The Global Open University (Nagaland) Act, 2006State Act of Nagaland · Act 3 of 2006

(1) The Government ornagatand has powers to give directives to the University if mismanagement, maladministration, indiscipline financial crisis and f d m to comply with this Act and regulations made thereunder, come to notice of the Government of Nagaland.

(2) The University shall comply with all the directives given to it by the Government ofNagaland.

Dissolution 5 8. (1 ) If aresolution by the highest dec~sion making body of the Tmstpassed for the dissolution of the University or a Bill for repeal of this Act is passed by the Nagaland Legislative Assembly and assented to by the Governor o f N a g a l 4 for gross inability ofthe University to cany out its functions in accordancewith this Act and regulations made thereunder, the University shall stand dissolved within one year of the passing of the resolution or the Act.

Provided that any such resolution passed by the Trust may be rescinded by it before the expity of one year h m the date of passing ofthe on& resolution.

(2) The dissolution shall not affect the pursuit of courses by students but no further enrolment of students shall fake place from the date of passing of the resolution or Act and if for any reason, such continued pursuit of courses by students is not possible, the Trust shall take necessary steps for transferring the studies of students to other institutions, organizations or Universities., m consolation with UGC etc., or provide reasonable financial compensation in lieu thereof, as may be determined by the Governing Council ofthe University:

(3) The moneys in the Endowment Fund of the University shall be exclusively applled forthe purposes ofrehabilitatingthe students and others affected by the dissolution ofthe University. .

(4) The State Government shall have overriding powers to monitor and ensure the implementahon of the provisions in h s section and, in case of any failure of the University to discharge its obligations, it this section and, in case of any failure of the assets of the Universi$ at anytime, f o r m the obligations either by itselfor by appointing an agency on its behalf.

(5) After all the obligations under this section have been met, the remaining funds, assets and liabilities of the University shall stand b-ansferred to the Chapter IX Regulations ..
