Where the Director is satisfied that there shall be difficulty in securing proper evidence of the alleged misconduct, or that the member or firm against whom the information or complaint, as the case may be, has been received shall find it difficult to lead evidence to defend himself or itself, as the case may be, on account of the time lag, or that changes have taken place rendering the inquiry procedurally inconvenient or difficult, he may refuse to entertain a complaint or information in respect of any misconduct made more than seven years after the same was alleged to have been committed and submit the same to the Committee.
CHAPTER IV DISCIPLINARY COMMITTEE
13. Functioning of the Committee (1) All questions which come up before the Committee shall be decided by a majority of the Members present and voting, and in the event of an equality of votes, the Presiding Officer or in his absence, the person presiding at the meeting of the Committee, shall have a second or casting vote.
(2) The quorum for any meeting of the Committee shall be two members
(3) In the event of the Presiding Officer not being able to attend the meeting of the Committee, the member of the Council dully elected by the Council under subsection (1) of section 26 of the Act shall act as the Presiding Officer.
