Under weighing of cargo with intention/interest to pass undue benefit to passenger/ agent/ third party;
(xxxii) Recycling of terminal entry passes/ tickets etc;
(xxxiii) Unauthorized allotment of retiring rooms, non-realization of room charges, failure to maintain allotment/vacation record;
(xxxiv) Disruption of Air Traffic Service in any manner whatsoever;
(xxxv) Abetment of, or attempt to commit, any act which amounts to misconduct;
(xxxvi) Commission of any act subversive of discipline or of good behavior;
(xxxvii) Sexual harassment of working women
(a) No employee shall indulge in any act of sexual harassment of any woman at her work place.
(b) Every employee who is incharge of a work place shall take appropriate steps to prevent sexual harassment to any woman at such work place.
Explanation – For the purpose of these regulations, “Sexual Harassment” includes such unwelcome sexually determined behaviours whether directly or otherwise, as –
(a) Physical contact and advances;
(b) Demand or request for sexual favours;
(c) Sexually coloured remarks;
(d) Showing any pornography; or
(e) Any other unwelcome physical, verbal or nonverbal conduct of a sexual nature”.
Note - The above instances of misconduct are illustrative in nature, and not exhaustive.
