‘(ba) “Rules” means the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Rules,2000’.
3. In the said regulations, in regulation 4,-
(i) in the heading, the words “other than members” shall be omitted;.
(ii) after sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that such person or professional to be associated with the Board shall have three years working experience in the area of disability and shall not be more than sixty five years of age.”;
(iii) in sub- regulation (4), for the words “ to carry out its business, for a duration not exceeding six months”, the words “to carry out the affairs of the Trust for periods not exceeding six months at a time” shall be substituted;
(iv) in sub- regulation (5) for the words “carry out its business”, the words “carry out affairs of the Trust” shall be substituted;
(v) in sub- regulation (6), for the words “carry out the business”, the words “carry out affairs”, shall be substituted;
(vi) in sub- regulation (8) for the words “carry out the business”, the words “carry out affairs” shall be substituted.
4. In the said regulation, in regulation 5, for the words “thirty days”, the words “fifteen days” shall be substituted.
5. In the said regulations, in regulation 6,-
(i) in sub-regulation (1), for the words and letters “Form A or Form E under the rules”, the words and letter “Form A under these regulations” shall be substituted;
(ii) in sub-regulation (2), for the words “having over”, the words “having jurisdiction over” shall be substituted.
6. In the said regulations, in regulation 7,-
(i) after the sub-regulation (1), the following shall be inserted, namely:- “(1A) The promotion of welfare of the persons with disabilities covered under the Act shall be the main object of the organization.
(1B) The organization shall have proper registration as legal entity such as a society or a trust under the respective law or a company under section 8 of the Companies Act, 2013 (18 of 2013) which has been in existence for at least three years.
(1C) The organization shall also have registration with the respective State Government or Union territory, as the case may be, under the provisions of the Right of Persons with Disabilities Act, 2016 (49 of 2016) and shall also be registered with ‘NGO DARPAN’ portal of the National Institution for Transforming India (NITI Aayog).
(1D) The updated online registration form shall be made available on the website of the Trust.”;
(ii) for sub-regulation (4), the following sub-regulation shall be substituted, namely:- “(4) The granting authority may either grant registration or refuse registration on the basis of the facts and circumstances of each case and record reasons in writing therefor.”;
(iii) after sub-regulation (8), the following sub-regulation shall be substituted, namely:- “(8A). The Board shall complete the registration process within thirty days of submission of all required documents by the applicant.”;
(iv) in sub-regulation (10), after the words “cancel the registration”, the words “, based on the facts and circumstances of each case by recording reasons in writing,” shall be inserted.
