An interested party may receive the assets which have been allotted to him in the partition before the order of homologation becomes final; however, the assets shall be handed over only upon such party furnishing security, in case of negotiable instruments, shares and securities an endorsement shall be made that the holder shall not transfer or assign such assets, without the order of the Court. Security shall also be obtained in cases where a paternity suit, suit for annulment of a will, or any other suit the decision of which is likely to affect the partition is pending.
