Section 4: Permission to cut the specif ied trees

(1) Any Bhumiswami belonging to an Aboriginal Tribe, who intends to cut any specif ied tree standing on his holding shal l apply for permission to the Col lector, in the prescribed form, giving ful l and complete reasons thereof in such manner as may be prescribed.

(2) The Col lector shal l have the appl icat ion enquired into in accordance with such rules as may be prescribed and shal l not grant or reject the appl icat ion without considering the report from Tahsi ldar, the Sub-Divisional Off icer (Revenue) and the Divisional Forest Off icer having terr i tor ial jur isdict ion:

Provided that no such permission shal l be granted in a case where a period of f ive years has not elapsed after the date of acquisi t ion of t i t le in the land in any manner except by succession.

Explanation.- The date of acquisi t ion of t i t le shal l be the date of cert i f icat ion of mutat ion under the Code.

(3) The permission to cut the trees in a year shall be restricted only to such number of speci f ied trees as may fetch the Bhumiswami such amount of money, not exceeding rupees f i f ty thousand in a year as is considered by the Col lector to be adequate to meet the purpose specified in the appl icat ion:

Provided that under special circumstances the Col lector may, after due considerat ion, grant permission in a year for a value not exceeding ‘ [rupees two lakhJ or the value of one tree, whichever is higher.
