After clause (e) of sub-rule ( 1) of Rule 2, the following shall be inserted, namely:- ~(e- 1) "End use plant" means the plant where the mineral shall be used finally."
2. For sub-rule (5) of Rule 4, the following shall be substituted, namely:- "(5) (i) Mines of each such metallic ore, in which royalty on mineral (Ad valorem basis) is fixed on the basis of metal con ent of ore and benchmarks prices, the lessee shall conduct sampling as per the criteria fixed by the Bureau of Indian Standards prior to dispatch of the mineral produced.
(ii) Mining lease holder shall establish a laboratory as per the standard of Bureau of Indian Standards for analysis of these samples within mining lease area and carrying out chemical analysis of the samples. In special circumstances, the laboratory may be established outside the mining lease area after obtaining exemption from the Director.
(iii) The mining lease holder shall also submit monthly and yearly returns in the prescribed format as per rule 45 (as amended) of Mineral Conservation and Development Rules, 1988, timely to the Director and the concerned Collector of the District in addition to the specified Departments/Institutions.
(iv) All the m ining leases of metallic ores operating in the State, in which there is a provision of royalty to be charged on the basis of metal content in mineral ore and benchmark prices, information about grade (metal content) of the ore shall be collected after conducting sampling and its analysis from the committee constituted by the Director atleast once in a year.
(v) If for any special reason, the Mining Lease holder is facing difficulty in conducting sampling of the mineral ores to be extracted from leased area then 368 (6) he shall have to submit an application to the Director stating reason and justification for the same. Director, if satisfied with the reason stated by the Mining Lease holder then he may grant permission for extraction without sampling of minerals from the mining lease area with condition that Mining Lease holder shall pay the royalty to the Government at prevailing rates for the time being, on the basis of the grade (metal content) of the mineral ore mentioned in approved mining plan submitted by the mining lease holder or obtained from previous sampling conducted by the Directorate, whichever is higher:
Provided that, in case of iron ore, the leasee may be granted any such an exemption on condition of payment of royalty specified for highest grade slab for the State of Chhattisgarh."
