(1) An appeal shall be preferred within one month of the _ date on which the appellant was informed of the order appealed against.
(2) It shall contain all material statements and arguments relied on by the appellant and shall contain no disrespectful or [improper language and shall be complete i in itself. :
(3) Every such appeal shall be: submitted through the Chief Executive Officer or through the.
authority from whose order the appeal is preferred.
1 Withholding of Appeal t— (1) The authority which iissle the order appealed against may withhold an appeal if—
(a) It is ‘an appeal against an order from which no appeal lies;-or
(b) It does not comply with any of the provisions of Regulation 34; or
(c) It is a repetition of an appeal already decided and no new facts or circumstances are adduced:
Provided that an appeal withheld on the ground that it does not. comply. thi the. provisions of sub-regulations (2) or (3) of Regulation 34 shall be returned to the ‘appellant and if resubmitted within one month thereof after compliance ‘with the said: provisions, shall not be. withheld.
(2) Where an appEe, is withheld, the eis shall be informed of the fact and the reasons thereof.
38. Transmission of Appeal t= (1) The authority which made the order appealed against shall, without any avoidable delay, transmit to the appellate authority every appeal which is not.
withheld under Regulation 35 and thereupon ‘such appeal shall be transmitted to ‘that ‘authority together with the comments’ thereon with the relevant record,
(2) The authority to which the appeal lies may direct transmission to it of any ei withheld under Regulation 35 and thereupon such appeal shall be transmitted to that autharity. by: the person withholding the appeal and the relevant record.
