Section 2: Definitions

The Andaman and Niocbar Islands Waqf Board Regulation 2018Union territory Regulations of Andaman and Nicobar Islands · 1995

In these Regulations unless the context otherwise provides:- a) Act means the Wagqf Act, 1995, b) Board means the Board of Waqfs, hereinafter shall be called the Wagqgfs Boards, Andaman " & Nicobar Islands.

c) Chairperson means the Chairperson of the Board.

d) Chief Executive Officer means the Chief Executive Officer of the Board.

€) Lt. Governor means the Administrator of Andaman & Nicobar Islands.

f) Survey Commissioner means the Survey Commissioner of Wagfs appointed under Section 4 of the Waqf Act. ) gl Additional / Assistant Survey Commissioner means Additional / Assistant Survey Commissioner of Wagfs appointed under Section 4 of the Waqf Act.

h) Member means Members of the Board and includes the Chairperson.

i) Convener means Convener of a committee appointed under Section 18 of the Waqf Act,

1995.

J} Committee Members means Member of a committee appointed under Section 18 of the Wagf Act, 1995.

k] Rules means Wagf Board Rules, framed under the Wagf Act, 1995.

2 THE ANDAMAN AND NICOBAR EXTRAORDINARY GAZETTE, OCTOBER 16, 2019 1) Committees means Committees constituted under Section 18 of the Wagf Act, 1995 by the Board for-a particular purpose or for any. specified arca or areas for the supervision of .

Wagfs.

m) Executive Officer r means Executive Officer appointed by the Board under Section 38 of the Act.’ n) Masjid means Mosque or such place where prayers arc performed on regular basis’ by Muslims in Jamaat.

0) New item of expenditure means any expenditure not provided in the budget and being incurred for the (First) time.

p) Form means Forms appended to these Regulations.

q) Qabrastan means Burial place, Takia Khangah and Dargah (Mazar) etc.

2. (a) Words and Expressions used and not defined in the Regulations but defined in the Act shall have the same meanings respectively assigned to them in the Act.

PART-II - CONDUCT OF MEETING OF THE BOARD AND COMMITTEES (Section 17 of the Act)

3. a) There shall ordinarily be 12 meetings: of the Board. every ycar which may be increased to any number depending upon the need for the Bicking. to discuss and resolve important matters and issucs.

b) An extraordinary (apocinl) meeting of the Board may be convened, if the Chairperson so desire necessary or if a requisition in that behalf is presented to the Chairperson: by onc third of the members of the Board setting out Matter/Agenda for consideration in the meeting.

c) An ordinary meeting of the Board may be convened by giving 3 days notice. An extraordinary meeting of the Board may be called by-giving shorter notice.

The notice for the meeting whether ordinary or extraordinary would contain date, time, venue and agenda of the meeting.

d) Three members shall form a quorum of the Board.

e) Where a ‘meeting has been adjourned for Lack of quorum, the adjourned meeting would be held an hour later than the time fixed for original Hiserug at the same venue and agenda of business irrespective of quorum.

f) Al matters brought before the meeting shall be decided by majority of votes of the members presents in the meeting.

g) The Chairperson or the Chief Executive Officer with the approval of the Ctiidparaon of the Board shall convene the meeting of the Board on the agenda approved by the Chairperson.

h) The Chairperson or in his absence any Wie as authorized: pd the Chairperson shall preside the meeting.

i) The Chairperson shall havea 2" or a casting vote in cases of isting of votes.

j)- At the next meeting, the minutes of the previous meeting shall be read and confirmed.

k) The minutes of the meeting shall be recordéd by the Chief Executive Officer and after approval by the Chairperson, it shall be circulated to members.

1) It shall be open to any member to raise any matters not included in the agenda with the permission of the Chairperson provided that in the extraordinary (special) meeting only such business shall be transacted as is included in the agenda.

'm) Proposals relating to formal vote of thanks, message of congratulations or condolence and other matters of the nature be moved without notice from the chair or by any member with the permission of the chair.

n) The Chairperson shall maintain order at the meeting of the Board or Committee, and if a member fails to comply, the Chairperson may exclude him from the rest of the meeting.

0) Every motion by members shall be in the form" of a resolution which must be seconded before it is considered.
