(1) Where any person has been convicted for contravening any of the provisions of the Act or any rule made thereunder, the stock of medical device in respect of which the contravention has been made shall be liable to confiscation.

(2) Where any person has been convicted for manufacturing any medical device notified under sub clause (iv) of clause (b) of section 3 of the Act, which is deemed to be misbranded, adulterated or spurious, for sale, stocking or exhibiting for sale or distribution without a valid licence or licence, any implements or machinery used in such manufacture, sale or distribution and any receptable, package or covering in which such medical device is contained and the animals, vehicles, vessels or other conveyances used in carrying such medical device shall be liable to confiscation.
