(1) Bhumiswami may cut down trees planted as agriculture in his land, subject to the provisions of the Chhattisgarh Transit (Forest Produce) Rules, 2001, framed under the Chhattisgarh Van Upaj (Vyapar Viniyaman) Adhiniyam, 1969 (No. 9 of 1969) and Indian Forest Act, 1927 (No. 16 of 1927). The intimation in from-F clearly mentioning the reason of cutting, species and number, is necessary to be given, one month prior to the cutting, to the Sub-Divisional Officer (revenue) and Forest Range Officer. The revenue record related to registration and self-declaration in form-G are to given with the intimation. Sub-Divisional Officer (revenue) shall ensure, through Patwari and Vanpal, the documentary and physical verification of the intimation and the self-declaration provided by Bhumiswami, before the felling of trees.
(2) The forest department, on written expression by the Bhumiswami, may cut down trees planted as agriculture in his land, within 30 workdays of the expression.
Divisional Forest Officer, ensuring the felling of trees and transit to depo and calculating the value of log as per fixed rates, shall deposit 90% of total value in bank account of the Bhumiswami, and remaining 10% value shall be deposited in a fixed account of forest department. From deposited amount, forestation and their upkeep by forest department, shall be done in number 10 times of each felled tree. Trees of minimum 6 feet shall be planted by forest department and the report of plantation shall be given to Collector, through Sub-Divisional Officer (revenue), each year.
