(1) Bhumiswami shall give application in Form-A, for felling of naturally growth trees on his land, to Sub-Divisional Officer (revenue), who will forward it for joint inspection to revenue officer/staff not below Revenue Inspector and forest officer/staff not below Vanpal.
Inspection report in Form-B, including the title of Bhumiswami with respect to the trees, registration in revenue records, death/maturity of trees, indispensability of felling for agriculture/business of Bhumiswami etc, shall be sent within 30 workdays.
(2) Sub-Divisional Officer (revenue) shall send his permission in Form-C, to applicant and Divisional Forest Officer, within 45 workdays of receiving the application. If the applicant does not receive written decision of Sub-Divisional Officer (revenue) on his application within 45 workdays, he may give reminder by another written application. If any written decision of Sub-Divisional Officer (revenue) is again not received in further period of 30 workdays, then it shall be presumed that the permission has been given on the application and the applicant shall be free for felling of asked trees. The Sub-Divisional Officer (revenue) shall be responsible for the delay in this regard and the contravention of rules, if any.
(3) The felling of naturally grown trees may be permitted for maximum 04 trees per acre and maximum 10 trees in total over a land holding, in a calendar year.
(4) Bhumiswami may cut down trees subject to the provisions of the Chhattisgarh Transit (Forest Produce) Rules, 2001, framed under the Chhattisgarh Van Upaj (Vyapar Viniyaman) Adhiniyam, 1969 (No.9 of 1969) and Indian Forest Act, 1927 (No.16 of 1927). Within 30 workdays of receiving competent permission, Divisional Forest Officer, ensuring the felling of trees and transit to depo and calculating the value of log as per fixed rates, shall deposit 95% of total value in bank account of the Bhumiswami, and remaining 05% value shall be deposited in a fixed account of forest department. From deposited amount, forestation and their upkeep by forest department shall be done in number 05 times of each felled tree.
Trees of minimum 6 feet shall be planted by forest department and the report of plantation shall be given to Collector, through Sub-Divisional Officer (revenue), each year.
(5) The permission, granted under these rules, shall be valid till one calendar year from the date of application.
