· (7) Gram Panchayatl..evel Committee shall be constituted consisting ofSarpanch, Ex-sarpanch. Chai11nan of the forest management commiltee, Patwari and Beat Guard. Likewise sub-divisional level commillcc shall be constituted consisting of Sub-divisional Officer (Civil), Sub-divisional Officer (Forest). Janapad Chairman and Ex-Janapad Chairman of the concerned Janapad Panchayat. Sub-divisional Officer (Civil) will he the convenor of the commince.
(8) Permission to cut the trees will be granted by the competent authority on the recommendation of the Gram Panchayat Level Committee made as per rules.
(9) Sub-divisional Level Commi1tee will have powers to supervise activities of Gram Pr,nchayat Lel'cl Commillees and enquire into the complaints.
(10) No permission to cut the tree shall be granted unless the bhumiswami plants double the number of trees in his own land or has deposited the amount@ rupees 150/- per tree in the concerning Pnnchayai which will be kept in Panchayat as "Plantation Fund". If the Gram Panchayai Level Committee recommends that the bhumiswami has planted trees in the required number, looked after it and the plants have surviving, the aho\'e amount can be refundable after three months from the date of plantation, otherwise the amount wi II he uti lizcd for plantation by the Gram Panchayat. No amount will be recovered from the Bhumiswamis belonging 10 Below Poverty Line-families.

~- 'i: "&A, am~- No. F-7-3/Revenue/2002.-In exercise of the powers conferred by Sub-section (I) and clause (I-xii) of Sub-section . (21-of Section 258 read with Section 241 of Chhattisgarh Land Revenue Code, 1959, the State Government hereby makes . the following amendments in the existing rules.- Rules I. For sub-rule (I) of rule 3, which has been framed under Sub section (2) and (3) of Section 241 of the Chhattisgarh Land Revenue, Code, 1959, the following rule shall be substituted, namely :- "On receipt of the application the Collector shall immediately forward the application to the Divisional Forest Officer for :·opinion with respect to factors concerning the pfotection of forest and cutting of timber trees. The Divisional Forest Officer shall send his opinion with in thirty days from the date ofreceipt of the application to the Collector keeping in view the ginh of trees, condition, growth and justification in regard to cutting of timber trees applied for. The Collector shall send second copy of the application to the Panchayat Level Committee constituted under rule 7 of the rules framed under Section 240 (i) of the code for its opinion regarding ownership and cutting of the trees, which will send its recommendation within 30days. After considering the opinion and recommendation.
the collector shall take decision on the application of cutting of timber trees applied for taking in to account the public interest and trees required to be retained for further development and growth of the forest as well as prevention of soil erosion".
2. For sub-rule (I) of rule 10, which has been framed under said section of said code, the following rule shall be substituted, namely :~ "10 (!)No timber.piece shall be removed from the stump site unless it is duly hammer-marked and the applicant obtains transit pass under the provisions of Chruittisgarh Transit (Forest Produce) Rules, 2001 :·
3. After sub-rule (3) of rule 10, which has been framed under said section of aforesaid Code, the following sub-rules shall be inserted namely :- ( 4) No permission to cut the timber tree shall be granted unless the bhumiswami plants double the number of trees · in his own land or has deposited the amount @.rupees 150/- per tree in the concerning Panchaya which will be kept in Panchayat as "Plantation Fund". If the Gram Panchayat Level Committee recommends that the bhumiswami has planted trees in ther~quired number, looked after it and the plants have surviving, ti. ahove amount can be refundable after three months from the dale of plantation, otherwise the amount will be utilized for plantation by the Gram Panchayat. No amount will be recovered from the bhumiswamis belonging to Below Poverty Line-families.
(5) Sarpanch, Patwari and Kotwar shall be responsible for the safety of the timber trees standing of Revenue Land. Monthly Statement of illegal felling or removing of timber trees shall be prepared by Patwari and the • 142(4) .
' Tahsildar shall verify the statement and send it to the Collector and he will take all necessary steps lo prevent illegal felling or removing of timber trees.
(6) Revenue areas where large number of timber trees are standing and adjacent to the forest boundaries shall be notified as Protected Forest or Panchayat Forest and shall be handed over accordingly to the concerned. viz Panchayat or Forest Department and the same will be managed by joint Forest Management Committee of Panchayat Forest Commiuee as the case may be.
4. In the rules, which has been framed under Sub-section (2), (3) of Section 241 of the said code, the words "Sub Divisional Officer" it occurs the word "Collector" shall be substituted.
